application for building permit and the Building Inspector's March 8, 2010, amended June 3, 2010
Notice of Disapproval concerning additions and alterations to an existing dwelling, at 1 ) less than the
code required side yard setback of 15 feet, 2) less than the code required combined side yard setback
of 35 feet, 3) less than the code required setback to a bulkhead of 75 feet; at: 4075 Stillwater Ave.,
(East Creek (Eugene's Creek) Cutchogue, NY, SCTM#1000-137-1-8.1.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed second
story addition is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "11" which states:
II.
Additions to an existing building or rebuilt residential structure which results in no net
increase in ground area coverage, except where the parcel is located in a coastal erosion
hazard area;
The parcel is not located within the Coastal Erosion Hazard Area.
The proposed porch (roofed over) is recommended as CONSISTENT with the LWRP policies.

35' combined. The proposed addition indicates side yard setbacks of 5.7' & 31.2'
combined..
Also, the proposed additions are not permitted pursuant to Article XXII Section 280-116
which states.'.
"All buildings or structures located on lots upon which a bulkhead, ... and which
are adjacent to tidal water bodies other than sounds shall be set back not less than 75 feet
from the bulkhead."
The proposed additions indicate a setback of+-43.5' from the bulkhead.

achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in mom detail and, if necessary, modified prior to making a
dctcnnination that it is consistent to the maximum extent practicable with thc LWRP policy
