Present were Chairman John Wickham, Vice-Chairman Henry Moisa, and members Frank S. Coyle and Henry Raynor. Mr. Grebe was unable to attend because of inclement weather. Also present were Sherley Katz of the Long Island Traveler, Robert Rinklin of the Suffolk Weekly Times, Loraine Terry of the North Fork Environmental Council and Shirley Bachrach of the League of Women Voters. Public Hearing on minor subdivision of A. C. Garelle. Present: Gary Flanner 01sen, Esq. Mr. Raynor read the Notice.~of Hearing. NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town Law, Public Hearing will be held by the Southold Town Planning Board at the Town Clerk's Office, Main Road, Southold, New York, in said Town on the 24th day of February, 1975, at 7:30 o'clock in the evening of said day on ~he question of the final approval of the following plat: Plat of property owned by A. C. Garelle located at Mattituck, Town of Southold, Suffolk County, New York, more particularly bounded and described as follows: BEGINNING at a point on Westphalia Road at a monument set at the intersection of the northeasterly line of West- phalia Road with the southeasterly line of land of John I. Mr. Wickham: This is a minor subdivision. There are no roads that have to meet town highway specifications. Does anyone wish to be heard in opposition to this subdivision? Hearing none, is there anyone who wishes to speak in favor? Mr. 01sen: I am Gary 01sen, the Attorney for the applicant, Gus Garelle. This matter has been pending for several months now and the board has asked for certain things to be shown on the map which have been complied with. The property is approximately seven acres, out of which there will be four lots which exceed the 40,000 square feet. Lot #1 is 61,613 square feet, lot #2 is 63,343 square feet, lot #3 is 46,441 square feet and lot #4 is 52,499 square feet. I have also recommended to my client that he sign some covenants and restrictions which would prevent further subdivision of this property. I have prepared such a statement and I assume it will be back shortly. (He submitted a copy). I would strongly urge that approval be granted by the Planning Board. The lots are good size and nicely shaped and this is a real- istic way of subdividing this property. Mr. Wickham: We have spent a bit of time with this and are inclined to concur with you. Does anyone else wish to be heard on this subdivision? Hearing none, I will declare the hearing closed. Peter Sled~eski minor in Orient. Peter Sledjeski appeared. The Board reviewed the map. There are two rights-of-way to extinguish. Stillo has a minor subdivision to the north of this property and Mr. Sledjeski doesn't think any of the lots have been sold at this point. Covenants will have to be Planning Boars -3- February 24, 1975 drawn up for the oversized lo~s and he will have to contact his attorney to find the legal steps to extinguish the right of way and establish the new one for the Stillo minor. Peconic Knolls, Peconic. Steve Tsontakis appeared. The Planning Board told Mr. Tsontakis to make lots 8 and 9 just 40,000 square feet to allow more area for the drainage. A statement should be put on the map that there is no lot less than 40,000 square feet. Another cross-over pipe should be placed opposite lot 4. Mr. Tsontakis will have to present twelve copies of the map and twelve copies of the profiles. A letter is to be written to Mr. Tsontakis stating the above requirements. Schriever, Orient. Mr. Cuddy had sent the Board a copy of the map of the proposed cluster with the following letter: February 4, 1975 Dear Mr. Wickham: Pursuant to our recent conversation concerning the cluster subdivision of William W. Schriever at Orient, we are enclosing the proposed map submitted to you many months ago. In order to proceed before the Department of Environmental Control it is necessary that we submit a formal subdivision map as prepared by Mr. Van Tuyl. We, therefore, ask that you outline in pencil those areas which you wish to be included in the map. For reference purposes we point out that the areas containing arrows are a part of the premises purchased by Mr. Schriever but are to be conveyed to adjoining owners by a deed which will encumber each conveyance with a scenic easement. Those properties upon which the notation "exchange" has been made are to permit the straightening out of lot lines. The exchange has been completed between Schriever and Frost and Schriever and Wysocki. Kindly advise those areas which are to be included in the subdivision so that we may attend to preparation of the same. Thank you. /s/ Charles R. Cuddy, Esq. It was the concensus of the Board that although they have no objection to what is being proposed, they are not in a position to tell the subdivider how to proceed. Planning Board -4- _ebruary 24, 1975 Blue Horizons. Mr. Fauser, Surveyor, appeared along with three of the principles. Mr. Fauser presented a revised subdivision map of Blue Horizons. He is presenting a new type of drainage for this area and was told to check with Mr. Barnett of the Soil Conservation Service to see if this would be workable in this area. Mr. Raynor asked Mr. Fauser if he realized that this is a sketch map and Mr. Fauser said this is intended to be a preliminary sketch. Among items discussed were the requirement for 100 foot setbacks from the top of the bluff, turn-arounds being dotted in, a possible crossroad, westerly lot on the Sound possibly being lost. Mr. Fauser will send more copies of the map and profiles so that they may be sent to the various town agencies for suggestions. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board the bond estimate in the amount of $100,000 for the subdivision known as "Greenfields at Southold" as prepared by Lawrence M. Tuthill, P.E. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Raynor. On motion made by Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board approval of the ~pplication of Wilton and Clanton for a change of zone on property located at Queen Street, Greenport; to be utilized as a K.O.A. camp- site. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Raynor. Mr. Wickham asked that a note be included when this is sent to the county stating that the Planning Board has recommended this proposal favorably before because they feel it is desir~ able and the location is the best that we know of for this purpose. Standley, East Cutchogue. Renny Terry, Esq. appeared. It is being proposed to have a minor subdivision of four lots. One lot is underwidth and must be brought up to 150 feet front and it is also undersized and must be brought up to 40,000 square feet. The wetlands cannot be considered build- able land and, therefore, it would be better to make this subdivision three lots. Planning Boar¢ -5- ~ ~bruary 24, 1975 On motion made by Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board the bond estimate in the amount of $380,000 for the subdivision known as "Pebble Beach Farms" as prepared by Lawrence M. Tuthill, P.E. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Raynor. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board approve the final map of the subdivision known as "Pebble Beach Farms" subject to acceptance by the Town Board of the bond, receipt of the inspection fee, approval by the Suffolk County Planning Commission, catch and leaching basins and piping as agreed to at meeting with the Superintendent of Highways, Town Engineer, Lawrence M. Tuthill and Mr. Joseph Donovan at meeting held February 19, 1975. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Rayhor. Mr. Tuthill will write a letter to the Planning Board outlining the agreement as far as the catch and leaching basins and piping are concerned. Soundview Acres at Orient. The road grade should be raised and an easement provided for the cross-over and piping from the basins to the recharge. A letter should be obtained from Mr. Dean. On motion made by Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED to table the matter of the Garelle minor subdivision until a future time. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Raynor. Mr. Lawrence Tuthill presented a report on highwater marks in Southold Town. These will be submitted to the Army Corps of Engineers and HUD for flood plain elevations. It was the consensus of the Board that Mr. Wickham Planning Boara -6- ~ebruary 24, 1975 be authorized to make inquire of the Town Attorney at to what steps should be taken with the subdivision known as "Highland Estates"; and then take such action as seems advisable.
