A regular meeting of the Southold Town Planning Board
was held June 2, 1975. Present were Chairman John Wickham,
Vice-Chairman Henry Moisa, and members Frank S. Coyle, Alfred
Grebe and Henry~J~ynor.
Crown Land Lane. Present was Lefferts Edson, Esq.
Hearing was opened at 7:30 p.m. by the Chairman.
Henry Moisa read the Notice of Hearing.
NOTICE IS HEREBY GIVEN that pursuant to Section 276
of the Town Law, Public Hearing will be held by the Southold
Town Planning Board at the Town Clerk's Office, Main Road,
Southold, New York, in said town on the 2nd day of June,
1975 on the question of the following:
7:30 p.m. Approval of the final map of subdivision
known as"Crown Lane Lane" owned by Crown Land Lane, Inc.o
situated at Cutchogue, Town of Southold, County of Suffolk
and State of New York and bounded and described as follows:

Affidavits of publication were presented from the Long Island
Traveler - Mattituck Watchman and the Suffolk Weekly Times.
Chairman: We have the application in duplicate, endorsement
by County and State agencies. The following is a letter from
the Superintendent of Highways dated June 2, 1975.
Gentlemen:
I approve the layout of the road on the May 14, 1975 map
of Crown Land Lane located at Cutchogue, New York and concur
with Mr. Lawrence Tuthill recommendations of the October 2,
1973 correspondence.

(The recommendation referred to was the use of a blacktop
surface on the roads of the subdivision Crown Land Lane, Cutchogue
as a pilot project for possible use on future roads of sub-
divisions.)
Chairman: We have the agreement fromMr. Edson dated April
22, 1975, concerning the lot #19 on which an Appeals Board
variance is given. At this time, I will ask for anyone that
wishes to be heard in opposition to the subdivision known as
Crown Land Lane. Hearing none, I will ask for anyone that
wishes to speak in favor of the subdivision.
Mr. Edson: Having complied with the various rules and regula-
tions of the Town, County and State, I would like to ask for
your favorable consideration.
Chairman: Is there anyone else? Lot #12 is 37,729 square
feet in area. This is less than the minimum square footage
necessary but was made necessary because of the Planning Board's
insistence that the spur road be changed and further it has
been approved by all County agencies. We are respectively
asking the developer to work with Mr. Dean on Mr. Tuthill's
recommendation to blacktop the roads. Hearing closed.

There was some discussion after the hearing about the cluster
concept for subdivision of land. Mr. Edson feels it is a
mistake not to have clustering and that there is not enough
push exerted by the officials of this Town to get it done.
This way the farmland would be preserved without such a cost
to the county. Half the land in a subdivision would be
preserved at no cost.
Highland Road Estates. Mr. Alden Young, P.E. appeared.
Mr. Alden came in to discuss the County's recommendations
on this map. The Planning Board will study the recommendation
to move the spur road to the south as they had previously
recommended that it be moved to the north.
Peter Sled~eski minor subdivision. Rudy Bruer, Esq. appeared.
Hearing was opened at 8:00 p.m. Henry Raynor read the
Notice of Hearing.

Chairman: I have a declaration stating that the description
agrees with the map. There are no highways shown but there
was some discussion about a right-of-way.
Mr. Bruer: Mr. SIe~em~k~ wants to retain ownership of the
right-of-way on the west. I told him I would ask the Board
but my recollection was he would be creating a substandard
piece of property. (Mr. Bruer showed a deed to Mr. Rose
giving him a right-of-way over existing farm road. There was
no width given.)
Chairman: We don't like 12 foot rights-of-way. The line
should be dotted for the right-of-way on the west. The
easiest thing for us to say is we will go along but he has
to get the approval of the State for a curb cut. The
right-of-way has to be 15 feet in width and Mr. Sled~eski
cannot retain the ownership of it.
Chairman: Does anyone wish to be heard in opposition to
this subdivision owned by Peter Sledjeski? Hearing none,
will call for anyone that is in favor of it.

Mr. Bruer: I understand that with respect to the map you
have three comments. That you would approve it subject to
the curb cut of the State and the right-of-way on the westerly
side would have to be 15 feet wide and someone other than
the lot number 3 owner on the map could not be the owner of
the right-of-way. With those three and subject to the County
Planning I assume you have no objection. Will the Board please
give me a letter to the effect of these four points so I can
present it to my client and I will get a map showing what we
just discussed. If t~is right-of-way was extended 15 feet
would you mind if it came into the property like that? I
assume it is going to be 15 feet here on this side.
There being no one else wishing to be heard, the Chairman
declared the hearing closed.
Mr. Polashock appeared before the Board about his property
in New Suffolk. He lives on the corner of Jackson and Second
Streets. He says his property is not buildable because of
the area in which it is in. Therefore, he has been parking
cars on the property and charging $5 for it. He has been

cited by the Building Inspector and wanted to know what he
could do so he would be allowed to use this area. The
Chairman told him that he and Mr. Raynor would look the
property over and let him know what they think.

Public Hearing was opened at 8:30 p.m. by the Chairman.

Chairman: Does anyone wish to be heard in opposition to this
subdivision known as minor subdivision of N & E Associates?
Hearing none, I will ask for anyone that wishes to be heard
in favor.

Mr. Olsen: This has been before the board on several
occasions. We have four parcels,each have~3.41 acres which
is way over the square footage required by the Town. It
meets all the standards of the town and I urge that it be
approved. I have submitted a disclosure statement and also
the proposed covenants and restrictions which says the
parcels created will not be resubdivided.
Chairman: The covenants and restrictions say that the
declarant does hereby warrant, covenant and represent that
on approval of the aforesaid described lands as a minor
subdivision by the Planning Board of the Town of Southold, no
further application will be made to that Board or to any other
Board in the Town of Southold to further subdivide any of the
lots set forth in said minor subdivision. The declarant
further warrants, covenants and represents that the aforesaid
described lands within the minor subdivision cannot be sub-
divided into more than four lots and that each such lot shall
comprise an area of not less than three acres. The declarant
does hereby further warrant, covenant and represent that the
foregoing restrictions and agreements shall bind the undersigned,
his heirs, successors and assigns, and any and all person or
persons who shall succeed to the ownership of any of the lots
shown on said aforedescribed premises in said minor subdivision
by transfer or otherwise. If the Board approves this it will
be subject to receipt of this declaration.
Mr. Olsen: It will be subject to the original declaration.
Chairman: We will require that the declaration be filed in
the Suffolk County Clerk's Office.
Mr. Uhlinger: Is there any other thing that this can be used
for other than residential? (He is adjacent property owner.)
Chairman: Agricultural and residential.
Mr. Uhlinger: I am in favor of it personally.
Chairman: If there is nothing else, I will declare the hearing
closed.
Dean - East minor subdivision. Gary Olsen, Esq. appeared.
Mr. 01sen presented six copies of the map of this subdivision.
Mr. Raynor had it put in the record that he would abstain from
any action on this subdivision as one of his relatives has a
contract for a lot in this subdivision if it is approved.
There was discussion of a piece marked "private beach" which
the Chairman thought should be included in the subdivision but
it was pointed out that it is Park & Playground for the
adjacent subdivision called "Downsview".

Zaino. Gary 01sen, Esq. appeared.
Mr. Olsen presented some photocopies of the tentative
arrangement of these lots on Indian Neck Lane and the Main
Road in Peconic. Mr. Olsen was told to proceed with having
his sketch plan prepared.
Doebler minor. Gary 01sen, Esq. appeared.
Mr. Olsen saidMr. Doebler would like to create two additional
parcels on the creek. Topos will be required on this map. It
was noted that the lots should be numbered.
August Acres. George Wetmore and Stanley S. Corwin, Esq.
appeared.
The Chairman opened the public hearing at 9:00 p.m. Mr.
Raynor read the Notice of Hearing.

The following letter under date of June 2, 1975 from the
Southold Town Highway Department was read.
Gentlemen:
I would suggest more consideration be given to Item
II of the February 24, 1974 correspondence of Mr. Lawrence
Tuthill on the Eugust Acres subdivision located at Ar~hamomaque.
New York.

Item #2 of the above-mentioned letter reads as follows:
2. That since Southold Town has the deeds for the area between
lot 90 and 93 of the adjacent subdivision, that roads be
connected to this area to eliminate an extremely long block.
Chairman: There is a letter from the counsellor telling
about enclosing an affidavit about lot #1. The situation on
lot #1 is well-known and documented thoroughly. On April 7,
1975 the affidavit was sent to Mr. Villa. Under date of June
26th$ notice of approval of the preliminary was given subject
to the following conditions:
1. Course line be designated on Kerwin Boulevard to
conform with the description.
2. Rights-of-way be shown on final map.
3. Description of property be shown as Section I
exclusive of Section II.
4. 27~ pipe be shown instead of 18~ pipe on Pleasant
Place.
5. Approval on roads and drainage be obtained from the
Southold Town Highway Committee and the Southold Town Super-
intendent of Highways.
Items 2 and 3 should be checked out. Rights-of-way should be
shown on the final map.
Mr. Wetmore: The key shows Section I.
Chairman: We do not like people to hold out property and
we ask that it be shown as Section I and Section II.

Mr. Raynor: Can you get an agreement to extinguish the
right-of-way?
Mr. Wetmore: That is how the property was bought.
Mr. Corwin will check out the matter to find out if it is
a right-of-way or just a travelled road.
Chairman: We want to call to your attention, George, that
this map, within the area where you might have some problems
with the State Department of Environmental Con~ation,
because according to my scale it is at the nearest point about
five feet under the required 300 feet. At times the developers
have gone ahead and found they were in trouble with the DEC
and said why didn't the Town let us know.
Mr. Corwin: We won't be building anything within that
distance.
Chairman: Everything seems to be in order. At this time, I
would like to ask for anyone that wishes to be heard in
opposition to this subdivision known as August Acres? Hearing
none, I will ask for those that wish to be heard in favor of
it.
Mr. Wetmore: On behalf of the Posillico Construction Compauy,
I have worked diligently with the Planning Board for two years
and I believe we together have come to quite a nice acre
development that meets the requirements of the Town and h~s
public water in an area where it isn't really necessary. I am
sure we exceed the specifications of the town. It's been
quite some time and I know you gentlemen are well satisfied
and I am respectfully asking for final approval of the subdiv-
ision for Posillico Construction Company.
Mr. Raynor: Is there a certificate of disclosure on file?
Mr. Wetmore: Yes.
Chairman: Does anyone else wish to be heard? We agree we
have worked a long time over this and I think everything is in
good order. We will require that this other property of the
developers be shown as proposed Section II. I suspect that
either you or we should go a little further about this right-
of-way. Perhaps, counsellor, if you gave us a statement or
affidavit or something like that.
Mr. Corwin: Whatever is needed, we will get it.
Chairman: If there is nothing else, I will declare the
hearing closed.

Eli~ah's Lane Estates~ Section II. Joe Saland appeared.
Mr. Saland said the additional catch basins had been put in as
requested. Mr. Saland said they were a couple of months away
from starting the recharge basin which is shown in Section I.
There was discussion about the fact that this land has been
put in for bid for the County farm acquisition program. Mr.
Saland said that it looked a.long way away so they were going
ahead with the subdivision. If the option comes through and
the County Executive exercises it, the subdivision will be
discontinued. Mr. Saland requested a final hearing.
Motion was made by Mr. Grebe, seconded by Mr. Coyle and
carried that the meeting be adjourned.
Schriever. Mr. Schriever appeared, without an appointment.
Mr. Schriever asked when his public hearing would be on the
preliminary map. He said the turn-around was stirring up
problems with Dr. Moor-Jankowski who feels, according to Mr.
Schriever, that the opposition to the road going through is
primarily because of the trucks. A copy ofMr. Lawrence
Tuthill's recommendations to the Highway Department was avail-
able and read to Mr. Schriever as comments only. He was asked
to submit a copy of the covenants and restrictions as proposed.
Long Pond Estates. Mr. Wilsberg and Richard Cron, Esq. appeared.
The following letter of the Highway Department under date of
June 2, 1975 was read:
Gentlemen:
After reviewing the subdivision map dated November 12,
1974 of Long Pond Estates located at Southold, New York with
Mr. Ernest Wilsberg, I suggested that if Park Avenue cannot
in the future be extended out to Route 25 through the park
and recreation area, then I would recommend the extension of
Park Avenue east of Lot #28 in the park and recreation area
for future access to Route 25.

The developers showed one copy of a map where the road had
been relocated going north to south but they don't like this
plan and would rather have it go west to east. More park and
playground was Shown as there was an insufficient amount shown
on the original map. The lot number will have to be removed

from the area shown as a recharge basin. Mr. Dean is to be
contacte~,~to see if he will go along with the west to east
plan for the road.
Greenbriar Acres. Richard Cron, Esq. appeared.
Mr. Cron was told to submit the sketch plan including profiles
of this subdivision for action by the Board.
On motion made by Mr. Grebe, seconded by Mr. Raynor,
it was resolved to send the bond estimates prepared by Mr.
Lawrence Tuthill for the subdivisions "Crown Land Lane" and
"August Acres" to the Town Board for their action.
Vote of the Board: All ayes.
August Acres. The Board determined that the area around the
irrigation ponds should be fenced in if they are not going to
be filled in in the park and playground area.
On motion made by Mr. Moisa, seconded by Mr. Raynor, it
was
RESOLVED that a public hearing be held on the final
map of the subdivision known as "E~i~ah's Lane Estates,
Section II".
Vote of the Board: All ayes.
The next two meetings will be held on June 23, 1975 and
July 7, 1975.
On motion made by Mr. Raynor, seconded byMr. Grebe,
it was
RESOLVED to request the Southold Town Board to consider
the subdivision of land owned by William Schriever in Orient
as a cluster concept subdivision.
Vote of the Board: All ayes.

On motion made by Mr. Raynor, seconded by Mr. Grebe,
it was
RESOLVED to request the Southold Town Board to oonsider
subdivision known as "Heritage Harbor" owned by Riverside
Homes as a cluster concept subdivision.
Vote of the Board: All ayes.
On motion made by Mr. Moisa, seconded by Mr. Grebe,
it was
RESOLVED to grant approval of the map of the minor
subdivision of John Simicich, Jr. and John Spicejaric located
at Southold, New York, subject to the approval of the Suffolk
County Planning Department.
Vote of the Board: All ayes.
Motion was made by Mr. Coyle, seconded byMr. Raynor
and carried that the meeting be adjourned.
