It grows to a height of 60 feet or 70 feet with a 25 to 45 foot spread27. The concept behind the conservation benefit to be derived from this planting is that the trees will fome the short-eared owls to gain elevation to fly up and over rather than low and through the roadway, in this case, River Road. Short-eared owls have roosted almost exclusively in evergreens in the Coxsackie area. The pin oak is a deciduous tree and so, is unlikely to be attractive as a roost. The short-eared owls in the area have rested/pemhed on open, top rails of fences or in the open tops of dead or dying trees. The tips of the pin oak's branches are weak and densely packed and so, is unlikely to be attractive as a rest/perch. Finally, the pin oak retains its lower branches as it grows. These will form a dense matrix almost all the way to the ground (See Figure 7). The row of trees, with their low, interlocking branched, will force the short-eared owls to gain elevation to fly up and over rather than low and through the roadway. At 8 feet tall, they will be high enough to force the owls up and over any car or SUV traffic on River Road. Once the trees are 12 or more feet tall (three to four years from planting), they will be high enough to force the owls up and over any truck traffic on River Road. 3.5.3 Species Management - Net Effects The above features for the proposed Habitat Conservation and Management Plan (HCMP) will preserve, create, enhance and manage sufficient habitat to off set the project's impacts to both the short-eared owl and northem harrier habitats on-site. The preservation and creation of field habitat on site will total some 30.8 acres of land as open space and in or next to "blocks" where they will continue to function as part of a larger grass land system28. The site totals 106.3 acres. However, 16.5 acres is in woodland, shrub/scrub or a developed condition, which is not suitable for grassland species. This leaves 89.8 acres of grasslands. The 30.8 acres of lands to be preserved and or create as grasslands represents some 30 percent of the site. The conservation ratio (the grassland acreage preserved divided by the grassland acreage impacted), on an acreage basis is 0.40 to 1.0. The FEIS states: The entire Project area has the potential to be considered critical habitat by the Planning Board which may require the preparation ora Habitat Preservation Report. This would include a plan that will seek to provide habitat protection of a 1:1 ratio, with one acre of protected habitat provided for every one acre of habitat impacted by development, in accordance with the Natural Resource Standards. The Applicant would satisfy the 30% open space requirement applicable to all PDD's through the preservation of on-site habitat. Presumably, the preservation of this habitat would also satisfy the criteria of the DEC "takings" permit if it sufficiently demonstrates a net conservation benefit to the protected species.
