S. CAMPO #6411 - Request for Variance from Code Sections 280-124 and 280-116, based on an
application for building permit and the Building Inspector's June 3, 2010 Notice of Disapproval
concerning demolition and construction of a new single-family dwelling, at 1) less than the code
required front yard setback of 40 feet, 2) less than the code required rear yard setback of 50 feet, 3)
less than the code required bulkhead setback of 75 feet; at: 1165 Fisherman's Beach Rd., (adj. to
Cutchogue Harbor) Cutchogue, NY.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP provided
that the below best management practices are required.

Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Provide adequate buffers between wetlands and adjacent or nearby uses and activities
in order to ensure protection of the wetland's character, quafity, values, and functions.
The adequacy of the buffer depends on the following factors:
Potential for adverse effects associated with the use. Uses such as those
involving hazardous materials, on-site sewage disposal, or mineral extraction
have high potential for adverse effects and may require substantial buffer.
The nature and importance of the wetland and its benefits. Substantial buffers
may be necessary to avoid adverse effects from adjacent or nearby uses based
on the nature of the land use and the characteristics of the affected wetland.
Direction and flow of surface water between a use and adjacent or nearby
wetland. Buffer widths may be reduced in areas where drainage patterns
normally do not lead directly to the wetland and where adverse affects on the
wetland, other than those due to runoff, are not likely.
Buffer width necessary to achieve a high particulate filtration efficiency of surface
runoff as determined by vegetative cover type, soil characteristics, and slope of
land.
Other management measures or design alternatives to protect wetlands from
adverse effects where site constraints do not allow sufficient buffer width.
Maintain buffers to ensure that adverse effects of adjacent or nearby development are
avoided:
1. Maintain buffers to achieve a high filtration efficiency of surface runoff.
Avoid permanent or unnecessary disturbance within buffer areas.
Maintain existing indigenous vegetation within buffer areas.
The Board of Trustees issued a Wetland Permit for the action on August 19, 2009. The permit
does not reference a buffer.
The site plan shows a non- disturbance buffer, however, the limits of the buffer are not clearly
shown (is the landward limit intended to be the "limits of clearing")? it is recommended that
the Board clarify and memorialized the location of the buffer and the activities permitted within
the buffer area. Note that the non-disturbance buffer should not be located in the right- of- way
unless proof of abandonment and ownership has been submitted.
NON- DISTURBANCE BUFFER -- a land area containing existing vegetation of varying widths located
seaward of the "limits of clearing" depicted on the site plan titled Campo House, last dated July 14,
2010. Clearing and/or grading activities or applying fertilizers and pesticides within the buffer area are
prohibited. Maintenance activities within the buffer are limited to removing vegetation which are
hazardous to life and property, replanting of native, drought tolerant vegetation and establishing a four
foot (4') wide access path constructed of pervious material for access to the water-body.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action;

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Water~ont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

part of the consideration for the issuance of the Permit does understand and prescribe to the

That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Pennittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of

That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, August 19, 2009 regarding the above matter:
WHEREAS, Mark K. Schwadz, AIA on behalf of ANTHONY CAMPO applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated June 11, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the app ication be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 19, 2009, at which time all interested persons were given an
oppodunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
