Re: Proposed Site Plan for Jemco Winery

This site plan is for construction of an 8,419 s.f. building w~th associa~ j;)acking for th~purpose of a
retail winery on 60.33 acres located in the R-80 Zoning District.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the proposed action is CONSISTENT with the LWRP,
provided that the below recommendations are required in the site plan approval.
The area is included and identified as an archeo-sensitive site. Therefore, it is unknown if the
proposed action will impair important historical or archaeological resources at this time.
To further the intent of Policy 2, Preserve historic resources of the Town of Southold it is
recommended that an archeoloqical survey be conducted within the buildinq and parkinq areas
prior to any ground disturbance.
To further Policy 3, Enhance visual quality and protect scenic resources throughout the Town of
Southold.
A. Minimize introduction of structural design components (including utility lines, lighting,
signage and fencing) which would be discordant with existing natural scenic
components and character; and
E. Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
Preserve existing vegetation which contributes to the scenic quality of the
landscape.
Require a 75' scenic easement from the State Route 25 property line, north,
to preserve to the scenic quality of the New York State Scenic Byway.
To further Policy 4.1,Minimize losses of human life and structures from flooding and erosion
hazards" the following is recommended.
The fo/lowing management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
Require one beach access over the bluff to minimize the potential for erosion.
The access should be located to accommodate any future development of the
parcel.
To further Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystem the following is recommended.
6.3 Protect and restore tidal and freshwater wetlands.
E. Maintain buffers to ensure that adverse effects of adjacent or
nearby development are avoided:
1. Maintain buffers to achieve a high filtration efficiency of
surface runoff.
2. Avoid permanent or unnecessary disturbance within buffer
areas.
3. Maintain existing indigenous vegetation within buffer areas.
Require the establishment of a natural veqetated buffer from the top-of-bluff lin~,
landward for distance of 100'. A sample definition follows:
NATURAL VEGETATED BUFFER -- A land area of a certain length and width where
existing vegetation occurs prior to the commencement of any grading or clearing activity.
Vegetation shall be maintained to achieve a minimum percentage of ground cover of
95%. To achieve the percentage of ground cover, indigenous, drought-tolerant
vegetation shall be planted. Survival of planted vegetation shall be 90% for a period of
three years. Maintenance activities within the buffer are limited to removing vegetation
which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to
maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access
path constructed of pervious material for access to the water-body. [Added 12-15-2009

Policy 12.1, "Protect agricultural/ands from conversion to other land uses."
D. Provide buffers between agricultural and non-ag~cultural uses.
New development located adjacent or in proximity to agricultural land or uses
should provide sufficient buffer between agricultural and non-agricultural lands to
protect agricultural uses from interference from non-agricultural uses, and protect
non-agricultural lands from potentially offensive agricultural practices.
Further, if the action is approved it is recommended that a veRetative buffer be
established between the western (main) parkin,q area and residential properties
to the west and between the eastern overflow parking areas and residences tn
the east to minimize potential conflicts between the residences and the future
agricultural/winery use. The location of the buffers should be further discussed
(e..q. On the property line or against the parkinq areas)
If the above recommendations are accepted as conditions it is recommended that the Board
require that the conditions be memorialized in a filed covenant and restriction.
