A regular meeting of the Southold Town Planning Board was
held on Monday, March 27, 1978 at 7:30 p.m. at the Town Hall,
Main Road, Southold, New York.
Present were:

7:30 p.m. Public Hearing on the question of the approval of the
preliminary map of subdivision known as "Peconic Bay Cove"
located at Peconic, New York. Mr. Raynor read the notice of
hearing and presented proofs of publication from the Suffolk
Times and the L. I. Traveler-Watchman
Mr. Raynor: Approval of the sketch plan was April, 1977. In the
file there is no letter from the Superintendent of Highways
because the proposed subdivision is situated so the property is
abutting the Main State Road on the north and Indian Neck Lane on
the east. A question has been raised as to the conditions pertain-
ing to drainage and we have not as yet gotten a letter from the
Superintendent of Highways about drainage.
Secretary: You probably won't because he is concerned about up
the road and not here.
Mr. Raynor: Is there anyone that would like to speak in opposition
to this subdivision?

Arthur Gossner: The water runs from there into Indian Neck Road
and is eroding the field.
Mr. Raynor: We will get an opinion from the Superintendent of
Highways about the drainage in writing.
Millicent Gossner: On what lot is the house?
Mr. Raynor: I want to hear any objections.
Mr. Gossner: I am not in objection to the subdivision but there
is a water problem.
Lady: What's he proposing to do?
Mr. Raynor: Are you an adjacent property owner? Do you have an
objection?
Lady: I am down on Arrowhead Lane and was just curious.
Mr. Raynor: Is there anyone with an objection? Hearing none, is
there anyone who would like to speak in favor of this subdivision?
Rudolph Bruer: I am the attorney for the developer. I think
everything was said that could be said on my part at the sketch
plan last April. For the record, I would like to repeat every-
thing I said at that time. I think we have gone over this and
made the comments and I think it should be granted as applied for.
Mr. Raynor: I see one very minor technicality. There is a
provision for a path; it should be labelled foot path. Is there
anyone else that would like to speak in favor of this subdivision?
Hearing none, I would ask for anyone that has some information
that he or she feels the Board should have some knowledge of in
regard to this subdivision.
Mrs. Gossner: Lot #2 which is .9 acres, is that the lot that the
existing house is on?
Mr. Bruer: I really don't know what lot it is exactly on but
the developers will take it down and it is not an existing
situation, It is not being sold with a house. It was there
when they bought it and as far as they are concerned, it is
nothing.
Mr. Coyle: It is part of the kitchen of the main house that was
already moved away. It is an empty shell of a building.
Mr. Bruer: It will be eventually taken off.
Mr. Raynor: Is there anyone else that has anything to add some
light.
Mrs. Gossner: Have you got problems with the wells on that
property?
Mr. Bruer: They are trying to get good water.

Mrs. Gossner: That is what I mean. I notice Krieger has been in
for the last two ro three months. I was just wondering if there
was a water problem.
Mr. Bruer: He is going to speak to me tomorrow.
Mr. Raynor: Anything else? Fred? Sparky?
Mr. Coyle: I feel lots 2, 3 and 4 that require this footpath
it should be in the deed to these people and should be left open
to the lot owners
Mr. Bruer: It should be in the deed?
Mr. Coyle: It should be in number 4's deed that it should be left
open. I presume the park and playground is the right size.
Mr. Bear: What's the footpath for?
Mr. Coyle: For the children so they won't have to go on the road
to get to the park and playground.
Mr. Raynor: Lot #6 will need covenants and restrictions as to no
further subdivision.
Mr. Bruer: Right.
Mrs. Gossner: Is the park and playground the correct amount?
Mr. Raynor: It is a small parcel.
Mr. Coyle: It is correct.
Mr. Raynor: If there is no one further that wishes to be heard,
I will adjourn this hearing.
Paradise-by-the-Sound. Roger Rath and Howard Young appeared. Mr.
Tuthill's latest recommendations were reviewed. Mr. Rath voiced
his objection to Mr. Tuthill coming up with these afterthoughts
four days after a meeting with the Supt. of Highways, Mr. Tuthill,
Mr. Wickham and Mr. Young regarding the map. There was a drainage
question and now Mr. Tuthill is raising new points where there is
already preliminary approval. He said he had tried to comply with
all the recommendations of the Board and Mr. Tuthill. It was
suggested that this matter be discussed later in the evening when
Mr. Wickham and Mr. Tuthill were present as none of the other
members had been at the meeting in Mr. Dean's office.
8:00 p.m. Public Hearing on the question of the approval of the
preliminary map of subdivision known as "Orient Hills" owned by
the Wilsberg brothers and located at Orient. Ernest Wilsberg and
Richard Cron, Esq. appeared. Mr. Raynor read the notice of
hearing and presented proofs of publication from the Suffolk Times
and the L. I. Traveler.

It was noted that there are no metes and bounds shown on the map
along the Long Island Sound.
Mr. Raynor: Would the secretary make a notation in the minutes
that the legal description is complete. The metes and bounds as
to distances are incomplete on the map that is presented. We
will open the hearing to anyone present that would like to speak
in opposition to the subdivision of "Orient Hills". Hearing none,
I will ask if there is anyone present that would like to speak in
favor of the subdivision "Orient Hills".
Richard Cron: I am appearing for the applicant. With the full
expectation that the applicant has been before this Board on a
number of occasions relative to this subdivision and hopeful that
the same does meet the rules and regulations of this Planning
Board, I would like to move that the Board approve the subdivision
and forward same to the county.
Mr. Raynor: Is there anyone else present that would like to
speak in favor of the subdivision "Orient Hills". Hearing none,
at this time I would like to review with the developer and his
attorney the report of the engineer. Have you people had a copy
of the letter dated the l~th of March?
Mr. Cron: I have just read it over. I would request that the
findings of the Board pursuant to this hearing be given in writing
to the applicant making specific mention of whether the Board is
approving or following the recommendations of the town engineer
as set forth in his letter of March 14th.
The following are the recommendations of the engineer and the
decision of the Planning Board on them.
1. That this submission be disapproved due to gross differences
between contours on plan and elevations shown on profile in the
northeast section. The map will be corrected to properly show
the contours and elevations.
2. That either Southview Road be carried to the west property
line or that a proper curve be provided at the intersection with
Hill Place. If the road isn't carried to the line, there should
be a correction of the curve.
3. That a 200 foot tangent be provided between the reverse curves
on Hill Place. This will be corrected.
4. That underground piping of storm water be provided when gutter
flow exceeds 1,000 feet. Provision should be made for another
recharge basin or piping to the existing basin.
Comments
1. It is noted that most vertical curves are computed from
barabola formulas rather than a radius as show~ on the profile
of Northwest Drive. The vertical curves will be recomputed to
use the standard that Mr. Tuthill feels it should be.

Mr. Raynor: Mr. Tuthill, do you have any other comments? Mr.
Gordon? Is there anyone present here this evening that has any-
thing that should be brought to the attention of the Board at
this time.
Mr. Bear: I would like to ask a question of another access.
Mr. Raynor: It ties in with Browns Hills Road which is another
access which is approved. It meets the criteria of the ordinance
because it is an emergency access.
Mrs. Gossner: Between lots 23 and 22, that l0 foot wide strip,
is that for Florence Cummings?
Mr. Raynor: That was discussed at considerable length in the
earlier stages. Has anyone else any questions regarding this
particular subdivision? Hearing none, I will deem this hearing
closed.
* * * Mr. Wickham arrived.
8:30 p.m. Public Hearing on the question of the approval of the
final map of "Kouros Acres" owned by Olympia Kouros and located at
New Suffolk. Edward Boyd, Esq. appeared. Mr. Raynor read the
notice of hearing and presented proofs of publication from the
Suffolk Times and the L. I. Traveler-Watchman. There was a
difference in two measurements - 298.8~ on Xouros Road to Campbell
and 172.07 to the point or place of beginning. Mr. Boyd said the
difference is the radius that was put in at the request of the
Planning Board. What was in the paper was the original legal
description.
Mr. Raynor: As this subdivision is on an existing town highway,
there is no letter from the Supt. of Highways. It was sent to
the Planning Commission on the 2~th of this month. I will ask
if there is anyone present that would like to speak in opposition
to this subdivision entitled "Kouros Acres" in New Suffolk.
Hearing none, I will ask if there is anyone present this evening
that would like to speak in favor.
Mr. Boyd: I am representing the applicant, Mrs. Kouros. I
believe that we have complied with all of the requests of this
Board to draw the maps according to ~our wishes.~r I believe there
remains nothing for us to do and, accordingly, I would move that
the final map of "Kouros Acres" be approved by this Board at this
time.
Mr. Raynor: Is there anyone else that would like to speak in
favor of this subdivision. Hearing none, is there anyone present
this evening that would have some information in regard to this
subdivision that should come before this board at this time.
Mr. Coyle: He has complied with the rules about number 5 and
that is all we requested.
Mr. Wickham and Mr. Gordon had no comments.

Mr. Raynor: There being no further business, I will declare this
hearing adjourned.
Paradise-by-the Sound. Roger Rath and Howard Young appeared.
The recommendations of Lawrence M. Tuthill, P. E., were discussed.
Recommendations
1. That an additional hydrant be placed at the end of road "D".
2. That there be a 1 inch service line from the water main to
each lot.
3. That the spacing of the manholes be not more than 200 feet
apart.
Comments
1. That lots Nos. 44 and 45 do not have a width of 150 feet at
the building line.
2. That the park and playground areas do not total 2.5 acres.
3. That there is only one entrance to this subdivision.
The following are the determinations reached by the Board.
1. Request letter from the Village of Greenport.
2. Request letter from the Village of Greenport.
3. Mr. Raynor will check with the Supt. of Highways.
Comments 1. and 2. are waived. Comment #3 Mr. Wickham will explore
with the Town Attorney.
9:00 p.m. Public Hearing on the question of the approval of the
map of minor subdivision of Joanne Schwartz. William Price, Jr.,
Esq., appeared. Mr. Raynor read the notice of hearing and presented
proofs of publication from the Suffolk Times and the L. I. Traveler-
Watchman.
Mr. Raynor: As there is no highway construction and this is a
minor subdivision, there is no letter in the file from the Supt.
of Highways. We will first ask if there is anyone present this
evening that would like to speak in opposition to the subdivision
of Joanne Schwartz in East Marion. Hearing none, I will ask if
there is anyone that would like to speak in favor.
William Price, Jr.: I am appearing on behalf of Joanne Schwartz
to answer any questions regarding this minor subdivision.
Mr. Raynor: Is there anyone else present that would like to speak
in favor of this proposed subdivision? Hearing none, I have in
the file correspondence, notice of the legal hearing, the copy
of the declaration. Everything seems to be in order.

Mr. Wickham: There should be in the minutes some reference to the
fact that there is a setback line in lot #1 which indicates that
any residential building must be to the south of that line. Like-
wise, there should be some reference to the pie-shaped small piece
to the south of the Main State Road that it is part of lot #3
and not to be built upon.
Mr. Raynor: It is indicated on the map.
Mr. Wickham: It should be part of the minutes, also.
Mr. Coyle: It says walking right-of-way and looks like they don't
expect automobiles.
Mr. Price: That is right. I have a description of lot #2 that is
going to be used and refers to the walkway.
Mr. Coyle: Do you feel that lot #2 and #3 have sole ownership?
Mr. Price: It is in common with lot #1. These people have beach
rights to that section right to this point.
Mr. Wickham: Would you send us a copy of that?
Mr. Raynor: Fred, do you have anything?
Mr. Gordon: No.
Mr. Raynor: Is there anyone present that has any information
that they would like to present before the Board. Hearing none,
I will declare this hearing closed.
Peter Blank subdivision. William Price, Jr., Esq., appeared.
Mr. Wickham read the latest letter from Mr. Esser of the Soil and
Water Conservation District. Mr. Price requested a copy.
01d Town Park - James Bitses. Mr. Bitses had presented a new
map.
On motion made by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that the proposed cluster development entitled
"Old Town Park at Southold" be referred back to the Southold Town
Board with the accompanying data of Van Tuyl for its consideration
as a cluster location.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Bayview Woods Corporation. Howard Young, P. E., appeared.
Mr. Young is representing the developer and will furnish an
affidavit of ownership. The Board will look at the property by
the marsh.

On motion made by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED to set 7:30 p.m., Monday, April 17, 1978 at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question of the approval of the preliminary
map of subdivision known as "Cutchogue Joint Ventures~ Inc."
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
On motion made by Mr. Gordon, seconded by Mr. Wickham, it was
RESOLVED to set 8:00 p.m., Monday, April 17, 1978 at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question of the approval of the final map of
subdivision known as "Paradise-by-the-Sound".
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Cauntry Club Estates. Mr. Raynor stated for the record that he is
not in favor of the pipe going to the marsh because it might push
the dike and go into the wetlands. He doesn't want the safeguard
running off in the headlands of the creek. Mr. Tuthill was requested
to recalculate on the sand drain.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to grant approval to the sketch map of "Sebastian's
Cove" said map dated January 18, 1978 and amended March la, 1978.
Vote of the Board: Ayes: Raynor, Coyle, Gordon
Abstain: Wickham
A letter from George Toumanoff, the owner of the property, was
read. Mr. Toumanoff requested permission to rough grade the road
in order to open up the land for inspection by prospective buyers
prior to submission and approval of the final map. The Planning
Board voiced no objection to the rough grading of the road as this
is Mr. Toumanoff's private property. This matter has not yet been
before the town engineer, Supt. of Highways nor the County Planning
Commission as to road location and design.
Mr. Toumanoff also asked permission to enter into a contract of
sale of lot #2, containing the existing farmhouse, prior to final
approval of the plan, on the basis of the existing driveway,
utilities and previous resident use of the property. This request
will be explored with the town attorney for his opinion as to
whether it is within the jurisdiction of the Planning Board to
give this permission on an interior lot.

On motion made by Mr. Coyle, seconded by Mr. Wickham, it was
RESOLVED to grant approval to the map of the minor subdivision
of property of Frank Murphy located at Laurel, New York, subject
to covenants and restrictions being filed in the Suffolk County
Clerk's Office as to no further subdivision and that Section 2
will only be brought in as a major subdivision if it is ever
developed.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
On motion made by Mr. Gordon, seconded by Mr. Wickham, it was
RESOLVED to request a letter from the Supt. of Highways
regarding the drainage in the subdivision known as "Peconic Bay
Cove".
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Mr. Wickham reported that he had discussed the flood plain
elevation with the town attorney and Supervisor Martocchia and was
told by them to go ahead and have Lawrence Tuthill, the town
engineer, make a study using Planning Board and Engineering funds.
It was also mentioned that Shelter Island and several other areas
were barred from flood insurance. The Planning Board wants the
town attorney contacted to find out what the reason is for this.
On motion made by Mr. Wickham, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board recommends
that a study be made to determine the accuracy of the Preliminary
Flood Plain map as presented to the Town of Southold by the flood
insurance people and also the accuracy of the statements made in
the test.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Mrs. Tiedke reminded the Board of its invitation to a program
sponsored by the League of Women Voters and the North Fork
Environmental Council at which David New, on of the Cooperative
Extension Service will speak on Coastal Zone Management.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to set 8:30 p.m., Monday, April 17, 1978 at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the final
map of the subdivision known as "Country Club Estates".
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon

On motion made by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED to waive the requirement of fifty-foot roads built
to town highway specifications for the subdivision known as
,Brionngloid-by-the-Sea" because these roads are less than 600
feet long and will serve only one lot and it seems unreasonable
to ask that they be constructed to town specifications. Right-
of-ways will be subject to the town engineer's specifications
for improvements.
Vote of the Board: Ayes: Wickham, Coyle, Gordon
Abstain: Haynor (Mr. Wickham left)
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to set 9:00 p.m., Monday, April 17, 1978 at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the final
map of the subdivision known as ,'Brionngloid-by-the-Sea".
Vote of the Board: Ayes: Coyle, Gordon, Raynor
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board is willing
to approve a revision of the site plan of Eastern Long Island
Kampgrounds~ Inc. that would allow 53 (5,000) square foot sites
ahd 71 (2,500) square foot sites subject to the action of the
Southold Town Board.
Vote of the Board: Ayes: Raynor, Gordon, Coyle
Motion was made by Mr. Coyle, seconded by Mr. Gordon and
carried that the meeting be adjourned. Meeting was adjourned at
ll:20 p.m.
