requests a Wetland Permit to remove 151' of existing bulkhead and construct 151' of new
bulkhead in-place and provide 10' non-turf buffer landward of new bulkhead. Remove existing
10'X 30' wooden deck and construct new 10'X 30' deck in-place. Remove existing ramp and
install new 32"X 12' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by
two 8" dia. anchor pilings. Remove accumulated debris and overgrowth of vegetation from
existing marine railway. Recondition track-trolley and track bed as required. Recondition or
replace existing winch and cable assembly as required. Located: 4302 Wunneweta Rd.,
Cutchogue. SCTM#111-14-30
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this dePartment, as well as the records available to me, it is my
recommendation that:
The proposal to remove 151' of existing bulkhead and construct 151' of new bulkhead
in-place and provide 10' non-turf buffer landward of new bulkhead is CONSISTENT with
the LWRP.
2. Remove existing 10'X 30' wooden deck and construct new 10'X 30' deck in-place is an
EXEMPT action and not subject to review.
The proposed action to remove the existing ramp and install new 32"X 12' seasonal aluminum
ramp onto a 6'X 20' seasonal floatin.q dock secured by two 8" dia. anchor pilings is
INCONSISTENT with the LWRP. Applicable policy standards are provided below.

Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions
The applicant fails to prove that the action meets the following requirements § 275-11
Construction and operation standards C. 2 (c) [1] a of the Southold Town Code:
Chapter 275 defines a DOCK-- Any permanent or seasonal structure, except a building,
located or proposed to be located on lands abutting or comprised of freshwater or tidal
wetlands or connected to a bulkhead or the upland and extending over the water's surface,
designed to secure vessels and provide access from the shore to a body of water. For the
purpose of this chapter, this term shall also include the associated structures necessary to
cross wetlands and adjacent natural areas. The term "dock" includes the terms "wharves,"
"piers," "fixed docks," "docks," or "floats." [Amended 12-18-2007 by L.L. No. 23-2007]
Based upon the above definition the 10'x 30' deck is capable of securing vessels and therefore
could be considered a "dock". A second dock on the lot is not a permissible action
pursuant to:
(c) Regulations for the placement and conf'~guration of docking facilities.
[1] Residential docks. [Amended 10-11-2005 by L.L. No. 17-20.05]
[a] Only one catwalk may be permitted per residential lot. Only one mooring or
dock may be permitted per residential lot. Upon a showing of special need due to
Iow water level and hazard to property, the Trustees may permit both a mooring
and a dock for the same residential property. [Amended 12-18-2007 by L.L. No.
23-2007]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written.determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Sonthotd agency in
making a determination of consistency. *Except minor exempt actions including Building, Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the pmpm~r of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Sonthold Town).

If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an accdon cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken~

DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal
location, and minimizes adverse effects of development.
This is a waterfront piece of property that has structures that arc in disrepair. Our proposal consists of
reconstructing these structures without any expansion. These structures arc consistent with thc
surrounding properties.
Policy 2
Preserve historic resources of the Town of Southoid.
Our proposal will have no effect on the preservation of historic resources of the Town of Southold.
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
There will be no significant effect on the visual quality or scenic resources. The structures are existing
and visual impact will be unchanged.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
These are erosion control structures that are need of repair. They are existing and will have no
additional flooding or erosion effects on adjacent properties.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
Our proposal will have no effect on the protection or improvement of water quality and supply in the
Town of Southold.
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosystem.
There will be no significant effect, positive or negative, on the quality and function of the Town of
Southold's ecosystem. We will take all precautions to ensure that debris does not enter the waterway
when reconstructing the existing bulkhead and deck.
Policy 7
Protect and improve air quality in the Town of Southold.
Our proposal will have no effect on the air quality in the Town of Southold.
Policy 8
Minimize environmental degradation in the Town of Southold from solid waste and hazardous
substances and wastes.
Our proposal will not environmentally degrade the Town of Southold from solid waste and hazardous
substances and wastes.
PUBLIC COAST POLICIES
Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold.
There will be no change in the public's ability to access and use coastal waters, public lands and public
resources of the Town of Southold. All structures are existing and there will be no expansion.
WORKING COAST POLICIES
Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
Our proposal will not promote new water-dependent uses at this location. The reconstruction of these
structures will continue to enable the upland property owner and their family to access the water to
engage in water-dependent activities.
Policy 11
Promote sustainable use of living marine resources in the Town of Southold.
Our proposal will have no effect on the sustainable use of living marine resources in the Town of
Southold. The project location is a private residential piece of property surrounded by other
residential properties. Commercial shellfishing does not exist in this location.
Policy 12
Protect agricultural lands in the Town of Southold.
Our proposal will have no effect on the agricultural lands in the Town of Southold.
Policy 13
Promote appropriate use and development of energy and mineral resources.
Our proposal will have no effect on the development of energy and mineral resources.
