Dear Mr. Ham:
The Board of Trustees reviewed the site plan prepared by Richard H. Strouse dated November
1, 2010 and determined the proposed construction of a single-family dwelling with a porch and a
deck to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and
Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agency.

Dear Board Members:
I represent prospective purchasers of a parcel of vacant land near Barlow
Pond on Fishers Island bearing the referenced tax map number.
I have enclosed two prints of a site plan showing proposed building
activities my clients intend to undertake after they acquire the property involving the
construction of a single-family residence with a porch and a deck, activities which we
believe to be out of your jurisdiction.
Please advise me in writing whether you agree that the proposed
construction is out of your jurisdiction or whether the same would require the issuance of
a permit by your agency. In that regard, I have enclosed a check for $50.
I understand that you may wish to send one or more of your members to
inspect the site and, in that regard, I will obtain a letter of consent from the owner and
forward it to you when it is in hand. In the meantime, however, I would appreciate it if you
would give me at least a preliminary indication of your position which you may, of course,
qualify and make subject to the actual state of facts an inspection might disclose.
