THIS INDENTURE, made the 26t~ day of January, Two Thousand Eleven
BETWEEN
VINCENT M. CLAPS, residing at 450 Snug Harbor Road, Grecnport, New York 11944
party of the first part, and
DAVID L. FISHER, residing at 1500 Brecknock Road, Apt. 318, Greenport, New York 11944
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or pared of land, with thc buildings and improvements thereon
erected, situate, lying and being in the Hamlet of Orient, Town of Southold, County of Suffolk,
and State of New York, known as Lot #2 on a certain map entitled, "Minor Subdivision for Linda
Gonsritz and Judith Barnett at Orient, NY" dated December 30, 1971 and amended March 13,
t972 and May 10, 1972 by Van Tuyl & Son, Greenport, New York, said lot being bounded and
described as follows:
BEGINNING at a point at the southeast comer thereof, which point is distant North 41 degrees
31 minutes 00 seconds West, 215.0 feet from a point which is distant North 41 degrees 20
minutes 20 seconds West, 192.8 feet as measured along the northerly line of land now or
formerly of D. Moore from the point where said northerly line of D. Moore intersects the
westerly side of Main (State) Road;
RUNNING THENCE from said point or place of beginning along the northerly line of land now
or formerly of Boyle, North 41 degrees 31 minutes 00 seconds West, 240 feet to the easterly side
of Lot 3 on said map;
THENCE North 48 degrees 29 minutes 00 seconds East along the easterly side of Lot 3, 444,74
feet to land now or formerly of Darling & Menking;
THENCE along last mentioned land and land now or formerly of Bloom, South 39 degrees 34
minutes l0 seconds East, 240.14 feet to the westerly side of Lot I on said map;
THENCE along thc westerly side of Lot 1, South 48 degrees 29 minutes 00 seconds West,
436.58 feet to the point or place of BEGINNING.
TOGETHER with a 16 ½ foot right-of-way from the westerly side of Main (State) Road to the
easterly side of Lot 1 on said map.
TOGETHER with and subject to a 25 foot right-of-way running from the e~asterly side of said Lot
I on said map where the aforementioned 16 7: foot fight-of-way terminates to and over the
within described premises.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated September 14, 2006, and recorded September 15, 2006, in the Office of the Suffolk
County Clerk in Libex 12469, Page 645.
TOOETHER with all right, title and inter~st, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and fights of the party of the flint part in and to said
promises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or su~essors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the p~ of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
