THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2011-350 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
APRIL 26, 2011:
RESOLVED that pursuant to Chapter 280-176 of Article XXX, Agricultural Planned
Development District (AgPDD) of the Town Code~ the Town Board of the Town of Southoid
hereby sets the annual price to be paid by the Town for AgPDD development rights sales at
$60,500 per true acre.
BE IT FURTHER RESOLVED that the annual purchase price shall be valid for up to a year
from the date of adoption, and that such purchase price may be amended during the annual time
period upon recommendation by the Land Preservation Committee and adoption of same by the
Town Board.
BE IT FURTHER RESOLVED that the Town Board of the Town of Southold hereby adopts
the Policy for the Agricultural Planned Development District (AgPDD) Section 280-176 (Price
for Development Rights) dated April 26, 2011, effective immediately.

The price to be paid by the Town for Agricultural Planned Development District (AgPDD) development rights sales shall
be determined as follows:
1) Two (2) appraisals shall be prepared by Certified Appraisers in accordance with the AgPDD_Section 280-176 (Price
for Development Rights) and the Hypothetical Parcel for AgPDD Purposes designed by the Land Preservation
Committee. The Hypothetical Parcel, last revised 2/24/2011, will be used for future appraisals, unless modified by the
Land Preservation Committee.
The appraisals shall establish a value for a true acre wig:hone (1) true acre.being 43,560 sq. ft.

2) The Land Preservation Committee shall use the appraisals to prepare a recommendation for the
Town Board to set an annual price to be paid by the Town for AgPDD development rights sales.
3) The Town Board shall, by resolution, establish the annual purchase price per true acre to be paid
by the Town for AgPDD development rights sales.
4) The value of one (1) development right for AgPDD purposes will be calculated as follows:
Property located within R-80 and Agricultural-Conservation (A-C) Zoning District
The purchase price for one (1) Development Right shall equal the annual purchase price per true acre multiplied by
1.84 acres (80,000 square feet).
Property located within R-40 Zoning District
The purchase price for one (1) Development Right shall equal the annual purchase price per true acre multiplied by
0.92 acre (40,000 square feet).
Property located within R-200 Zoned District
The purchase price for one (1) Development Right shall equal the annual purchase price established for properties
located within the R-80/A-C Zone.
Examples:
Example property is 20 acres (871,200 sq. ~.) of bui!d.~[e land.
Example assumes an annual purchase price per true acr,e established @ $60,500.

4) The annual purchase price shall remain valid for up to one year from the date of adoption. If during the 1 year time
frame the Land Preservation Committee finds reason to recommend change, the annual purchase price may be
amended during the annual time frame if an amendment is recommended by the LPC and adopted by the Town
Board.
