HomeMy WebLinkAboutCalculation & Verification of Livable Floor AreaRESOLUTION 2011-353 ADOPTED DOC ID: 6843 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2011-353 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON APRIL 26, 2011: RESOLVED that the Town Board of the Town of Southold hereby adopts the foliowin~ Policy: CALCULATION AND VERIFICATION OF LIVABLE FLOOR AREA POLICY In 2010, the Town Board adopted a Local Law entitled "A Local Law in relation to Amendments to Use Regulations within the Agricultural Conservation (A-C) District and Low Density Residential R-40, R-80, R-120, R-200, and R-400 Districts and Accessory Apartments", which permits accessory apartments in accessory structures, subject to special permit approval by the Zoning Board of Appeals. One of the special permit criteria requires a proposal for an accessory apartment in an accessory structure to be "no less than 450 square feet and shall not exceed 750 square feet of livable floor area" (§280-13(B)(13)(f)). Special permit applications to the Zoning Board of Appeals do not require review by Building Department prior to the submission of an application. However, there may be instances where the Building Department review is required to verify the proposed square footage of an accessory apartment. The Town Board hereby directs the Building Department to verify livable floor area in all special permit applications submitted to the Zoning Board of Appeals within 14 days of receipt of the application from the ZBA Office.
