Proposed Wetland Permit and Coastal Erosion Management Permit for ANNA COSTAS

requests a Wetland Permit and Coastal Erosion Permit to realign the existing concrete
seawall and install 16 10" dia. batter pilings on front side and install 150 ton of rock armodng at
base of seawall consisting of 1-3 ton rocks; repair and/or replace existing concrete splash
slab as needed, in-place; remove sections of collapsing lower retaining wall and construct new
rock retainer, in-place, install 16 10" dia. support pilings in void area and fill void area with 150
cy. of 20-50 lb. core stones on filter cloth, and pour new 6" reinforced concrete splash slab, in-
place; remove existing collapsing wooden deck and walkway and construct new deck and
walkway moving new deck 8' landward and re-vegetate open area of bank to match existing;
repair and/or replace sections of existing stairway and handrails as needed, in-place. Located:

All work is proposed seaward of the Coastal Erosion Hazard line and located within the
Coastal Erosion Hazard Area.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed actions (realign the existing concrete seawall and install
16 10" dia. batter pilings on front side and install 150 ton of rock armoring at base of seawall
consisting of 1-3 ton rocks; repair and/or replace existing concrete splash slab as needed, in-
place; remove sections of collapsing lower retaining wall and construct new rock retainer, in-
place, install 16 10" dia. support pilings in void area and fill void area with 150 cy. of 20-50 lb.
core stones on filter cloth, and pour new 6" reinforced concrete splash slab, in-place; remove
existing collapsing wooden deck and walkway) are CONSISTENT with the Policy Standards
and therefore is CONSISTENT with the LWRP provided the following best management
practice is required pursuant to:
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees
or their designee. All intertidal construction and excavation requires the installation of a
Silt boom that will retain all suspended sediments within the immediate project area.
The proposal to construct new deck and movin.q new deck 8' landward is
INCONSISTENT.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Decks and platforms. No decks or platforms shall be permitted on or near bluffs.
Platforms associated with stairs may not be larger than 32 square feet. [Amended
10-11-2005 by L.L. No. 17-2005]
It is unclear if the new deck would be located 8' from the top-of-bluff line or from its
current location.
Policy 4.t "Minimize losses of human life and structures from flooding and erosion
hazards." The following management measures to minimize losses of human life and
structures from flooding and erosion hazards are recommended: specifically
A. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal hazard areas.
Locate new development which is not water-dependent as far away from coastal
hazard areas as practical.

except as specifically allowed under the relevant portions of 6
NYCRR 505.8.
avoid hazards by siting structures to maximize the distance from
Coastal Erosion Hazard Areas.
To further the above policy, it is recommended that the new deck be located landward
of the Coastal Erosion Hazard Area to the greatest extent practicable.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable withl the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal
location, and minimizes adverse effects of development.
The existing concrete splash on this property has been damaged by the recent spring storms. The
owner would like to maintain the property and provide safe access to the waterfront by repairing
and/or rebuilding the existing structures. Our proposal will not have any effect on the community
character or preservation of open space.
Policy 2
Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
All structures exist. The current conditions of these structures are unstable threatening the integrity of
the upland property. Our proposal is just an attempt of the upland property owner to ma'mtain his
property. The present conditions of these structures are not aesthetically pleasing so the visual quality
and scenic resources will be restored to when the area was stable.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. The new bulkhead will help control
further erosion of this bluff and will not increase flooding or erosion in this area.

Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact on the water quality and supply of the Town of Southold.

Protect and restore the quality and function of the Town of Southoid's ecosystem.

WORKING COAST POLICIES

dependent uses in suitable locations.
Our proposal is to rcconstxuct and/or repair existing structures. Thc present condition of thc bluffarca
is poor and is unsafe. This property is used by thc upland property owners to engage in water
dependent activities such as fishing and swimming. These activities will continue at this site.
Policy 11
Promote sustainable use of living mar'me resources in the Town of Southold.
Thc site conditions at this point arc poor. Thc repairs of these structures will help stabilize thc area
landward of the high water mark. Them should be no significant effects on the living marine
resources.
Policy 12
Protect agricultural lands in the Town of Southold.
This proposal has no impact on the agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
