THIS INDENTURE, made the 17t~ day of February, Two Thousand Eleven
BETWEEN
FLORENCE A. EVANS, as surviving tenant by the entirety, residing at 67 West Neck Road,
Shelter Island, New York 11964
party of the first part, and
EDWARD L. COAKLEY and CAROL COAKLEY, husband and wife, residing at 622
Lighthouse Road, Southold, New York 11971
party of the second part,
WITNESSETH, that the parry of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the s~ond part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot /~24 as shown on a certain map entitled "Map of Harbor
Lights Estates, Section One, Bayview, Town of Southold, Suffolk County, N.Y." made by Otto
W. Van Tuyl & Son, Licensed Land Surveyors, Greenport, N.Y., and filed in the Office of' the
Clerk of the County of Suffolk on June 8, 1965 as Map #4362.
Together with an easement over the streets as shown on the filed map herein.
Together with the use, in common with others, of the beach area and parking area adjacem
thereto; said beach area having a depth of approximately 50 feet from the average high water
mark on Peeonic Bay, and having a length of 900 feet more or less measured along the ordinary
high water mark, and said parking area having a frontage on the northerly side of Harbor Lights
Drive of approximately 150 feet, running westerly along said street from Lot #7, and having a
depth of not less than 150 feet northerly of Harbor Lights Drive. The parking area shall be
immediately adjacent and contiguous to the beach area herein referred to.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 7/24/! 979 and recorded 7/26/1979, in the Office of the Suffolk County Clerk in Liber
8665, Page 287.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein grantexl unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffer~
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold th~ right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the imlarovemen'c and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any othm' purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
