Our first order of business is to set Monday, April 11,2011 at 6 p.m. at the $outhold Town Hall, Main Road, Southold, s the time and place for the next regular Planning Board Public Meeting. Southold Town Planning Board Pa.qe Two March 14, 2011 CONSERVATION SUBDIVISIONS, STANDARD SUBDIVISIONS, RE- SUBDIVISIONS (Lot Line Changes) Setting of Final Hearings: Batta.qlia, Joseph & Heidi - This is a standard subdivision of 2.32 acres into two lots where Lot 1 = 43,213 s.f. and Lot 2 = 57,809 s.f. in the R-40 Zoning District. This site is located at 1720 Hobart Road, on the west side of Hobart Road approximately 1,059 feet north from Terry Lane in Southold. SCTM#1000-64-3-3 Kenneth Edwards: Mr. Chairman, I would like to offer the following resolution: be it RESOLVED, that the Southold Town Planning Board set Monday, April 11,201 at 6:02 p.m. for a final public hearing regarding the final plat entitled "Final Plat of Joseph and Heidi Battaglia" dated as last revised October 17, 2010, for the above- referenced standard subdivision. Conditional Sketch Extensions: Colony Pond -This proposal is for a standard subdivision of a 13.540-acre parcel into five lots where Lot 1 = 35,709 sq. ft., Lot 2 = 336,962 sq. ft., inclusive of a 41,470 sq. ft. building envelope and 6.8 acres of preserved Open Space, Lot 3 = 30,252 sq. ft., Lot 4 = 30,012 sq. ft., and Lot 5 = 29,984 sq. ft. in the R-80 Zoning District. The property is located on the s/s/o Colony Road approximately 470' e/o Bayview Avenue in Southold. SCTM#1000-52-5-60.3 James Rich, II1: Mr. Chairman, I will offer the following resolution: WHEREAS, this proposal is for a standard subdivision to subdivide a 13.540-acre parcel into five lots where Lot 1 = 35,709 sq. ft., Lot 2 = 336,962 sq. ft., inclusive of a 41,470 sq. ft. building envelope and 6.8 acres of preserved Open Space, Lot 3 = 30,252 sq. ft., Lot 4 = 30,012 sq. ft., and Lot 5 = 29,984 sq. ft. in the R-80 Zoning District; and Southold Town Planning Board Page Three March 14, 2011 WHEREAS, on September 13, 2010, the Southold Town Planning Board re-issued Conditional Sketch Approval originally granted on February 11, 2008 upon the map entitled "Road and Drainage Plan of Colony Pond", dated April 4, 2006 and last revised June 29, 2007, prepared by Jeffrey T. Butler, P.E.; and WHEREAS, on February 14, 2011, the applicant submitted a request to the Southold Town Planning Board to extend Conditional Sketch Approval for 90 days due to the continuing effort to meet all of the requirements outlined in the Conditional Sketch Approval re-issued on September 13, 2010; and WHEREAS, the Southold Town Planning Board reviewed the above-referenced request at their February 28, 2011 Work Session; be it therefore RESOLVED, that the Southold Town Planning Board hereby extends Conditional Sketch Approval for a period of 90 days from the date of this resolution to June 15, 2011. SITE PLANS Final Determinations: McCall Farm Winery - This site plan is to construct a 724 s.f. wine tasting room and a 782 s.f. wine storage area by altering an existing 2,480 s.f. barn on an 87-acre parcel in the A-C Zoning District. The property is located at 22600 Main Road in Cutchogue. SCTM#1000-109-1-40 Donald Wilcenski: Mr. Chairman, I will offer the following resolution: WHEREAS, this site plan is to construct a 724 s.f. wine tasting room and a 782 s.f. wine storage area by altering an existing 2,480 s.f. barn on an 87-acre parcel in the A-C Zoning District; and WHEREAS, on January 19, 2010, a site plan application was submitted for review by the applicant's agent, Samuels & Steelman; and Southold Town Planning Board Page Four March 14, 2011 WHEREAS, on March 23, 2010, the Southold Town Planning Board formally accepted the application for review and distributed the application to agencies having jurisdiction for their comments including the following: Town Engineer, Architectural Review Committee, Cutchogue Fire Department, Suffolk County Planning Commission, Local Waterfront Revitalization Coordinator, Southold Building Department and NYS DOT; and WHEREAS, the comments from those agencies were received and reviewed by the Planning Board, discussed with the applicant, and incorporated into the site plan to the satisfaction of the Planning Board; and WHEREAS, on May 10, 2010, a public hearing was held and closed by the Southold Town Planning Board regarding the site plan; and WHEREAS, on May 17, 2010, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 C., received a reply from the Suffolk County Planning Commission with the notation that the application was a matter for local determination, with two comments: 1. No off-street parking should be allowed to overflow onto adjacent Suffolk County (purchase of development rights) farmland property; 2. A fence (in accordance with the Zoning Code) or a landscaped buffer should be located between Lot 40 and Suffolk County PDR farmland property to the south. Both comments were considered by the Planning Board and the Development Rights Easement Area was noted on the plan, however, a fence or landscaped buffer was not required because both uses are agricultural and screening was not considered necessary; and WHEREAS, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5c(7), has made a determination that the proposed action is a Type II Action and not subject to further environmental review; and WHEREAS, on August 23, 2010, the applicant submitted the Suffolk County Department of Health Services approval, Permit (#C10-10-0003) and a copy of the plan approved by the SCDHS, on which one hand-written notation was made (and subsequently noted on the site plan to be endorsed by the Planning Board); and WHEREAS, on March 9, 2011, the applicant submitted plans approved by the NYS DOT with their Curb Cut Permit #10-094P, and those plans were found to be in agreement with the site plan except for one detail showing an existing curb cut to be abandoned. This was subsequently noted on the site plan; and WHEREAS, on March 10, 2011, the Cutchogue Fire Department reviewed the plan and requested an emergency vehicle turn-around, pursuant to State Fire Code Appendix D103.4, be installed as the driveway is a dead-end greater than 150' in length; and Southold Town Planninq Board Pa.qe Five March 14, 2011 WHEREAS, on March 11, 2011, the Southold Town Building Inspector reviewed the plan and certified that the proposed action is a permitted use in this A-C Zoning District; and WHEREAS, at a Work Session on March 14, 2011, the Planning Board determined that all applicable requirements of the Site Plan Regulations Article XXIV, {}280 - Site Plan Approval of the Town of Southold have been met; be it therefore, RESOLVED, that the Southold Town Planning Board has determined that the action is consistent under the policies of the Town of Southold Local Waterfront Revitalization Program; Kenneth Edwards: Second the motion. The buildings include three horse barns, two at 5,087 s.f. and one at 6,885 s.f., and two 12' diameter silos. Buildings proposed to be added include six 12' X 24' pasture shelters. Also proposed is a 1,243 s.f. apartment on the second floor of the largest barn for the purpose of living quarters for on-site supervision of the horses (granted a ZBA special exception approval as a "Farm Labor Camp" in February, 2011) on a 133+ acre parcel in the A-C Zoning District. The property is located on the south side of Indian Neck Lane, 646 feet west of Arrowhead Lane, Peconic. SCTM#1000-98-1-27.1 & 2.1 and 97-9-10.4 & 12 William Cremers: Mr. Chairman, I will offer the following: WHEREAS, this site plan is for a change of use for existing buildings from residential accessory structures to primary agricultural structures.
