Area shall be replanted with the stockpiled sod, and all with the Condition the newly constructed and vegetated wetland area retains an 85% success rate for two (2) growing seasons, and as depicted on the site plan for the recreational path prepared by Richard H. Strouse last revised March 7, 2011 and site plan for the Fishers Island Golf Club prepared by Richard H. Strouse dated August and both stamped approved on March 23, 2011. Environmental Consulting Services on behalf of FISHERS ISLAND DEVELOPMENT CORP. applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated October 1, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, ~' WHEREAS~ a Public Hearing was held by the Town Trustees .W th respect to'sa d application on March 23, 2011, at which time all interested pets~)ns were given an opportunity to be heard, and, WHEREAS, the Board r~embers have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees has found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVES the application of FISHERS ISLAND DEVELOPMENT CORP. to construct an 8'X 132' Thru Flow boardwalk in the area of "Boker Doyle" and maintain a minimum of 18" from bottom of structure to wetlands elevation, construct an 8'X 300' elevated boardwalk supported on helical anchors in the area of"Barleyfield Cove". Box 1179 Southold, N.Y. 11971-1179 MAR 1 4 2011 RE: Fishers Island Development Corporation Proposed Permit Modifications East End Road, Fishers Island Dear Ms. Doherty: I am presently writing you as a follow up to the recent (2/23/11) inspection of this project site that I attended with Mr. James King, the project engineer (Mr. Richard Strouse) and representatives of the NYSDEC. At that time, there were suggested recommendations to our current proposal for this project. The first was our proposed permit modification of the approved 4'x 300' boardwalk, utilizing open grate decking at "the area" Barley Field Cove; to widen the boardwalk to 8' in width. This proposal would have resulted in approximately 1,315 s.f. of wetlands under the proposed walk. Upon inspection of the site it was recommended that the proposed boardwalk be located 6" closer to the existing paved road (East End Road). For your review we have enclosed revised plans depicting that recommendation. In relocating the proposed boardwalk there will now the approximately 1,200 s.f. of wetlands under the proposed boardwalk. This modification is depicted on (sheet C-35) of the enclosed plans. The proposed widening of the existing boardwalk would take place between the existing walk and the existing paved road (East End Road). This would also result in approximately 470 s.f. of wetlands being located under the proposed boardwalk widening. During the site inspection it was further noted that the type of freshwater wetlands at this site were deciduous wetlands. The boardwalk would be supported by helical anchors which would result in less ground disturbance than our original proposal. When completed the decking for the proposed boardwalk would be located 6"- 8" above grade of the existing paved road (East End Road). Please be advised that upon the inspection and recommendations for the proposed area for wetlands creation to mitigate the two proposed permit modifications, we have also revised those plans to depict the existing wetlands on site as well as some of the plantings. To mitigate the approximately 470 s.f. of wetlands which would be under the proposed widened boardwalk at the "Boker Doyle" area, we are proposing to plant an approximate 1,500 s.f. areas with wetlands shrubs (Arrow Wood, Buttonbush and Sweet Pepperbush). We are also proposing to create an additional area of approximately 11,000 s.f. of wetlands at this site; depicted on the enclosed plans (1st & 18m Hole- Wetlands Creation). The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is required: To further Policy 6.3. Protect and restore tidal and freshwater wetlands Restore tidal wetlands and freshwater wetlands, wherever practical, to foster their continued existence as natural systems by: 1. reconstructing lost physical conditions to maximize wetland values, manipulating biological characteristics to emulate natural conditions through re-introduction of indigenous flora and fauna, and It is recommended that the Board establish survival rates for vegetation planted within the created wetland. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. At this time we are seeking to modify the Permit to allow for the construction of an 8'x132' Thru Flow boardwalk. This proposed modification shall result in approximately 890 SF of additional area to be disturbed. In the area of"Barleyfield Cove" which was depicted on Sheets (C-35 & C-36) the Permit approved a 4'x300' Thru Flow boardwalk. At this site we are seeking to modify the Permit to allow for the construction of an 8'x300' Thru Flow boardwalk which would be supported by helical anchors. The boardwalk would be elevated 18" above grade and only a portion of the boardwalk would be constructed over wetlands. The purpose of the proposed Peimit modifications is for the safety of the bike riders, walkers, joggers, etc. utilizing the path. It is felt that a 4' wide path in these two areas is much too nan'ow and it would be dangerous having two bicycles passing each other in opposite directions. For your review I have enclosed a copy of the "Review of Traffic Statistics" which was commissioned by FIDCO. To mitigate these proposed Pemfit modifications we are proposing to construct/create an area of freshwater wetlands adjacent to the 1st and 18th holes of the Fishers Island Club golf course. The area is currently a "rough" vegetated with Giant Reed (Phragmites australis), goldenrod and assorted weeds. The proposal is to excavate the ara down to elevation 3' and removing approximately 1,920 CY of material and stockpiling it. At the proposed elevation 3' create approximately 9,650 SF of open water wetlands and in that area between elevation 3' and elevation 4' create approximately 26,450 SF of vegetated wetlands. We are also proposing to regrade a portion of the "fairway" located to the south of the proposed wetlands to control rainwater runoff. This would be done by first stripping the sod offofthe "fairway" and stockpiling it. Then approximately 1,050 CY of fill shall be placed in the exposed area to raise the elevation of the "fairway" to elevation 7'. The area shall then be replanted with the stockpiled sod. The proposed mitigation project shall provide the residents and visitors to fishers island with a new recreational use by providing areas for hiking, bird watching, photography and hunting. It will also create an area that currently does not exist for wildlife habitat by providing breeding, nesting and feeding grounds for various forms of wildlife, wildfowl and shorebirds as well as migratory waterfowl.
