PLANNING BOARD MEMBERS John ~/icl~hem, Chelrman Henry Mo|s,~ Alfred Grebe Archibeld ¥c~un 8 ~//illi~rn Unl~elbech MINUTES SOUTHOT.n TOWN PLANNING BOARD October 19~ 1965 A regular meeting of the Southold Town Planning Board was held on Tuesday, October 19, 1965, at 7:30 P.M., at the Town Office, Main Road, Southoldt New York. There were present: Messrs: John Wickham, Chairman, Henry Moisa, Alfred Grebe,.Arch/]mald Young. Absent: Mr. William Unkelbach tin Europe on business-). ~so present: Messrs: Otto V~n Tuyl, Consultant; Howard Terry, Building Inspector. Mr. Harold Reese appeared before the Board' to,. discuss Section II of'Harbor'LightsEstates. The Chairmanadvised Mr. Eeese that'the Town Board has been.consistant~in requiring access on ~aterfront property. The Chairman also stated that if:.%here was a canal dug thatth~ would be considered water- front property. The Chairman advised that in this case the Town Board would require access to the canal. Mr. Reese stated that they had intentions of digging a canal. Southold Town Planning Board -2-- October 19, 1965 The Chairman further advised Mr. Reese, whereas he had substantial acreage to develope that the Planning Board felt~they should not waittoo long before requiring the park and play ground area. Mr. Reese stated that .he had the area for dedication for the park and playground area approximately located. He also-stated that the rough road leading to this area Should be completed within thirt~ydays, however, he stated it might be longer than 30 days. Mr. Van Tuyl will map out the specific area to be set-aside for the park and play ground area. Mr. Reese stated that over a period of~a couple of years he intents to develope three orfour sections of this subdivision. The total acreage of this land being subdivided is approximately 125 acres. Semtion'II of this subdivision is to be approximately 25 acres. InSection II~ Mr. Reese intents to provide parking area for the residents in the subdivision by the beach. The Chairman advised Mr. Reese that~he would like to suggest the possibility of withholding land on the waterfront to fullfill the dedication requirements because the Town must have access to waterfront property. Mr. Reese statedthat he has already sold some lots and has given these people rights to the water- front. Therefore~ he will have to loOk into the legal aspects and see to what extent beach rights were given to the people in the Subdivision. Mr. Reese stated he had set-aside 900 feet of private beach for the residents in the subdivision. A very lenghty discussion was held on the possibilities of providing the necessary beach front and access to fullfill the dedication requirements of the Town, and still maintain the 900 feet of private beach for the residents of the sub- d~vision. Mr.~ Grebe asked who would own the bottom of the Canal. Mr. Reese stated that it-was their'intention to have the people form some soft,of association and they would maintain the canal. The Chairman made reference to Dawn~Estates, to be developed by Bernard and Theodore Kaplan. This subdivision is also proposing a man-made canal and the Chairman felt that Mr. Reese wouldbe interested to know how they intended to maintain the canal. A copy of the letter from Kaplan is to be sent to M_r. Reese. The Chairman advised Mr. Reese-that the Planning Board would like to have a clear and concise statement in writing, stating who is to be responsible for~the canal. Mr.. Reese said he would submit a letter'of intent in regard to the maintenance of the canal. Mr. Reese stated.~at it has been made clear to the buyers of lots that the entrance to the canal Southold Town Planning Board -3- October 19, 1965 will be kept open by the subdividers for about two'years. After the~e are a substantial number or'property owners in the subdivision, the car~twill be the responsibility.of the property o~ners. The Plan~$g Board received from the Town Board the original petition or'Martin C. Nelsen relative to a ~change of zone fromA Residential and Agricultural District to "B~2" Business District with the instruction to prepare an official report defining the conditions described therein. This property is located in Greenport, Town of Southold~~ Suffolk'County~ New York, and.~ounded and describedas follows: Beginning at the 'intersection of the southerly line of Middle Road, with the easterly line of Moores~Lane~ from said point-of beginning running along said southerly'line of Middle Road~ three courses: (1) N. 66° 09~' 10" E.-96.61 feet; thence {2) N. 69© 02~ 10" E.-985.10 feet; thence (3) N. 71© 28~ 20" E.-312.64 feet; thence S. 16° 01~ 50" E.-600o0 feet; thence S. 69°~20~ 30" W.-1381.31 feet-to said easterly line of~Moores Lane; thence along said easterly.line~ 600.0 feet 'to the point,-of beginning. Containing 1~.303 acres. On motion by ~ir. Moisa, seconded by Mr. Grebe, it was the Town Board the change of 'zone from "A" Residential and Agricultural District to "B'2" Business~District on the property of Martin. C. Nelsen as described above. The PlanningBoard has had' conference with.the attorney for Mr. Nelsen and~ith his~engineer. The Plan~ing Board feels that theyhave some verypromising plans for this property'and we feel that it will be a veryreal asset to the Town of'Southold. Grebe, seconded-b~.Mr. Moisa, it was RESOLVED that the minutes of-the'Southold Town-Planning Board datedOctober 5, 1965, be approved as corrected. Vote of'the Board: Ayes:-Mz. Wickham,. Mr. Moisa, Mr. Young, Mr. Grebe. The next meeting of theSouthold Town Planning Board will be held on Novenfoer 9, 1965, at'7:30 P.M.', at the Town Office, Main Road,. S0uthold~ New-York. On motion by Mr. Moisa, seconded by Mr. Young~ it. was RESOLVED that a letter bewritten toRaymond ~nd May Associate~ and to~Cornell University.requesting a study.to be made or'preferential assessment-or,open spaces, including farm land.
