PROPERTY LOCATION: 4170 Indian Neck Lane, Peconic, NY CTM: 1000-98-1-27.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Dec. 29, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property consists of an agricultural/farm parcel containing 77.66 acres, minus 4.l 1 acres of wetlands, with 73.51+/- remaining acres, or 3,202,008+/-square feet. The property is located in the AC Zone, and is in use as a horse farm and stable. The property is improved with a two-story frame house, several principal agricultural structures, and numerous accessory agricultural structures, all of which are identified as buildings #1-19, as shown on the site survey drawn by BBV Civil Engineers, latest revision dated Nov. 17, 2010. The agricultural structure with the proposed staff[groom's] apartment subject to this Special Exception Application is noted as building # 18 [stable] on the reference survey; and is also titled Barn "A" on the site plan as shown on Sheets A-101, A-101.1, and A-110 drawn by Fairfax & Simmons Architects PC., latest revision dated Feb. 2, 2011. BASIS OF APPLICATION: Request for Special Exception approval per Code Section 280- 13B(9) whereas the Applicant proposes farm labor housing that is a permitted use requiring a Town Zoning Board Special Exception. RELIEF REQUESTED: The applicant proposes to construct a two-bedroom apartment in an agricultural structure (second floor of an existing horse barn) for the purpose of providing living space for an employee (groom) of4170 Indian Neck Lane Holdings, and related family members. The Applicant's file contains a copy of a Memorandum from the Town Planning Board Office, dated Dec. 13, 2010, a copy of a Building Permit issued by the Town Building Dept., dated June 26, 2008, and other pertinent documentation provided by the Applicant. The Town code recognizes a horse farm as a bona fide agricultural operation. At the Feb 3,2011 public hearing the agent for the applicant submitted an amended set of architectural plans for the proposed second floor apartment to address the Zoning Board's concerns for the number of proposed occupants, fire safety, and emergency egress. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 6, 2011, and February 3,2011 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board bas reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The applicant owns a 77.7 acre parcel with a residence and agricultural structures/barns which are not easily seen from the street. Only one apartment unit of farm labor housing is being proposed in conjunction with the agricultural operation. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. The occupant of the proposed farm labor housing shall be limited to a full time employee of the agricultural operation. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The proposed farm employee apartment is residential in character, as are other properties in the neighborhood, and shall be located within an existing agricultural structure suitable to the AC zoning. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. The proposed second floor apartment includes 90 minute fire rated doors, two hour fire rated perimeter walls, and two exterior balconies each with a pull down ladder for emergency egress. As discussed, it seems best ifl could update you on the development of drawings over the past ten months and meetings that we have had with officials for the Town of Southold. Belvedere Property Management secured thc services of Blackburn Architects, PC to do preliminary studies for a horse stables on 6/21/06. John Blackburn and his associate, Dan Blair, traveled to the property on Oregon Road, 7/18/06 to meet with Felipe Garcia, Belvedere horse manager and me. We discussed with Blackburn, our intention to develop a year round horse stable for the private use of our horses for stabling and turn-out in paddock areas. This stable will offer a critical balance to the private polo operation that is currently in place in the Town of Southampton. This stable will be used primarily for wintering of the horses, though some use for stabling will occur on a year round basis. Blackburn Architects, PC met with us twice during the summer and developed several studies for consideration. The first published conceptual drawings were 7/26/06. On 7/31/06, Dave Emilita and I met with Damon Rallis - Town of Southold Building inspector and shared with him these conceptual drawings and volumetric studies for the proposed stable. At that time, we discussed with Damon the use of this property as a private stable and asked him how best to move the project along. Damon confirmed that he needed to review the concept, but that as a private stable this should be seen as an accessory building to the residence and thus an ordinary building permit should be required without Planning Board approval. The residence on the property had been recently renovated and a Certificate of Occupancy issued. Throughout August, we continued to proceed with the development of plans with a revised set issued 8/17/06. Dave Emilita met with Pat Conklin 8/24/06 to review the current set of drawings and the status of our project, other master planning concepts that we were considering, and generally to re-confirm that our proposal of this horse 125 [Avcnuc oftl~e Amcricas~ 17® floor New York, NY 10020 stable as an accessory building to the main residence seemed a viable direction. That direction was reconfirmed at that meeting. Throughout the autumn, the drawings proceeded from conceptual to Schematic Design, and then to full Design Development drawings in which plans, sections and elevations were detailed. This process culminated in Pricing Set issued 10/17/06. We forwarded this set to Bill Kelly of Morton Builders, Inc. to provide pricing and a building schedule. Bill Kelly returned 11/10/06 with cost and schedule; we spent the remainder of the month analyzing his assumptions. We made a decision in early December to move forward with the project. I consulted Dave Emilita and Bill Kelly and we decided the best option would be to have the architects proceed with a Permit Set and submit our application to the Building Department anticipating start of construction in March 07 with completion of the project in November, 07. We discussed this strategy with Blackburn Architects, PC and they began the process of securing the services of a structural engineer. Unfortunately, the firm they typically used was not available, and so we spent the remainder of the month attempting to find another structural engineer. With the holidays approaching, we were further delayed and it was not until January 12, 2007 that we contracted with Robert Silman Associates to provide the structural engineering for the project. Throughout January 07, we were operating under the assumption that the horse stables would be seen as an accessory to the main residence and that the application ~vould be viewed a simple building pernfit. On January 14, 2007, Bill Kelly called to inform me that the Town of Southold had passed a resolution to alter the status of accessory buildings. Although our drawings lacked full structural engineering, we took the position that it would be best to submit our current amhitectural set and progress structural drawings with our application, before the new regulation was instituted. We submitted these drawings to the Town of Southold February 15, 2007. We easily lost six weeks in our search for a structural engineer. In retrospect, we would have accelerated our efforts if we had known that the proposed legislation was pending. Belvedere Property Management, acting as the agent for the owner of this property, other properties along Oregon Road and Robins Island, has worked closely with the Town of Southold on many issues over the past twelve years. We remain committed to the north fork and feel this horse stable proposal goes a long way in our continued effort to support both open space, agricultural and a farming lifestyle. As previously stated, the purpose of this horse stable is exclusively for private purposes. There is no intention to have any commercial activity on the property, no boarding of other horses and the use will be exclusive to the property owner. We intend to stable and paddock horses on the property in support of a private polo farm we operate in the Town of Southampton. In addition to this 54 acre parcel, Belvedere operates 127 acres of farm land that is east of this parcel - 102 acres of which, is restricted from development I hope the foregoing makes sense and gives you a better picture of all that has transpired over the past ten months. During the time we developed both conceptual and schematic plans, we felt we made considerable efforts to keep the Town of Southold aware of what we were considering and partnering with us as to the best means of achieving a permit.
