GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765-1938 A regular meeting of the Southold Tow~ Planning Board was held at 7:30 p.m., Monday, July 17, 1978, at the Town Hall, Main Road, Southold, New York. Present were: Chairman John Wickham Vice-Chairman Henry E. Raynor, Jr. Frank S. Coyle, Member Frederick E. Gordon, Member James Wall, Member Lawrence M. Tuthill, Town Engineer (8:30 p.m.) Edward Bage, Town Engineer (8:30 p.m.) Douglas Love, L. I. Traveler-Watchman Peter Campbell, Suffolk Times Franklin Bear, North Fork Environmental Council Millicent Gossner, League of Women Voters Victor Trunce, Planning Student Mr. Wickham called the meeting to order at 7:30 p.m. Rene Gendron - Indian Woods (Fischer Estate) Mr. Gendron appeared. Mr. Wickham read over the letters from the Soil & Water Conservation District and Supt. of Highways Dean regarding the water problem that Mr. Gendron is having with his minor subdivision. There is no updated letter from Mr. Dean's office although Mr. Gendron said that Mr. Dean had indicated he would deliver a letter today. Mr. Wickham said the Planning Board will not take action until there is a letter in the file from the Supt. of Highways. Mr. Wickham asked Mr. Raynor to chair the remainder of the meeting. Sea Breeze Village. Richard Lark, Esq., and Emmanuel Kontotkosta appeared. Mr. Raynor reported that he had contacted the Town Attorney regarding the Southold Town Environmental Quality Review Act and Mr. Tasker had told him to comply with Local Law #3, Sections 44-5, 44-6 and 44-7. The letter from Mr. Lark which complies with 44-5 and 44-6 has been posted on the Town Clerk's Bulletin Board which is part of requirement 44-7. Mr. Lark stated that this is a revised plan which meets with the building inspector's approval and it is in technical compliance as far as the zoning law is concerned. Mr. Wickham expressed concern about the setback from the bank. He said we have required 100 feet. Mr. Lark referred to a study that shows the area in question to have a .6 foot accretion rather than erosion. Mr. Wickham said he would not accept this study as valid and the Technical Report 18 is worthless because it is completely inaccurate. Mr. Wickham stated that this property is not adapted to that many units or that much use. Further discussion ensued regarding the zoning of the property for that purpose and so forth. Mr. Raynor ended the discussion by saying that the Planning Board would discuss the matter later in the evening. Woodbine Manor. Mr. and Mrs. John Fellinger-Ihar and Shepard Scheinberg, Esq. appeared. Mr. Scheinberg said that the Fellinger- Ihars agree to pay the inspection fee based on the $66,000 bond estimate but desire not to post the bond but complete all require- ments before the signing of the final map. Mr. Raynor said he had not had the opportunity to check with the to~n attorney. If it is agreeable to the town attorney that the board follow this line of reasoning, it would be the only change from the set schedule. The Fellinger-Ihars have entered into an agreement with the town to deed to the town property for a recharge basin and are ready to enter into a contract and close immediately depending on the action of the Planning Board. There is an understanding with the Supt. of Highways and the Town that the soil being removed should remain on the property for the Fellinger-Ihars to utilize. Mr. Tasker is to be asked for a written opinion on this. Mr. Wickham made a motion, seconded by Mr. Coyle and carried that the Planning Board explore with the Town Attorney a setback requirement for property with bay or sound frontage to be an amend- ment os the Rules and Regulations for the Subdivision of Land. On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED that final approval be given the map of subdivision known as "Brionngloid-by-the-Sea" and upon receipt of final maps containing all signatures necessary from all agencies the chairman be authorized to sign the map. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall There was a question about the construction of the rights-of-way and the developer expressed an interest in having the work bonded. Mr. Raynor asked Mr. Tuthill to prepare a bond estimate. Maude Morgan. Helen Reiter had inquired as to what the Planning Board would require for access to this property. It will be necessary to have 25 foot wide for a minor subdivision and 50 foot wide for a major subdivision. It will be up to the town engineer as to what is necessary to make the road passable. An inspection will be made if Ms. Morgan intends to proceed with a subdivision. Serge Traube property. Helen Reiter had inquired about this property and if it was possible to make this a subdivision with all lots on the road and however deep they were. A sketch should be submitted as to what the developer would like to do. An amendment to the minutes of June 26 is to be made on page 5 regarding the size of the water mains. It should be 3/4 inch and i inch. Motion was made by Mr. Coyle, seconded by Mr. Gordon and carried to approve the minutes as amended. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to recommend the bond amount of $230,000 as submitted by Lawrence M. Tuthill, Engineer, for the subdivision know~ as "Paradise-by-the-Sound" to the Town Board. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall It will be necessary to have a letter in the file from Supt. of Highways Dean before the Planning Board can give final approval to the preliminary map and forward same to the Suffolk County Planning Commission for its action. On motion made by Mr. Gordon, seconded by Mr. Wickham, it was RESOLVED to graut approval to the sketch map of Droperty of William and Barbara Schriever, said map dated May 16, 1978, subject to Mr. and Mrs. Schriever applying for and obtaining a change of zone of the business-zoned property to residential. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to recommend the bond amount of $140,000 as submitted by Lawrence M. Tuthill, Engineer, for the subdivision known as "Country Club Estates" to the Town Board. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall -4- It will be necessary to have a letter in the file in the matter of "Country Club Estates" from the Supt. of Highways before the Planning Board can give final approval to the preliminary map and forward same to the Suffolk County Planning Commission for its action. On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED that based on a report from Edward Bage, Town Engineer, stating that all elements of the bonding have been met according to town standards, the Planning Board of the Town of Southold recommends to the Town Board release of the bond for the subdivision known as "Pebble Beach". Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion m~de by Mr. Wickham, seconded by Mr. Gordon, it was RESOLVED that in view of the fact that the rough grading has been completed, the Planning Board would recommend that the bond amount for the subdivision known as "Country Club Estates" be reduced to $100,000. The inspection fee is to be based on the original bond amount of $140,000. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Ceyle, it was RESOLVED to approve the preliminary map dated January 7, 1977 and amended April 14, 1978 for the subdivision known as "Bayview Farm" owned by Peter Blank, Jr., and Mary Louise Blank. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Long Pond Estates. The recommendations of Lawrence M. Tuthill of June 25, 1978 are to be sent to Ernest Wilsberg. Orient Hills. Mr. Tuthill's recommendations were reviewed as to the compliance with the revised maps. Item i is still incorrect. It shows 1,000 feet more pip than is needed. Comment and recommendation #1. Included in the correction should be a control survey of the proposed roads. NorthviewDrive is broken up by C~mmings property so it should be labelled east and west on the map. On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED to approve the preliminary map of subdivision known as "Richmond Shores at Peconic" dated June 28, 1978 with the exception that the trees are too close and should be fifteen feet apart. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED to approve the final map of the subdivision known as "Southold Gardens" with the stipulation that the sand drain be lowered one foot and recommendation that there be a pipe connecting with the adjacent catch basin. This is also subject to the approval of the Supt. of Highways and the Suffolk County Planning Commission. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Acknowledgement was made of a letter from Ms. Jody Adams. The Board will study her comments. Mr. Raynor asked that the record show that he was very pleased with the performance of Mrs. Linda Kowalski who helped out the board during the two-week absence of the regular secretary. Ms. Brush also commented that Mrs. Kowalski had catalogued all telephone messages and the mail which was most helpful to her upon her return. On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED to approve the site plan of "Sea Breeze Village" dated May 25, 1978 and revised June 2, 1978 subject to the rear yard setback requirement being equal to the adjacent property to the west and that on the east it be not closer than 75 feet from the top of the bluff. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Receipt was acknowledged of a letter from Mr. Edward Bage indicating that he will no longer be performing engineering services for the Planning Board. Mr. Wickham reported on the "S~mmary of Development Plan for the Town of Southold". He and Frank Beear have discussed this matter several times and there are several things that would be -6- added to it. Some reference has been made to the "208 Waste Water Study" and the Coastal Zone Management. The Soil Conservation Service has suggested that this would be the time to have some sort of an update on the erosion control requirements for subdivisions in progress so that raw land isn't left out for the winter. Each one of these things should be considered in the implementation. Shore erosion could be in there, too. The Supervizerwants the completed s~mmary and Mr. Wickham said he would try to get it to him in five or six weeks. Another draft will be made and if the Town Board thinks well of it, it can be printed. There being no further business to come before the Board, Coyle made a motion, seconded by Mr. Wall and carried that the meeting be adjourned.
