HomeMy WebLinkAbout01/09/2009 Town of Southold Housing advisory con~nisSion MEETING MINUTES MEETING #37 January 09, 2009 Riverhead Town Hall Present: Rona Smith, Leslie Weisman, LeRoy Heyliger, Bill Gatz and Phillip Beltz. Also present: Town of Southold: Patricia Finnegan, Town Attorney and Mark Terry, Principal Planner. Town of Riverhead: Annemarie Prudenti, Assistant Town Attorney and LeRoy Barnes, Building Department Administrator. Excused: Margaret Minichini, Jenny Gould, Nancy Pester, John Vahey, Don Leslie, Jr. and Lori Pfeiffer. The meeting began at 11:05 a.m. Hiqhliqhts of Discussion with Riverhead Personnel Re: Accessory Apartment Leqislation and Role of Review Board: · Intent to create small apartment units to assist median income households (note, not necessarily affordable). Primary purpose to ensure and increase compliance with building and fire codes due to the proliferation of illegal units · Mandate owner occupancy and primary residence · Do not prohibit seasonal use · No income or rent guidelines · No permits issued until three years has elapsed from date of issuance of certificate of occupancy · Minimum square footage 300 sq ft and maximum 650 sq ft, however, pre-existing units up to $50 sq ft may be granted approval by Accessory Apartment Review Board (AARB) · AARB consists of five appointed residents with diverse backgrounds (architecture, construction, title, assessments, local business) who meet monthly. Compensation $4k annually. · Minimum of two parking stalls for occupants of accessory apts. · Originally, amnesty was provided for one year for illegal dwellings to comply with code however new legislation will now allow two years to comply. To date, 2 of 15 applications before AARB sought amnesty. · Pre-approval Accessory Apartment Application form/process developed to lessen impediments and increase expediency of process · Appeals from AARB determination by Article 78 proceeding · Sunset provision of 500 units established by Planning Dept. study of existing affordable units (trailers, etc.) to address goals of NY state & SC · No specific design standards but units must preserve residential character · Outreach to the community consisted of website, advertisements in paper, govt. channel--community outreach targeted promoting safety for residents and the potential to collect taxes should be "marketing" Next Meetinq Date: February 11,2009, at 5:30 p.m. at the Human Resource Center in Mattituck.
