Mattituck, NY 11952 RE: 4322 WESTPHALIA RD., MATTITUCK SCTM#113-9-9.2 Dear Ms. Saunders: The Southold Town Board of Trustees reviewed the survey prepared by John C. Ehlers last dated August 10, 2004 and determined the construction of a first floor porch and second-story addition to the existing dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 25' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. WHEREAS, J.M.O. Environmental Consulting on behalf of Jean A. Saunders applied to the S outhold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 27, 2002. WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on July 24, 2002 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. Saunders for a Wetland Permit for a dock 14 feet of existing dock - old dock shall be removed replace with new 4'x86' catwalk 3'x20' ramp and 6'x20' float secured by two pilings new set of 4'x20' steps up the bluff check measurement on seaward side of the float - new drawing. 8/23/02 BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Ban-: I am presently writing you in response to the "Request For Necessary Data m~d Information" issued for this project on 5/21/02 (copy enclosed). Prior to addressing those issues addressed in this request I would like to apologize for not responding to this in a more timely manner. Since the time o[ the request we had been asked by the applicant to modify the application. The request to modify the application has resulted in not only the preparation of new plans but also additional soundings, measurements and site meeting with representatives of the Southold Town Trustees and inspections by the N.Y.S.D.E.C. The applicant is now seeking to remove the existing 30"x 16 ramp and 3'x 26' fixed dock, both of which are in a state of despair. Then to construct a 4'x 20' set of stairs down the existing bluff leading to a 4'x 86' fixed dock, elevated 4' above the grade of the marsh, a 3'x 20 ramp and a 6'x 20 float arranged in a "L" configuration which would be secured by two piles. For your review we have enclosed copies of the plans which depict the modified proposal, water depths at 10- intervals taken during a period of Iow tide and the width of the waterway. Kindly note that the photograph is 1" to 100- scale and was taken on 3/14/00. In counting only those docks depicted west of the "shoal" at the opening of this branch of the creek 34 existing docks can be observed, 17 on either side of the creek. It should also be noted that since the photograph was taken in mid-March, that not all of the portions of some of the docks are depicted because some are seasonal. On the south side of this section of the creek there are sections of six separate docking facilities where one can see floats stored on beaches and in areas of intertidal marsh along side the fixed docks, The pilings utilized to secure these floats can be seen located offshore of the existing fixed docks. In examining the north side of the creek, one can note 7 docks in the same situation. Although there is no marked navigational channel in this section of the creek in examining the phone, one can note that file docks are all of average length as is the applicant's and none appear to protrude into any fairway area 0fthe Creek. The applicant is seeking to replace a docking facility that will allow her access to Mattituck Creek and the Long Island Sound. Both of which areas are prime sites for fishing, shell-fishing, Iobstering, swimming, boating and a myriad of other activities which are water dependent. The project is as proposed, is considered water dependent as determined in Policy #2, and therefore is considered consistent with this policy. In regards to the NYS CMP Policy No. 20, the applicant's property is located on Howard's Branch of Mattituck Creek. As earlier stated there are a minimum of 34 private docking facilities located m this section of the creek. The main body of Mattituck Creek has at a minimum a hundred similar structures in addition at least five large commercial marinas, a public mooring area, a public boat launching ramp and a number of commercial launching ramps, boat rental stations, commercial fishing docks and docks where charter and fishing party boats are stationed. The project as proposed would not result in a reduction in the existing level of public access to existing public coastal lands or waters by interrupting pedestrian access. The project shall not result in the elimination of the possibility of increasing public access in the future by physically preventing convenient public access to public coastal lands or waters. With this I believe that the project, as proposed is consistent with this policy. In closing, kindly note that I have placed a small piece of black tape on the enclosed photograph. The tape measures to scale the length of the proposed structure (+ 109-), given fl~e hinged rmnp's over ride of the float in an "L" configuration. The tape has been placed at the exact site of the proposed structure (+ 14') west of the existing structure which may be noted on the photograph. I would ask that upon your review of the project that the aerial photograph be returned sine I have promised to donate it to the offices of the Board of Town Trustees of the Town of Southold. You are of course welcome to copy the photograph and when the review is complete kindly contact our office and we will arrange shipping and handling.
