Re: Permit for Kane, 3100 Sound Drive, Greenport
I am writing to get a better explanation as to what I can do regarding the permit I was issued. To refresh
your memory, we installed a Iow wooden retaining wall at the edge of our bluff to prevent erosion. The
permit was denied and was amended to have us remove the wall and add plantings. We have until June
I to accomplish this. I had asked for a longer extension since we don't take up residence until memorial
Day, since this is our summer home. We will need to plant rosa ragosa bushes to take the place of the
retaining wall. If we take the wood out and there is a rain storm, our backyard will wash down the cliff
causing major erosion. My question is since we cant keep up the wood retaining wall, can I at least be
allowed to place rocks at the edge to hold up the lawn area until the rosa ragosa bushes take root? I
would like to place a series of rocks along the entire length of the existing wood wall now {62'). The
rocks would be no bigger than what I can carry, which are already strewn about our property randomly.
I would guestimate the rocks to be between 12" and 18" each and I would line them up in a single file
and then another set of rocks on top of that row to hold the dirt in place until the bushes grow. Once
the bushes grow, I could remove the rocks.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of

TERMS AND CONDITIONS
The Permittee, Carol Kane, residing at 3100 Sotmd Dr., Greenport, NY as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released fxom any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this perm/t, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid until March 1, 2011, which is considered to be the estimated time
required to complete the work involved.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Kane:
The Board of Town Trustees took the following action during its regular meeting held on Wed.,
January 19, 2011 regarding the above matter:
WHEREAS, CAROL KANE applied to the Seuthold Town Board of Trustees for permits under
the provisions of Chapter 275 of the Southold Town Code the Wetland Ordinance, and Chapter
111 Coastal Erosion Management, applications dated December 16, 2010, and,
WHEREAS, said applications were referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed applications be found
Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6 and 6.3 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the following
Best Management Practica requirements: the removal of the retaining wall and re-vegetation of
the disturbed area with native vegetation, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said applications
on January 19, 2011 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning these applications, and,
WHEREAS, the structure complies with the standards set fodh in Chapter 275 of the Southold
Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirements imposed above, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code,
and,
RESOLVED, that the Board of Trustees approves the applications of CAROL KANE to remove
a 2'X 62' long retaining wall along the edge of the bluff and re-vegetate the disturbed area with
native vegetation, as depicted on the survey prepared by John T. Metzger last dated December
28, 2010.
Permit to complete project will expire on March 1,2011.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

I just received my permit in the mail and was very concerned to see a March 1, 2011 expiration date. I
respectfully request an extension. This home is our summer home and we don't open up until Memorial
Day. There is no way we can complete this work that quickly. The ground right now is frozen, with snow
covering the area, and will soon give way to a mushy muddy lawn. We are planning to plant Rosa Rigosa
bushes end of May/early June and they need time to root themselves into the ground. This is very
important to do before we take the wall out so as not to cause further erosion from our bluff. We would
want at least a year for the bushes to take hold before removing the wall so can you please grant me an
extension of Sept 1, 20127 Thank you so much for your consideration in this matter.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the
LWRP:
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for afl Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
The structures were constructed without a permit pursuant to Chapter 275 Wetlands and Shorelines of
the Southold Town Code.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
