Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
July 23, 2008, and in consideration of application fee in the sum of $250,00 paid by Vincent & Laura Manetti
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees

Based on the informetioh you have submitted, the Department of Environmental Conservation
(DEC) has determined that the property landward of the pre-existing {prior to 8/20/77) bulkhead,
which is more than 100 feet in length, as shown on the survey prepared by Nathan TaR Corwin

The proposed additions and alterations to this existing single family dwelling, on a non-
conforming 15,527 square foot lot in the Residential R-40 District is not permitted
pursuant to Article XXIII Section 280-122, which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction
or enlargement of a non-conforming building containing a conforming use,
provided that such action does not create any new non-conformance or increase
the degree of non-conformance with regard to the regulations pertaining to such
buildings."
The proposed additions note a single side yard setback of 9.7 feet and a total side yard
setback of 20.10 feet. Pursuant to the ZBA's interpretation in Walz {#5039), such
additions and alterations will thus constitute an increase in the degree of non-
conformance.
Additionally, pursuant to Article XXII Section 280-116 (B), which states;
All buildings or structures located on lots upon which a bulkhead, concrete wall,
riprap or similar structure exists and which are adjacent to tidal water bodies other
than sounds shall be set back not less than 75 feet from the bulkhead.
Proposed alterations show a setback from the bulkhead of 47 +/- feet.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type I1 category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODF: This application was referred as required under the Suffolk County
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating
that this application is considered a matter for local determination as there appears to be no significant county-wide
or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 15,527 square foot lot in the
' Residential R-40 Distdct with a 70.55 ft. frontage along West Shore Drive, 63.28 ft. along Peconic (Southold) Bay,
269.7 ft. on the easterly,~property boundary, and 227.12 ft on the westedy property boundary, it is improved with a
single family dwelling ada attached seaward deck.
BASIS OF APPLICATION: Requests for Variances under Sections 280-116-B and 280-122, based on the Building
Inspector's November 19, 2008 Notice of Disapproval concerning proposed additions and alterations to the existing
single-family dwelling. 'The reasons stated for disapproving the building permit application are that the new
construction will constituJe an increase in the degree of nonconformance on a single side yard, on total (both) side
yard setbacks, and at ess than 75 feet from the bulkhead.
LWRP DETERMINATI(~N: A Letter dated May 12, 2009 from Mark Terry, LWRP Coordinator, confirming
inconsistency was subm'ltted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town
of Southold Code and L6cal Waterfront Revitalization Program (LWRP) standards. A letter dated May 20, 2009 from
Nicole Spinelli, Distdct ~echnician, of Suffolk County Soil and Water noted that upon site inspection on May 19,
2009, there were no observed natural resources concerns with regard to the construction of additions to the
residence. The existin~.b uff is stable and well vegetated. Potential adverse environmental impacts by granting the
relief requested will be ~itigated by the applicant's proposed removal of the existing non-conforming sanitary system
located JeSs than 100 ft from the bulkhead and replacement with an upgraded sanitary system located more than 100
fl from the bulkhead; addition of new gutters and leaders and drywells to capture and recharge roof runoff; and
establishment of a six-fopt wide non-turf buffer at the top of the slope leading to Southold Bay.

required, and maintain the existing non-conforming setback from the bulkhead of +/- 47 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Town Law ,~267-b(3/!b)(3/(l/. Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Proposed additions and alterations will all take place within
the existing structural f~)otpdnt with no further encroachment on the pre-existing non-conforming setbacks. The
renovations will improve the appearance of the dwelling and correct substandard construction. The proposed
architectural design is in:keeping with other homes in the neighborhood.
2. Town Law §267-b(3i(:b)(2/. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue; other than area variances because the existing dwelling haS pre-existing non-conforming
setbacks. Therefore, an~ new construction or replacement of existing structures will require variances.
3. Town Law §267-b(3iib)(3). The variances granted herein are not substantial in so far as no increase in the pre-
existing nonconforming setbacks is being proposed. The setback relief of 47.8 ft. from the bulkhead represents 28
feet or 37% from the req:.uired 75 ft. and is mathematically substantial; the relief for the single side yard setback of 8.8
ft where 10 feet is the minimum required, is 1.2 feet or 12%, which is not substantial; the relief for a total side yard
setback of 20.1 ft wherE'5 feet is required represents 4.9 ft. or 19.6 %, and is substantial.
4. Town Law ~267-b(~fb/15). The difficulty has not been self-created, but is the result of previous substandard
construction that caused?tructural deterioration and leaking, and pre-existing non-conforming setbacks.
5. Town Law §267-b(~(b)(). No evidence has been submitted to suggest that a variance in this residential
community will have ad adverse impact on the physical or environmental conditions in the neighborhood. The
existing bluff is stable arid well vegetated. Potential adverse environmental impacts by granting the relief requested
will be mitigated by the tapplicant's proposed removal of the existing non.conforming sanitary system located less
than 100 feet from the bulkhead and replacing it with an upgraded sanitary system located more than 100 feet from
the bulkhead and wetlands; adding gutters and leaders and drywells to capture and recharge roof runoff and
,~maNishing a 6 ft w de non-turf buffer at the top of the slope leading to Southold Bay. All construction will be within

6. Town Law §267-b. iGrant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of additions and alterations to their existing dwelling, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.

GRANT the variance as applied for, and shown on the January 27, 2009 survey by Nathan Taft Corwin III, Land
Surveyor, and the 1-29-09 drawings prepared by Meryl R. Kramer, Architect and labeled first floor plan, second
floor plan, south elevation, east elevation, north elevation, and west elevation, subject to the following conditions:
1. Removal of the existing non-conforming sanitary system that is currently located less than 100 feet from the
bulkhead, and replacement with an upgraded sanitary system located more than 100 ft from the bulkhead and
wetlands;
2. Incorporate a drainage system of gutters and leaders and drywells to capture and recharge roof runoff (as

zoning code. This action does not authorize or condone any current or future use, setback or other feature of the
subject properly that ~y violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves thecght to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

Foundation Notes:
The contractor is to verify all measurements in the field and any discrepancies ara to be
brought to the attention of the Engineer pdor to constru~on.
1 - All concrato 3.500 psi alter 28 days minimum.
2 - Ail rabar ASTM A-615 Grade 60,
3 - Footings are to be installed on undisturbed virgin soil. The bottoms of all footings am
to be installed a minimum of 3' betow grade unless indidmd otherwise.
4 - Rebar installed along the top of the foundation walls without windowa ara to be installed
10" below the top of the foundation wall. Rebar installed along the top of foundation wails
with windows ara to be installed 3" below the boffom of the window opening.
5 - All snap off form flea ara to be removed and remaining openings are to be
sealed/grouted.
6 - The foundation contractor shall coordinate with the plumbing and elect~cal contractors
relative to installation of sleeves and other penetraflons pdor to poudng concrete.
7 - The Engineer is to be contacted If unacoeptable or questionable soil is encountered
dudng excavation. Unacceptable sol1 Is soil containing clay and/or organic matehel,
8 - Install isolation joints along foundation walls and at column and other floor penetrations.
9 - Installed contraction joints in the cellar floor slab every t 8' mlnimum.
10 - Foundation excavation is not to be back filled prior to the installation of the floor
framing.
11 - Bac~ll along foundation walls is to be clean matadal and is to be mechanically
compacted in 6" lifts to 95% of maximum dry density.
12 - Underpin existing foundation. Connect existing footing to new footings and wall tops
with No.5 rabar dowels.
Suggested Undeq)innlng Procedures:
a) Underpin prior to addition of any new loads on wall.
b) Excavate small exploratory pit at exterior wall to determine depth and width of existing
footing. Infolm Architect/Engineer of findings before proceeding.
c) Upon receiving approvst, excavate to the top of the existing footing for the entire length
of the area to be underplnned on both sides of the foundation wall. Remove intedor
concrete floor as necessary.
d) Excavate by hand below the existing footing at no more than 3 foot lengths, e) Install a
key way between sections. Allow 7 days coring.
f) Back fill and replaca Intoner floor as necessary.
g) During the underpinning procadura, monitor Ihs existing foundaflon wall for excessive
movement and/or cracks. Notify the AmhitedJEngidser if movemenl and/or cracks are
noted.
13 - Dowel to existing foundation wall with No. 5 rebar. Grout solid all cavities in existing
wall for three feet from new wall.
