NOTE: that the survey dated as last revised, July 24, 2009 does not show the Coastal Erosion Hazard
Area (line) or flood zones. It is recommended that the applicant provide these details on the survey.
STEPHANOS STEFANIDES #6413 - Request for Variance from Code Sections 280-116(B) and 280-
124, based on an application for building permit and the Building Inspector's June 11, 2010, Notice of
Disapproval concerning proposed alterations/additions and "as built" deck addition to seasonal
dwelling, at; 1) less than the code required bulkhead setback of 75 feet, 2) less than the code required
minimum side yard setback of 10 feet, 3) less than the code required total combined side yards of 25
feet, 4) less than the code required rear yard setback of 35 feet, 5) more than the code required total lot
coverage of 20%, at: 780 Rabbit La., (adj. to Gardiner's Bay) East Marion, NY. SCTM#1000-31-18-17.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed second
story addition (roofline) is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "Ir' which states:

Additions to an existing building or rebuilt residential structure which results in no net
increase in ground area coverage, except where the parcel is located in a coastal erosion
hazard area;
The parcel is not located within the Coastal Erosion Hazard Area.
The as built deck is recommended as INCONSISTENT with the below listed LWRP policies.
Policy 4.1 "Minimize losses of human life and structures from flooding and erosion
hazards." The following management measures to minimize losses of human life and
structures from flooding and erosion hazards are recommended: specifically

flooding and erosion hazards,

3. Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard areas
may be warranted for:
structures which functionally require a location on the coast or in coastal
waters.
water-dependent uses which cannot avoid exposure to hazards.
sites in areas with extensive public investment, public infrastructure, or
major public facilities.
sites where relocation of an existing structure is not practical.
The "as built deck" does not meet the above criteria (a. through c). It is
recommended that the Board consider requiring that the applicant relocate
the structure landward of the Coastal Erosion Hazard Line.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

The proposed alterations and additions and "as built" deck addition, on this non-
conforming 7,013 sq. fi. lot in thc R-40 District, is not allowed pursuant to Article XXII,
section 280-116 (B), which states "All building or structures located on lots upon which a
bulkhead ...exists... shall be set back not less than 75 feet from the bulkhead."
The survey shows a setback of O feet fi-om the bulkhead for the "as built" deck addition.
In addition, pursuant to Article XXIII, Section 280-124, non-conforming lots, less than
20,000 square feet shall maintain a minimum side yard of 10 feet; the survey shows 0
feet, and both side yards shall have a total of 25 feet~ the survey shows 5 +/- feet, and a
rear yard of 35 feet~ thc survey shows 2 +/- feet to the high water mark. Total lot
coverage of 20%, survey shows lot coverage of 24% +/-.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfi'ont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
