Present were John Wickham, Chairman; Henry Moisa, Vice-Chairman; Alfred Grebe; Frank S. Coyle and Henry Raynor. Pebble Beach Farms. Present were Lefferts Edson, Esq.; Rudy Bruer, Esq.; Josepn Donovan. The Chairman opened the public hearing at 7:30 and asked Mr. Ray-nor to read the Notice of Hearing: NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town Law, public hearing will be held by the Southold Town Planning Board at the Town Clerk's Office, Main Road, Southold, New York in said Town on the 27th day of January, 1975, at 7:30 o'clock in the evening of said day on the question of the final approval of the following plat: Plat of property owned by Pebble Beach Realty, Inc. entitled "Pebble Beach Farms", consisting of a parcel of land situated at East Marion in the Town of Southold, Suffolk County, New York, and bounded and described as follows: BEGINNING at a monument set at the intersection of the northerly line of the Main Road with the westerly line of the land of Andre K. Planning Boa~ -3- January 27, 1975 The follewing letter under date of Jauuary 13, 1975 to the Southold Town Planning Board from Young & Young, Surveyors, was read: Gentlemen: At the direction of Mr. Joseph Donovan, we are trans- mitting herewith the original tracings, two sets of cloth prints and three sets of paper prints of the above-captioned subdivision which we have amended at his direction to show a parcel 60 feet wide adjacent to Lot No. 45 for the possible future highway dedication, and amended to show the rear setback line 100 feet from the tie line along average line of the bluff. /s/ Howard W. Young The following letter under date of January lC, 1975 to the Southold Town Planning Board from Lefferts P. Edson, Esq. was read: Dear Sirs: At the meeting before you on December 16, 1974, four requirements were imposed which we are now complying with: 1. The 100 foot building set back line from the bluff will be indicated on the map. 2. An area 60 feet wide South of Lot No. 45 for possible future highway dedication will be shown on the map. 3. Fire hydrant locations are presently shown on the map, indicated by a solid circle with two spurs extending therefrmm, which are placed along the roadline. 4. Water spurs for lot service will be installed across the road at the time of installation of the water mains. Thank you. /s/ Lefferts P. Edson Chairman: There is a letter from the Cluster Review Committee of Suffolk County under date of October 7th stating that they are prepared to have a new hearing before the Cluster Review Committee. I believe you had such a meeting. Mr. Donovan: We did not have the hearing because we got into a gray area and we had a hearing by the joint board, Mr. Klein, Mr. Flynn, Mr. Grant and the Health Department. It wasn't a hearing from the Cluster Review Committee. Chairman: Normally, we have a letter from the Review Committee. Mr. Donovan: We had approval prior to the submission. Chairman: The map is County Health. Mr. Wickham: It is customary to ask those that are opposed to this subdivision to speak at this time. Is there anyone opposed to this subdivision? Hearing none, I will hear from those in favor of this subdivision. Mr. Edson: My name is Lefferts Edson and I represent the owners of the corporation being represented by Mr. Donovan. Having complied with the requirements and amendments there- to resulting in these maps and having met the requirements of the Cotunty and State, we are here tonight to pray for your approval of the submission. Mr. Wickham: At this time I want to compliment you on your cooperation and your work and your really complete coopera- tion with this Board and your patience with working with the County of Suffolk on the cluster concept. This is the first cluster concept that we have been able to get past the County of Suffolk and we are very pleased about this. If there is no other problem, I will declare the hearing closed and we will discuss this highway. Planning Boa~ -5- · ~uary 27, 1975 There was discussion about the width of the roadbed and it was decided it should be 36 feet as per the request of the Highway Committee. Mr. Donovan agreed to do this and will provide the Board with cross-sections of the highway to complete the Planning Board file. Mr. Martocchia attended the meeting from 8:10 until the conclusion of the meeting. Amari. Mr. Rudy Bruer appeared. Mr. Bruer presented five copies ~ the map. The Board told Mr. Bruer to prepare a covenant for no further sub- division of lot ~ronting on the 01d North Road. Bagshaw site plan. Philip 0frias, Esq., Harvey Bagshaw and Terry Woodhull appeared. Mr. ~iokham: The parking facilities have to be figured out by the Building Inspector. This Board may have further restrictions on the use of the area. What do you propose to use it for? Mr. 0frias: Auto body shop. Mr. Wickham: I happen to be opposed to these body shops where the police get some wrecker to deposit a wreck in front of your place and it is left there until the insur- ance adjuster comes and looks at it. I am looking to some sort of covenant of how the night deliveries are made. You will have to come up with some way of assuring us in this site plan that the site plan is adequate and you have guarantees that the police w~ll not tell the wreckers to dump it in front of your place. Mr. 0frias: We could put a chain across so no one could get in there. The Board requested a complete site plan and Mr. 0frias said he would send copies into the office. Leisure Oaks condominiums. Steve Tsontakis and Mike Tsontos appeared. Mr. Tsontakis presented two copies of site plan. Mr. Tsontakis sa~d he had incorporated all comments made by the Building Inspector in hi~ letier. They haven't prepared road profiles yet and haven't gotten the topos for the drainage. Plar~ning Boa~ -6- anuary 27, 1975 Mr. Tsontakis: This is a proposed condominium project to be located off Factory and Sound Avenues at Mattituck. We intend to upzone it to M-1 from Industrial. We would like to construct thirty-five units on the seven and a half acres of land. We have a total of ten buildings, one of which is recreational. Attached to the recreational building is a swimming pool. The electric and telephone utilities will be underground. It will be served by a community water supply. We have gotten samples from the area and there is sufficient water in the area to carry this housing. The parking is about two vehicles per unit. The requirement is a vehicle and a half per unit. This is based on 350 square feet. It averages out to about two bedrooms per unit or a total of 65 bedrooms for thirty-five units. We would like to leave as much of the land as Virgin as possible. We will clear where necessary. The area in the southeast corner will be left virgin to be used as a picnic ground and nature walk. Included in this draw- ing is a planting schedule,layout of the roads, elevations of the buildings, floor plans and the lighting schedule. We have included six inch water mains running from the northerly boundary of Sound Avenue to the easterly boundary on Factory Avenue for future hookup to a public system. This water supply will not meet the underwriter's require- ments but it will be sufficient to fill the pumps. Mr. Wickham: What size well-casing were you thinking about? Mr. Tsontakis: It will probably be four inch submersible. Mr. Wickham: We strongly recommend a larger casing and a shorter screen. Mr. Tsontakis: This has to be approved by the Attorney General of the State of New York. This costs alot of money and he doesn't want to apply until he is sure it is acceptable to the Town of Southold. The Board will check over the drawings and check with the Town Attorney as to what if anything will be required. Mr. Tsontakis gave the Board an extra copy to be looked over by the Building Inspector. Simicich minor. Mr. Simicich and Charles Cuddy, Esq. appeared. The Board looked at the maps Mr. Cuddy had presented and Mr. Cuddy said that Mr. Simicich would rather put the 50 foot reservation of land all in lot #2 rather than half in lot #2 and half in lot #3. The map will be changed and re-presented. A draft of an agreement to be put on the right of way was presented and will be sent to the Town Attorney for his comments. Planning Boal -7- anuary 27, 1975 Schriever. Mr. Cuddy said the Health Department had approved the plan but he is skeptical of the environmental people. He asked if he could submit a map for the review of the Planning Board. The Planning Board was agreeable and Mr. Cuddy will send in new maps. Luce and Penny minor. Mr. Penny appeared. The Board reviewed map dated January 25, 1974. Mr. Penny wants to combine lots I and 2 and change the roads a bit. The total number of lots will be four. Mr. Wickham told him that the Board will require a filed ~ovenant that these oversized lots will never be divided. Mr. Penny w~tl have a new map prepared and forward it to the Board. Oregon View. Gary 01sen, Esq. appeared. The Board reviewed the final map of the above subdivision. They will need a drawing of the pillars to be put at the entrance. Laurelwood #2~ Gary Olsen, Esq. appeared. Mr. Olsen asked if any comments had been received from Mr. Dean. The answer was negative. Macari. Gary Olsen, Esq. appeared. The secretary was to write to the State Transportation Department to find out the status of the expressway. Garelle minor. Gary Olsen, Esq. appeared. Mr. Olsen was told a public hearing would be set up for this subdivision. Soundview Acres at Orient. Richard Cron, Esq. appeared. The following letter under date of January 27, 1975 from the Southold Town Highway Department was read. Planning Boal -8- nuary 27, 1975 Gentlemen: A meeting to review several subdivisions was held at the office of Superintendent Raymond C. Dean, Peconic Lane, Peconic, at lO:O0 a.m. on January 23, 1975. Present were Superintendent Dean, Justices Louis Demarest and Martin Suter of the Highway Committee and Mr. L. Tuthill, P.E. It was agreed by all and requested that the Soil and Conservation Dept. review the combined run-off and drainage facilities. It was noted that the park and playground area of Pappas appeared to be undersized. It was thought that the recharge basin would be more desireable located on the existing 01d Main Road and that the catch basins at the entrance roads drain into recharge basin. It was requested that the road grade on the north-south road in the Sound- view Subdivision be raised and carry a direct slope to the Old Main Road. /s/ Raymond C. Dean Sup't of Highways The Board feels that if the road is raised and the pipe from the catch basin comes back into the drainage area, that this map is satisfactory. An easement should be included from the 01d Main Road to the drainage area. Werner Adel~ Jr. Richard Cron, Esq. appeared. The following letter under date of January 27, 1975 from the Southold Town Highway Department was read. Gentlemen: A meeting to review several subdivisions was held at the office of Superintendent Raymond C. Dean, Peconic Lane, Peconic, at lO:O0 a.m. on January 23, 1975. Present were Superiatendent Dean, Justices Louis Demarest and Martin of the Highway Committee and Mr. L. Tuthill, P.E. It was agreed by all and requested that a 32' right of way be made the full length of the property and include the 18' strip of Alma Suter land to make a 50' right of way. /s/ Raymond C. Dean Sup't of Highways This map has already received final approval from the Plan- ning Board so that the right of way cannot be incorporated. The County Planning Commission had requested a drainage plan. It was the opinion of the Planning Board that this subdivision will not drain onto the State Highway because the land is relatively level, relatively light in texture Planning Boal -9- .anuary 27, 1975 and has good natural drainage. The Board feels on a minor subdivision such as this with such large lots there is no problem. It drains away from the State Road as shown by the spot elevations on the map. Southold Commons. George Ahlers appeared. Mr. Ahlers wanted to know the road requirements and the curb requirements. He was told to contact Ed Bage and Ray Dean. He was going to check with Jim Monsell of the Village of Greenport to find out whether the primary source of water will be Youngs Avenue or Hortons Lane. Mr. Wickham read the following letter which he intends to present to the Supervisor at the special meeting of the vami~us boards to be held on January 28, 1975. Dear Supervisor: The Planning Board submits the following figures for maximum tides in the town. Orient Ferry Dock 2.5' tide difference Max 10' above mean tide 8/2 /38 Orient Harbor 2.5' tide difference Max 9' above mean tide 8/21/38 Greenport 2.4' tide difference Max 6.1' above meau tide 8/21/38 Southold Bay 2.3' tide difference Est. 6.85' above mean tide Cutchogue Harbor Est. 6.7' above mean tide South Jamesport Max. 6.4' above mean tide 8/21/38 Mattituck Inlet 5.11' tide difference Est. 9.0' above mean tide The above figures are from U. S. Dept. of Commerce. Environmental Science Services Adm., Coast & Geodetic Survey, Tidal Bench Mark Records. It is disconcerting to find that these are tidal bench marks only. They do not relate to the National Coast and Geodetic grid which originates at Sandy Hook, New Jersey. Neither do they relate to the County and State system. There must be some reference at some place but we have been unable to find it. Neither do we have references between the County/State system and the Coast and Geodetic grid even though their respective bench marks are less than 75 feet apart on my own farm. We would like authority to hire one Planning Boal -10- ~ ~nuary 27, 1975 of our engineers to establish the relationship between these three systems at three points in the town and relate them to the County/State system which we would then require as a datum on all maps. Until these tidal bench marks are related to some system, we can only assume them to be within the ballpark. Our information from the U. S. Dept. of Agriculture Soil and Water Conservation District is that this is not necessarily so. In discussing flood plain elevations for the Town of Southold with the Soil Conservation District, it would appear that the flood plain elevation in this Town can be set somewhat lower than in other towns in the county because our bays are partially blocked by both Gardiner and Shelter Islands. These prevent flood water buildup from short intensity storms such as hurricanes. The above records bear this out. There should, however, be at least three zones, that east of Long Beach Point, the remainder of the bay side of the town and finally the Souud side. In addition to the above, this Board would like to recommend that an elevation of two feet above mean tide on the Bay and four feet at the Sound be required as useable land in computing lot area or base for clustering. Finally, the Planning Board would like to request about two week's time and authority to prepare a report and submit it to H.U.D. pointing out the general errors in their overlay map and the need for more precise flood plain elevations based on the above maximum tides. /s/ John Wickham On motion made by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board endors~ the purchase by the County of the end of O~ie~t~ certain very specific limitations mnclud~ng~e przv~lege of hunting and fishing as it has been historically used, low density usage, specific prohibitions about any more houses being built on the property, a very limited parking area and no camping facilities in the area. Vote of the Board: Ayes: Wickham, Moisa, Grebe, Coyle and Raynor. This resolution is to the sent to the County and to the Town Board. Planning Boa~ -11- nuary 27, 1975 On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED to hold a public hearing on the map of the minor subdivision of Garelle located in Mattituck on February 24, 1975. Vote of the Board: Ayes: Wickham, Moisa, Grebe, Raynor, Coyle. The secretary was directed to speak again with the Town Beard regarding the reduction in the bond estimate for the subdivision known as Greenfields at Southold. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board approve the sketch plan of the subdivision presented by Riverside Homes, Inc. dated December 26, 1974. Vote of the Board: Ayes: Wickham, Moisa, Grebe, Coyle and Raynor. Motion was made, seconded and Carried that the meeting be adjourned.
