Y. 119~1 PLANNING BOARD MEMBERS John Wlekham, Chairman Henry Melsa Alfred Grebe Henry Raynor Frank Coyle M I N U T E S SOUTHOLD TOWN PLANNING BOARD November 9, 1972 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Thursday, November 9, 1972, at the Town Office, Main Road, Southold, New York. There were present: Henry Moisa, Vice Chairman; Henry Raynor; Frank Coyle. Absent: John Wickha~, Chairman; Alfred Grebe. Also present: Howard Terry, Building Inspector; Jean Tiedke, League of Women Voters. Rudolph Bruer, Esq., appeared before the Board with a map of property of Kimen/.and Retzos on east side of Rocky. Point Road, East Marion. He wa~ted to informed him that it must be filed asa minor subdivision and in o.~der to get a mortgage ~rom a bank the right of way must be 30 feet wide. There is one house on the property and it may be possible to have water tested from this house for the two lots. gr. Brue~-said he would tell his clients that it will be necessary to file for a minor subdivision. Southold Town Planning Board - 2 November 9, 1972 Mr. Bruer also presented a map of property of Andrew Hahn at Peconic. He-is proposing a four lot minor subdivision With three lots of one acre and one lot of 1.9 acres. The Board told Mr. Bruer that the right of way could not be less than 30 feet wide and suggested that he talk'to adjoining property owner about the possibility~of a joint right of way. Mr. Bruer said he would do this and have maps prepared for a minor subdivision. Mr. Hanson of Island Associates and Richard Cron, Esq., appeared before the Board with a proposed ma~or subdivision, Richmond Shores at Peconic. The property is 27.194 acres with 25'lots proposed. There is a New ~ork' State drainage easement on the property. Mr. Cron asked about making a eash contribution in lieu of park and playground. Mr. Moisa said the Ptanningl Board has been in favor of this but the Town Attorney has been hesitant. There was discussion about the cul de sac and right of way for lots 9 and 10. It was suggested that the road be continued for a possible future tie-in instead of the cul de sac. It was also discussed putting in an entrance on the Main Road. Mr Raynor a~so stated that the Board was aware of the ~&rbi~rary dredging ~of this proper~t~ and is going on[ r~c~rd as opposing it. Mr. ~ans~n said he had ~a town p~rmit. The work was almost finished when I ~as nolt~fied to stop. Mr. Raynor read ~the Planning Board' s letter of ~anuary 26, 1~70 to LaUrel ResOurces Corp. advising them they were in violation 8f the rules and regulations ~6r the subdivision iof ~and as regards dredging and a permit~ was required from the Planning Board. Mr. Co~le read the l~tte~ from Mr. Hanson in response to this letter dated January 30, 1970 and letter dated February 5, 1970 from the Planning Board to Mr. Hanson suggesting that work be stopped and the land replaced to its original condition. Mr. Raynor Sout~old Town Planning BOard - 3 - November 9, 1972 said he would like to look at the property. Mr. Cron said there was no intention of developing the property until October 1971 and questioned if .they were in violation of-the Subdivision Regul~iions. Mr. Terry said the same regulations apply to the excavation ordinance and they were in violation of that. Mr. Moisa stated that as far as~the layout is concerned some effort should be made to continue the road. The ~roads would have to be reviewed by the Superintendent of Highways. You have to get an easement over the drainage area. Mr. Raynor also told Mr. Cron that the area marked "private path" would have to be changed to a reserve area on the map and that catch basins are required and must be shown on the map. The Highway Committee of the Town.Board is going to look at the map and on the profiles.if there is a dip in the road they may require~a piece of land for a recharge area. T~is may be considered in the park and play groUnd. Mr. Raynor said they must also find Qut about the right'of way and the actual line of the creek. On motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the next regular meeting of the Southold Town Planning Board will be held November 29, 1972, at 7:30 p.m., Town Office, Main Road, Soutold. Vote of the Board: Ayes: Messrs. Moisa, Raynor, Coyle. The Planning Board has received a copy of the proposed amendments to the ZQning Ordinance No. 26 of the Town of Riverhead. Southold Town Planning Board - 4 - November 9, 1972 The Planning Board received an invitation from the League of Women Voters to attend a meeting on November 13, 1972, at the Southold Presbyterian Church Assembly Hall. Dr. Ian Marceau will speak on the "Role of the Town in EnvirOnmental Preservation" Mr. Terry presented a proposed map for Luce and Penny at East Cutchogue, New York. The Board cannot consider this map because it is not an actual preliminary subdivision map. On motion of Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that Messrs. Luce and Penny be requested to submit a subdivision map showing adjacent property owners and delineate lines within subdivision. Vote of the Board: Ayes: Messrs. Raynor, Coyle, Moisa. Lefferts P. Edson, Esq., Rudolph Bruer, Esq., Gene Haberman and Joseph Donovan appeared before the Board in regard to proposed major subdivision for Pebble Beach Realty Corp. at East Marion. Mr. Moisa told them the Planning Board had spoken .to the Town Board and the Highway Committee in regard to this property. It was the opinion of the Town Board that ~ r6ad ~hould'be along the~bluff. Mr. D0novan asked where they wanted the road and Mr~ Raynor said-without a~t®pDg~aphical map and without an e~gineer's report andi~nion on erosion it is difficult to place the road. Mr. Haberman said the contours within 300 feet of the bluff did not lend themselves to a road. Mr. Terry said the Town Highway Committee and the Superintendent of Highways do not like the cul de sacs. The Planning Board will require the green belting tied up with covenants; it would be an agreement between the Town and the developers that they would put in the easements. The'Tow~ Board also would want this p~imary road 60 feet wide; 36 feet would be paved and 24 feet right of way. Mr. Haberman presented a new proposed plot plan. He said Van Tuyl put in a rough line of the bluff from a geodetic survey. This new plan also shows the cuts Southold Town Planning Board November 9, 1972 for the future road. Mr. Raynor said the Town Board did not give a definite commitment on the.~roads. Mr. Donovan said. the cul de sacs will cut down traffic flow. They are not going to disturb the bluff and will restrict it so no one can distnnb it. They. also propose to establish a rear yard setback so the view can't be blocked. Mr~ Coyle suggested they submit a map showing the roads to the east ~of Rocky Point Road. Mr~ Raynor asked if they propose initiating the green belting in planting. Mr. Donovan said they intend to replant the trees and vegetation removed from the wooded areas. The walk~ays are to be kept natural. Mr. Moisa said the Planning Board will discuss this again with the Town Board on November 20th. Mr. Haberman said they would submit more information for that meeting. Mr. Bob Douglass appeared before the Board in reference to the proposed minor subdivision for N. Douglass Latham off King Street, Orient. Mr. Douglass said the property has been sold and the owners~ Richard Latham, Jr. and Peter Blenk, do not want a subdivision; the proposed minor subdivision is, therefore, withdrawn. is dangerous for children. The road is going to be private. Mr. Douglass also said uhere is a beach' adjoining the beach at Willow Terrace. TheyPlanning Board is agreeable to thiS layout. Southold Town Planning Board - 6 - November 9, 1972 Mr. Leo Kwasneski presented a map of a proposed major subdivision.of 17 acres owned by Alfred Dart at SOuthold. The Board is in basic agreement with the layout. The map must be red~awn. Mr. Kwasneski asked if there had to be a turn around at the end of the road. Mr. Terry said he could just reserve the area at the end. Mr. Coyle said the roads must meet the highway specifications. The connecting road to the north is a Town road. Mr. Kwasneski thanked the Board for their help and said he would have preliminary maps prepared. The Planning Board received a copy of the minutes of the Southold Town Trustees meeting of November 6, 1972. The Secretary reported receiving a telephone call from Gordon~Watt of Suffolk County Department of Environmental Control in regard to a hearing in regard to Fishers Island Development Corp. They will-be required to have an Engineering Report started by December 1, 1972; begin consturction by February 1, 1973; and have primary system completed May 1, 1973. They intend to assessshomeowners for the cost. Mr. Moisa read Mr. Wickham's letter to William Esseks, Esq., dated November 3, 1972, in regard to proposed~change of zone on Tuckers Lane, Southold for condominiums. The Planning Board received a copy of a letter to the Town Board from Richard F..Lark, Esq., in reference to Laurel Country Estates, dated November 1, 1972, requesting release of the Performance Bond. Southotd Town Planning Board - 7 November 9, 1972 Attached to this letter was a letter from Charles Abrahams, P.E., to Raymond Dean reporting that the road construction for this project now complies fully with highway specifications. The Planning Board has not received a letter from the Spperintendent of Highways on the roads or a request from the Town Board. The matter will bs taken up with the Town Attorney. The Planning Board received a letter from Charles Abrahams,P.E., in regard to Cleaves Point, Seetion 3, stating that the road construction now complies substantially with the highway specifications pertaining to this project. The Planning Board has not received a letter from the Superintendent of Highways or a request from the Town Board on this matter. Received a letter from the Superintendent of Highways in regard to Willow Point Estates recommending release of the bond. ON motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Planning Board recommend to the Town Board r~ease of the bond for Willow Point Subdivision. Vote of the Board: AYES: Messrs. Moisa, Raynor, Coyle. Mr. Raynor read two letters from Eugene R. Francolini, Esq., dated October 3 and October 31 stating that the ~o~ds have been completed in Corey Creek EStates and requesting release of the bond. A letter was also received from Donald Alfano rDpresenting the property owners of Co~ey Creek~Estates advising that they Want to keep Corey Creek Lane a private road. The Planning Southold Town Planning Board November 9, 1972 Board does not have a recommendation from the Superintendent of Highways on the roads. The Planning Board received a letter from The St. Paul Insurance Companies in regard to Blue Horizons Subdivision. The bond is now in default and nothing has been done on the roads. On motion of Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the proposed change of znne on the Town Board's own motion for property on Mechanic Street, Southold, be submitted to the Suffolk County Planning Commission. Vote of the Board: Ayes: Messrs. Coyle, Raynor, Moisa. Mr. Moisa read Mr. Wickham's letter of November 3, 1922, to Froehlich & Mahony, Esq., in regard to Orient- By-The-Sea Subdivision advising them of the Planning Board resolution to approve one acre lots in the area west of Ryder Farm Lane and ~outh and west of Plum Island Lane as a new Section III. Lands End Subdivision was discussed. A letter will be sent to Mr. Kroehler informing him of Changes requested by the Town Board at the meeting of November 2, 1972; and asking him to attend Planning Board meeting of November 29th. Southold Town Planning Board November 9, 1972 Mr. Moisa read the petition from resid~m~s of Mill Colony and Yennecott in regard to proposed Wild Animal Park and African Village as described in 9-7-72 issue of Traveler Watchman newspaper.
