Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. We have made modifications to the project description and various notes on the application drawings, which includes the installation of a longer and wider ramp with no increased encroachment into Silver Eel Cove as discussed at the workshop at the Trustees meeting on August 22, 2012. The new bulkhead alignment will be landwazd of the existing steel sheet piling. The new counter weight towers and bumper system will remain in close proximity to their existing location and previously authorized locations. This work appears to be covered by the US Army Corps Nationwide Permit No. 3 and is consistent with NYS DEC Tidal Wetlands regulatory for "adjacent areas", with no tidal wetlands or submerged aquatic vegetation resources on the site. Our preliminary indications aze that the NYS DEC will process as a minor modification. I have enclosed a check for $100.00 for the Coastal Erosion and Tidal Wetlands permit modifications. The attached conceptual plans are as follows: Plan A represents instillation of an 18 foot wide by 24 foot long ramp. The new bulkhead could be run inside the existing southeast and southwest walls of the ramp well, requiring removal of the northwest wall and the wall beyond that going over the Coast Guard facility. I have shaded the area in where this wall removal will be taken place and it is blue to represent open water. The ramp is shown to scale, along with the new counter weight towers, the counter weights and the bumper piles. Note that this option will also require relocation of the outer dolphin at the port stern of the ferry. Concept plan B represents an 18 foot wide by 30 foot long ramp and this ramp is set back into the existing drive. The southeast wall is inside of the existing southeast wall of the ramp well which should ease construction options slightly, but requires the ramp to be slid farther to the northwest which crowds the property line and requires dolphin relocation out beyond the property line. The new bulkhead is recessed approximately 6 feet into the existing property which makes room for the new ramp, without exceeding the existing ramp footprint. This keeps the race point inside of the critical clearance s that was discussed during previous design iterations. Concept plan C involves the most work because all four of the interior walls of the lift well and the wall running to the Coast Guard will be removed. The new wall will be set back 6 feet into the pavement, allowing the new 18 by 30 foot ramp to occupy the existing ramp footprint. The counter weight towers counter weights, and bumper piles are shown. This concept does not necessarily require relocation of any of the dolphins. I have also included a sketch titled existing conditions which you can make use of as you see fit to develop other options which may arise during discussions. Most prominent in the foreground are the two dolphins which guide and hold the ferry in position during the berthing maneuvers and during adverse wind from the north and northwest. The first dolphin is 13 piles. The other three in this photograph are 7-pile dolphins. The bumper protection fenders straddling the ramp are 3- pile dolphins. The counterweight towers are visible behind those dolphins. The ramp is the upper left center of the photograph, the bright spot looking right down the exit roadway out of the ferry terminal. The terminal office building is to the left and the Coast Guard Station is to the far right of the photograph. As you can see, there is no conflict between ferry berthing facilities and the Coast Guard docking facilities which are immediately in front of the station building. Also indicate if there would be any barge overflow. MOORING FACILITIES Answer the following if your project includes the construction or rehabilitation of recreational mooring facilitles. t. It Is generally recommended that any fixed piers and walk ramps be limited to four feet in width, and that floats be-Ilmlted to eight feet In width and rest at least two feet above the waterway bottom at mean low water. Terminal floats at private, non- commercial facilities should be limited to 29 feet In length. If you do not believe your proposal can meet with these recommendations, please provide the reason(s). The existing ferry temtinal landing ramp has existed at this site since 1985 in its current shape, configuration and width, associated counterweight support towers and protective dolphins at the face of the ramp as well as lining the slip. While the least costly method of restoring the ramp is to simply refurbish the existing facilities and replace the counterweight support towers and protective dolphins, it may be financially prudent to install a new ramp if the project can fit within budgetary limitations of the Ferry District. For that reason, several different options are being considered. The ramp geometry is a matter of public safety and vehicle operational efficiency both for loading and disembarking on the ferries. Regardless of the ultimate dimension of the ramp, this structure will not impinge on navigable waters or the unencumbered use of Silver Eel Cove by vessels other than the Fishers Island ferries. 2. Using your plan view, show to scale the location(s), position(s) and size(s) (including length, beam and draft) of vessel(s) to be moored at the proposed facility, including those of transient vessel(s) if known. 3. For commerc/al mooring sites such as marinas, indicate the capacity of the Facility and Indicate on the plan view the location(s) of any proposed fueling and/or sewage pumpout facilitles. If pumpout facilitles are not planned, please discuss the ret/onale below and indicate the distance to the nearest available pumpout station. There are no fueling or sewage pump-out facilities at this site. All of those facilities exist at the New London Terminal for the support of the vessels. 4. Indicate on your plan view the distance to adjacent marine structures, if any are proximate and show the locations and dimensions of such structures. The offsets to adjacent marine structures are shown on Sheet 2 of the application drawings. 5. Discuss the net~for wave protection at the pr~sed facility. Please be advised that if a it Js issued, you would be re d to recognize that the mooring facility may be subject to wave action from wakes of passing vessels, whose operations would not be required to be modified. Issuance of a permit would not relieve you of ensuring the Integrity of the authorized structure(s) and the United States would not be held responsible for damages to the structure(s) and vessel(s) moored thereto from wakes from passing vessels. There is no overwhelming need for wave protection at this proposed facility. Silver Eel Cove faces north /northwesterly and it is rare that waves from Long Island Sound or Fishers Island Sound have direct access into Silver Eel Cove. On those rare occasions when the waves are from the north /northwest, ferry operations have to be altered or sometimes discontinued. BULKHEAD/NG/BANK STABILIZATION/FILLING ACTIVITIES Answer the following !f your project inclues construction of bullfheading (also - retalning walls and seawalls) with backfill, filling of waters/wetlands, or any other bank stabllizat/on f11/s such as rlprap, revetments, gabions, etc. 1. Indicate the total volume of sill (including backflll behind a structure such as a bulkhead) as well as the volume of fill to be placed into waters of the United States. The amount of fill in waters of the United States can be determ/ned by calculating the amount of fill to be placed below the plane of spring high tide In tidal areas and below ordinary high water in non-tidal areas. In the event that the scour wall sheet piling is installed for the protection of the existing terminal bulkhead facilities, the length of the structure and the total volume of the back fill has been set forth on the drawings. The bulkheading would be 40 feet long and the backfill would be approximately 80 CY over 150 SF. The backfill will be clean gravel, crushed stone or concrete or a combination of two or three of those materials. 2. Ind/cate the source(s) and type(s) of fl// material. Concrete will come from a commercial producer such as TelCon in Connecticut. Clean gravel can come from upland sources on Fishers Island, all of which is clean. Crushed stone would also have to come from a Connecticut earthworks contractor such as TelCon 3. Indicate the method of fill placement (i.e. by hand, bulldozer, crane, etc.). Would any temporary fills be required in waterways or wetlands to provide access for construction equipment? If so, please Indicate the area of such waters and/or wetlands to be filled, and show on the plan and sectional views. Fill for behind the scour wall will be placed by machine using special devices and shielding to make sure that the concrete, crushed stone or gravel is all placed within the confines of the steel sheet pile /scour wall bulkhead. Local program documents are also available for inspection at the offices of the appropriate local government. -3- C:OFFICE/WPWIN/WPDOCS/fcafl (Revised 10/15/99) RAMP REPAIRS AND RESTORATION PROPERTY OF FISHERS ISLAND FERRY DISTRICT SILVER EEL COVE, FISHERS ISLAND NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION January 24, 2011 GENERAL DESCRIPTION The Fishers Island Ferry District Terminal on the island is pazcel 1000-012-1-10 on Trumbull Avenue located along the west shore of Silver Eel Cove. The site is generally very slightly sloped and mostly paved over sandy gravel earthen materials bordered by residential property to the south and west and the Coast Guazd to the north. The frontage of the property is approximately 250 Feet of wharf and terminal ferry landing facilities. This project is the replacement or repair and restoration of the main ramp utilized by the Fishers Island Ferry potentially enlarging the ramp 22 feet wide by 30 feet long in Silver Eel Cove on Fishers Island. The scope of work includes removal of an existing 14-ft. wide by 24-fr. long steel and wood ramp, counterweight towers, protective dolphins (3-pile) and a ramp support beam structure if the repair/restoration option is pursued, the 14-ft. wide by 24-ft long steel framed wood, decked ramp will be stripped of the wood decking, sand blasted clean, repaired, recoated, new deck structure of wood timbers with steel tread plating will be mounted and the ramp will then be re-installed. If the ramp is not salvageable, it will be re-built. The new work will include placement of a new pile supported ramp support beam with pile braces, ramp support framework and bumper, counterweight towers and two protective 3-pile dolphins. This supplemental narrative has been prepazed in accordance with the requirements of Town of Southold's, Ordinance No. 6, 2004, and the Local Waterfront Revitalization Program related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State and Section 661 of the NYS Department of Environmental Conservation regulations for Tidal Wetlands and adjacent azeas. PROJECT PURPOSE This existing ramp and landing system at Silver Eel Cove was built approximately 25 years ago. The system has corroded and deteriorated under climatic conditions and routine weaz and teaz and must be repaired and / or replaced in order to provide the Ferry District with a viable, structurally sound second loading slip on the island for use during peak periods when weather allows. The Ferry District will, if budgets allow, opt to enlazge the ramps to be the same size and strength as those at their New London Terminal. 1 • ADJACENT PROPERTY OWNERS The Town of Southold owns land adjacent to the Fishers Island Ferry Terminal site on the southeast. The Federal Government owns the pazcel to the north, immediately adjacent to the ramp project site, operating it as the Fishers Island Coast Guard Station. PROJECT ALTERNATIVES It is difficult to determine one best course of action to pursue. There are only three real options for the Ferry District to pursue at this time. • Do nothing • Re-build and repair the existing facilities as is • Modify the facilities in some way to improve the efficiency or capacity of the ramp system. The "do nothing" option is not considered viable or appropriate because the existing ramp is in such condition that failure to rehabilitate the structure will necessitate the discontinuance of its use. The next option is to refurbish the ramp as it exists today. The proposed counter weight support towers, dolphins and ramp support beam and bumper system will be virtually identical to the structures that now exist for the cun•ent corner ramp, just located in a position which will allow for the proper operation of the cun•ent ramp. While this is the least costly option, reconstruction of the ramp to match the length and possibly the width to the maximum extent possible, and strengthening it to match the New London Terminal facility capabilities should be considered if the budget will allow it. The third option would be to rebuild the main ramp facilities to accommodate a wider ramp for easier vehicle access especially for trucks and over-sized vehicles. The existing ramp is relatively narrow to serve either ferry, MV RACE POINT and MV MUNNATAUCKET, the beams of which are 33' and 30' respectively. The existing ramp does not land on the center of the vessels but favors the port side in both cases, thus requiring vehicles to be maneuvered, sometimes significantly, to disembazk and equally importantly, to load the vessel. It may be in the best interest operational efficiency to have ramps centered on the ferries and approximately 6 feet larger to match the pitch of the ramps in New London. The widening project alone would require upland shoreline structure modifications and ramp support facilities modifications thus significantly increasing the project budget . 2 • SEQUENCE OF WORK As mentioned in the introductory pazagraph, this project is to replace or repair and restore the main ramp in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. It is envisioned that [his structure will be accomplished utilizing the following general sequence and methodology. ? The marine contractor will arrive by bazge with deck-mounted crane, push or tug boat and at least one work boat. ? The existing ramp, counterweight support tower and fender dolphins will be removed and the contractor's bazge will leave the site. ? If the ramp refurbishment is pursued the ramp will be dismantled elsewhere, steel components will be sand blasted, welded connections and steel components will be checked and repaired as necessary then re-assembled and coated with coal taz epoxy. New decking, tread strips and rails will be attached. ? If the new lazger ramp option is exercised, the framework will be manufactured and steel grate decking will be attached for shipment to the site and installation. ? If a new ramp is to be installed, the new ramp support structure and scour protection will be installed while the ramp is being manufactured. ? New piles for ramp support counterweights and fenders will be driven at the general locations shown in the application drawings pending subsurface obstructions. These piles will be driven by double-acting air powered hammer to a bearing resistance of approximately 20 tons. This generally results in about ten feet of embedment of the pile in the bearing stratum. Dolphin piles will be Class B 16-inch nominal diameter measured at 3 feet from the butt; the counterweight tower piles will be 16-inch steel. ? After the steel counterweight piles are installed, a sheave frame of two steel channels will be welded or "T" top piece. This will support the sheaves and provide a mounting for the ramp's motorized chain hoist. ? After the beam stringers have been connected to the hoist support beam, the decking will be installed. This decking will be pressure-treated Southern Yellow Pine 4x or 6x timber, for structural longevity or steel grating. . ? The alignment of the ramp will still be perpendicular to shore. ? The hinged ramp will be installed so as to land on and be secured to the new or rebuilt support beam standing in front of the bulkhead. ? Water and electricity will be run out on the ramp in the space between the outer ramp deck stringer and the counterweight tower to power the hoist. A power post control box will be mounted to the counterweight tower with receptacles to provide power for tools using extension cords. The power post will also have a coiling arm for storage of the cords and hoist controls between uses. This system will be manually controlled from shade so that the power will only be on when necessary for operations. 3 • REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW The pernuttee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town and its officers. The perrnittee gives consent to the Town and its officers, employees and agents to enter upon the premises where such operations aze being conducted to make such inspections to determine whether said operations aze being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standazds of Residential and Commercial Docks, the following additional information is offered. 1. Permits for the work aze being applied for through the Town, US ACOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. 2. The new fender dolphin piles to be installed, if wood, will be of sturdy, durable and stable materials; in all likelihood, CCA pressure-treated Southern Yellow Pine piles, one 1" bolt per connection and wrapped with galvanized cables. This ramp facility is a fixed, pile-supported structure and even if it is enlazged, does not adversely affect the free circulation of water or reduce the effects of fluctuating water levels in Silver Eel Cove. In addition, it does not present an adverse modification of the shoreline. The pier's elevation is such that in extreme high flood tides the hinged ramp landing of the structure might be flooded. Southern Yellow Pine timber materials aze specifically grown and prepared for this purpose, treated for exposure to hazsh, marine conditions and represent the standazd of the industry. With the connections described above, this structure will be able to survive repeated inundations. 3. It is respectfully requested that the use of CCA pressure-treated piles and timber decking be approved for this project. 4 4. The ramp will be decked with CCA pressure-treated Southern Pine or steel grating. This ramp is also the walkway that provides safe pedestrian surface for access to the berthed ferry. If wood, the ramp deck will have steel vehicle tread plates; if steel grating, the deck will have a steel plate pedestrian walkway. 5. The 15-foot property line clearance specified in this pazagraph should not be an issue as shown on sheet 2 of the application drawings. Even if the ramp is widened and the ramp or the accessory pile structures encroach on the offset, there will be no operational conflict imposed on the USCG waterfront. This project replaces an existing ramp with the same refurbished ramp and laid out to make reasonable use of a small cove reaching adequate water depth yet maintains adequate clearance from existing structures and the likely azea of new structures on adjacent properties. During the last USCG wharf modification project, docking facilities were relocated to the northeast end of the site, cleaz of the existing Terminal banding facilities. 6. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to the most seaward face of one of the fenders/dolphins for identification from the water. 7. There are no permanent structures located above the ramp decking other than the power post, lights and railing nor aze any planned at this time. 8. There is no need to provide adequate room for afive-foot passage way on the upland to get under this ramp. There is no room to walk along the nazrow shoreline at this site and the ramp operations area is fenced to provide inadvertent entry protection for the public. There aze no public trust lands to walk on so this requirement is really not applicable to this project or for this site. The new ramp will probably be up to 4 feet (from the centerline) wider but the new counterweight towers and fender pile aze single pile structures. The footprint occupied will be very similaz to existing conditions and the Coast Guard occupies and utilizes the northerly end of this site, a hundred feet or so to the north. US Armv Coros of Engineers - This project is also covered under Nationwide Permit #3 of the US Army Corps of Engineers. A ramp enlazgement may require an individual permit. 5 • NYS DEC Tidal Wetlands Reeulations -Sections 661.5 and 661.9 This project represents the replacement or reconstruction of along-standing existing ferry landing at the Fishers Island Ferry District property in Silver Eel Cove. The ramp facilities to be rebuilt include the ramp counterweight support towers and the Fender dolphins (3 pile and 7 pile). This ramp landing facility was built in the mid-1980's and has been routinely maintained since that time. The most recent DEC permitting for repairs and restoration was received in 1998 and restoration work was accomplished see NYS DEC Permit No. 1-4738-00396/00007 attached. A ferry landing on the waterfront is considered to be generally compatible use in an adjacent azea (AA) with a permit being required under Section 661.5 (b) (1), IS and 24. Under Section 661.9, the standazds for issuance of permits of NYS DEC regulations, the following aze considered to be pertinent considerations. The policies aze created to preserve and protect tidal wetlands and prevent their despoliation and destruction and [hat regulated activities will not have an undo adverse impact on the present or potential value of the affected tidal wetlands. There are no tidal wetlands on the project site. The existing ramp landing occupies a small portion of the property. Tidal wetlands vegetation does exist in small sporadic colonies east of the site on the east shore cove. This vegetation, however, does not constitute a tidal wetlands and it will not be adversely affected by the project. This ramp landing facility refurbishment or replacement project is compatible with public health and welfaze policies of the State specifically referenced under Section 661.6. ? The project complies with development restrictions contained in Section 661.6 as this is reconstruction of an existing, long-standing facility that has previously undergone review by [he Department in rendering a previous permit referenced above. Furthermore, the project supports the continued operation of a long-standing waterfront dock facility structure and is compatible with the use of the site, zoning and the long-standing use of the site. ? This project will not have an undo or adverse impact on the present or potential value of neazby tidal wetlands vegetation. There are no tidal wetlands on the west side of the cove; all of the terminal shoreline is developed shorefront. Construction materials will be in accordance with the NYS DEC standards and Town of Southold regulations and laws as previously addressed. 6 • Town of Southold - LWRP. NYS DOS Coastal Consistency These application documents include a copy of the Town of Southold Local Waterfront Revitalization Program (LWRP) work sheet addressing pertinent sections of the plan. The following policies from the Local Waterfront Revitalization Program are appropriate. These application documents also include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State which tied to the LWRP. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2 -Water Dependent Uses -This project is to retain a fully functional water dependent use of a docking facility for an essential ferry transportation facility at this site. Polic~5 -Use of Existin Developed Shorefront -This project will be primarily to replace or rebuild existing shore /vessel interface structures, cleaz of sensitive habitat or tidal wetlands and make them safe and reliably usable in all weather conditions. Policy 7 - Sitmificant Fish & Wildlife Habitat -Protection of significant fish and wildlife habitat has been considered in the development of this project layout and the waters azound Fishers Island are classified as essential fish habitat however Silver Eel Cove is more of a commercial /industrial facility. In any case, these facilities will be restored in kind. Policy 8 -Protection & Preservation of Habitat -Protection and preservation of habitat has also been considered in this project and the ramp facility is being kept to its minimal configuration consistent with standazds of the industry and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold. Even if it is expanded, the facility still, substantially, will operate at the same location and within the same footprint as the current operation. There aze no significant changes to the dimension or configuration of the ramp facilities. Policy 11 -Minimize Damage to Natural Resources - The shoreline runs north south and is shaded by the wharf complex. The ramp repair and restoration or enlazgement project has been laid out in such a way to be consistent with and so as to minimize impact to natural resources as identified in Policy 7 above. There are no sensitive fringe growth and there is no submerged aquatic vegetation in the sub-tidal zone where the ramp facility is to be located. Policv 14 - No Measurable Increase in Floodine - This project consists of repair or replacement of ferry ramp facilities that will in no way adversely affect water flow and circulation in Silver Eel Cove or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound and Block Island Sound and this structure will have no adverse influence on those flood levels. _Policv 15 - No Dred¢ine -Dredging is not required in this project. The water in this tiny cove gets appreciably deeper off shore quickly and the ferry arrival and departure maneuvering tends to keep the finer-grained sediments from accreting at this site 7 Policy 19 -Impact on Public Access -Public access will not be jeopardized or impeded as a result of this project. There is no public access to or usage of the public trust lands at this site; there is no intertidal zone. Thus, public access to the State's waters is not possible at this site because of the design of the ferry terminal facilities. The public does enjoy the passive recreation opportunities of the site and they will not change. Policy 20 -Public Trust Compatibility with Existing Adjoining Properties and Land Uses- Public Trust compatibility with borders and existing adjoining properties and land uses has also been considered in this project. The Coast Guazd property to the north has a small docking facility but this ramp restoration project will not interfere with an existing or possible future facilities on immediately adjoining properties. Policy 21 -Water Dependent Recreation -This project is consistent with water-dependent uses opportunities policies set forth in this section. The ramp system will be used for essential transportation at the ferry terminal. Policy 24 -Scenic Resources. Impairment or Loss - This policy is designed to prevent impairment or loss of scenic resources. The construction of the ramp facilities will not represent any new encroachment or structure which would create a loss of scenic resources. The elevated inboazd section to be extended will be lazgely over-shadowed by the existing shorefront terminal facilities as well as those at the Coast Guazd Station. Policy 25 -Enhance Overall Scenic Ouality - The new ramp facilities will be consistent with the scenic quality of the azea and prevent loss of scenic resources as described in Policy 24 above. The refurbished facilities will hazdly be noticeable in context with the other existing facilities which dominate the west shore of the cove. Policy 44 -Preserve and Protect Tidal Wetlands -There is no tidal wetlands on this site. None of the terminal facilities abut tidal wetlands and this project will have no adverse impact on wetlands vegetation which might exist elsewhere in the cove. SUMMARY This project is to replace or retain, repair and rehabilitate or replace the main ramp and associated facilities for the Fishers Island Ferry Terminal on Fishers Island. A copy of all US Army Corps of Engineers, NYS DEC, and DOS and Town of Southold applications aze attached as substantiation for this project.
