GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held on Tuesday, October 10, 1978 at the Town Hall, Main Road, Southold, New York, at 7:30 p.m. Present were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle, Member Frederick E. Gordon, Member James Wall, Member Millicent Gossner, League of Women Voters Jean Tiedke, League of Women Voters Franklin Bear, North Fork Environmental Council Douglas Love, L. I. Traveler-Watchman Peter Campbell, Suffolk Times 7:30 p.m. Public Hearing on the minor subdivision of property of Margery D. Burns located at Southold, New York. Margery D. Burns and Richard Cron, Esq., appeared. Mr. Raynor read the legal notice of hearing and presented proofs of publication in the L. I. Traveler-Watchman and Suffolk Times. Mr. Wickham read the following letter under date of October 5, 1978 fromthe Suffolk County Department of Planning to the Southold Town Planning Board. Dear Mr. Wickham: The Suffolk County Planning Commission at its regular meeting on October 4, 1978, reviewed the proposed subdivision plat entitled, "Minor Subd~¢ision- Margery D. Burns", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to the ~ollowing conditions deemed necessary to help~eserve the natural and aesthetic attributes of Canoe Inlet and Dryad's Basin: 1. No sanitary disposal facility shall be constructed within 100 feet of the mean high water line. 2. No stormwater ruuoff resulting from the development and improvement of the lots shall be permitted to discharge directly into the adjoining bodies of water. 3. Erosion control measures shall be required during and immed- iately after construction to insure that soils and other deleterious materials will not be carried into the adjoining bodies of water. 4. No building shall be erected on either lot that will be closer than 50 feet to the mean high water line. 5. All necessary permits under the Tidal Wetlands Act, if applicable, shall be acquired before start of any clearing or con- struction on either lot. /s/ Charles G. Lind, Chief Planner Mr. Wickham: There are no highways involved. The correspondence goes back to May of 1974. We have here under date of July 2, 1974 a statement from the then Tidal Wetlands Permit Administrator saying that the construction of one home would have no adverse effect on adjacent tidal wetlands and so forth. Our file would then appear to be in order and I will ask for anyone who wishes to speak in opposition to ~his minor subdivision on Cedar Beach Road in Southold entitled "Minor Subdivision of Margery D. Burns". Hearing none, is there anyone that wishes to speak in favor of it? Mr. Cron: I appear on behalf of Mrs. Burns. As the Board has indicated, this has been before this Board some period of time and at one time there were three lots proposed. Since the Board opposed that particular layout it was decided to ~roceed with a two-lot minor. This was delayed somewhat by the applicant and ~omewhat by circumstances not under her control. I ask that the Board please make an early determination on this matter. Mr. Wickham: Is there anyone else that wishes to be heard in favor of this subdivision? I would like to say for the record that these restrictions placed by the County are, in general, the same restrictions which we would require on behalf of the Town of Southold and the one thing which we generally require and is required by the County Board of Health is that both the sanitary facilities and the house be graded up to the same level and that would entail 20,000 square feet. We determined there was area enough to do this and we foresee no problem but I would like it in the record that the requirements of the County Board of Health are similar, if not identical, and will require grading up to the cesspool and the house. This is put in rather sharp perspective because of an application we had last week where it was proposed to put houses on pilings and we weren't able to discover what he was going to do with the cesspools. Mr. Cron: In light of the fact that the board's restrictions will be the same as the County's may I have a copy of it. Mr. Wickham: Does this board have any questions? If there is nothing else, I will declare the hearing closed. Gunther Morchel site plan. Mr. Morchel ~nd Gordon Ahlers appeared. At first, Mr. Morchel said he didn't own the property that the Planning Board wanted put in shrubs. Then, Mr. Ah~ers said that Mr. Morchel owned it but was using it to park six small foreign cars for the tenants upstairs. Mr. Morchel said there would be a parking problem if these spots were taken away. The Board insisted that it be put in shrubbery as per the approved site plan and the cars be parked elsewhere. There was discussion about a three foot paved buffer zone on the east. Lawrence Sto~an minor subdivision. Mr. Stojau and George Stankevich, Esq., appeared. Mr. Stojan has sold the development rights to the rear of this property. It should say Minor Subdivision of Lawrence and Martha Stojan, together and as individuals. The Pl~uning Board requested a copy of the deed for the development rights. Long Pond Estates. Richard Cron, Esq. appeared. Mr. Cron asked for some kind of action regarding the approval of this as he has new recommendations from the Town Engineer. Russell Case minor subdivision. Mr. Case would like a minor subdivision where the golf driving range is. Mr. Wickham suggested to him that he come in for a cluster minor subdivision and use the golf driving range as the additional open space required and use one-half acre lots for the buildings. The Board will inspect the property. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to give tentative approval to the sketch map of "Bayview Woods Corporation" dated February 15, 1978, pending submission of a sketch plan map incorporating the proposals made by the Planning Board in sketch map dated September 7, 1978 including the enlargement of the park aud playground. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Heritage Harbor. Riverside Homes, Inc. Howard Young appeared. Mr. Young wanted to know what is supposed to be done with the catch basins and the fact that Mr. Tuthill's bond estimate doesn't reflect what is on the map. He wants to know what to stake out. Mr. Wickhamwants to discuss the matter with the Supt. of Highways. The secretary was directed to set up an appointment. Orient Point Estates. Mr. Raynor reported that he had made an inspection of the property and looking at the surveyor's elevations he can't believe it. Mr. Wickham said potatoes are growing there although Mr. Raynor said water was up over his shoes. The following appeared questioning the advisability of housing in that area. Orville Terry, Joyce Terry, Frank Kujawski, Marie Johnson, Shirley Bachrach, Paul Stoutenburgh, Merlin Wiggin, Walter Smith, Marjorie Smith. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board recommends that all consideration be given to Donald Tuthill, the developer of Yennecott Park~ because he has met all the requirements of the Town of Southold at every step and exceeded them and because the current proposals will result in substantially lower density than originally contemplated by this Board and the development uses municipal water. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall This resolution is in snswer to a request by Mr. Tuthill for support from the board in his application to the Suffolk County Department of Health for release of three lots, #2, #29 and #46 from an agree- ment that these lots would be held and not sold. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was ~ESOLVED to approve the preliminary map of the subdivision "Sterling Forest" said map dated April 7, 1977, subject to the test hole requirement as outlined by the Tow~ Engineer in report dated August 29, 1978. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall RosenberE minor subdivision. A letter was read from Mr. Rosenberg and Mrs. Rosenberg. Mr. Raynor reported that he had talked with Dr. and Mrs. Rosenberg and it was his opinion that the Board should rescind the resolution approving the original submission and where he has gone to the Board of Appeals he now has a legal lot aud the Board should start again with this subdivision. There was also a letter dated October l0 from R. Terry, Attorney for the developers, in which Mr. Terry requested~no action be taken. There was no action taken at this meeting. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the sketch map of the Minor Subdivision of Margaret V. Braatz, map dated July 27, 1978. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall *** On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to give final approval to the map of the Minor Subdivision of Mary W. MacNish dated October 13, 1977 and authorize the chairman to sign the map. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall *** On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to refer to the Southold Town Board for its decision as to whether it may be developed in the cluster concept the subdivision to be known as Richmond Creek Farms. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall *** On motion made by Mr. Wall, seconded by Mr. Raynor, it was RESOLVED to approve the site plan of Sea Breeze Village owned by Kace Realty Company, said plan dated May 25, 1978 and amended August l, 1978. Vote of the Board: ~es: Wic~, Razor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the map of the Minor Subdivision of Margery D. Burns and authorize the chairman to sign the map. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall The site development plan of a Racquet and Tennis Club for Sandy Rowe & Mary Tloczkowski. It will be necessary to have a lighting schedule, more defined planting schedule, a drainage schedule and copy of building plans. In answer to an inquiry by John P. Gilowski regarding the construction of the roads in his minor subdivision, the Planning Board feels there is no reason why he can't remove the top soil and replace it with bankrun but he will need a stabilizer of either MC 0il, Pea Gravel or crushed stone. A meeting will be set up for October 23rd with Robert Beazley of Ecological Analysts, Inc. regarding the new State Environmental Quality Review Act. The next regular meeting of the Southold Town Planning Board will be held on October 30th followed by a meeting November 27th. There being no further business to come before the Board, Mr. Coyle made a motion, seconded by Mr. Wall and carried to adjourn the meeting.
