NORTH SHORE YACHT (Main Road - Mattituck)
Moved by Theodore Carpluk and seconded by Howard Meinke, it was
RESOLVED to APPROVE the plans with the CONDITIONS that the roof pitch
over the enclosed area be 5 x12, over the open area be 2 x 12, that the vinyl
siding on the south elevation match the existing color and that the metal on the
other three sides approximate the vinyl, that the roof color approximate the color of
the existing asphalt roof, that the fascia be white and that revised plans be
submitted in duplicate to reflect these changes.

RIVERHEAD BUILDING SUPPLY (Main Road ~ Greenport)
Moved by Garrett Strang and seconded by Robert Brown, it was
RESOLVED to TABLE the application awaiting roof and siding colors, details of
store front entry, a drawing of the east elevation, catalogue cuts of exterior lighting
fixtures (building-mounted as well as free standing), signage, details of the
rolldown gate at the check out and locations of the mechanicals and roof
penetrations.
It is suggested that the roof pitches on both storage buildings be 2 x 12 and
that casings, and perhaps grill work, be used with the windows on the west and
north elevations.

This letter is further to our letter to you of July 18, 2001, copy enclosed.
The following additions/changes must be made before the Board can proceed with its
review:
1. Pave access road and both parking areas.
Place transition buffer at southwest side of property adjacent to the Low
Density Residential (R-40) Zone. The plantings should be placed from the
gate south to the twenty-five foot front yard landscaped area. The Board
recommends Pampas Grass for the buffer screening.
3. Revised elevation drawings as discussed with your agent, Warren Sambach, at
the Architectural Review Committee Meeting of October 11,2001.
In addition to the above, review is required by the Suffolk County Department of Health
Services and the New York State Department of Transportation.
Please be advised that no possible final approval can be granted before the boats are
removed from the twenty five foot front yard landscaped area and any boats stored in the
rear Residential area.

The following additions/changes must be made before the Board can proceed with its

1. Parking calculations must be corrected The combined existing and proposed
requirements for parking are fifteen (15) spaces.
2. The boat display & storage area appears to show Parking spaces, the two
southern spaces do not have the required twenty two (22) feet of back up
space. Is this area for parking or for boat storage?
3. One of the ZBA conditions was a fence around the entire property. This fence
is not shown around the entire property.
4. Parking area should be paved.
Your elevation drawings will be reviewed by the Architectural Review Committee.

Dear Mr. Orlowski:
As per your request, I have reviewed the revised plans for the above referenced
project. The plans submitted for this project have been prepared by Warren A. Sambach,
Consulting Engineers, and had a revision date of July 5, 2001.
This revised plan has addressed the issues that were listed in my previous report
dated 4/20/01, regarding the drainage calculations. A test hole has been included with the
revisions to the plan indicating suitable soil conditions that will enable the proposed drainage
systems to function properly. The drainage calculations have also been modified to include
all of the proposed development within the scope of work for this project.
The proposed drainage design for the above referenced project, as revised, meets
the minimum requirements of the Town Code. If you have any questions concerning this
report, please contact my office.

As per your request, I have reviewed the site pi'an for the above referenced project.
The drainage calculations provided appear to be incomplete. There is a new 15' x 30' shed
roof attached to the proposed building that was not included in the calculations. It is also
difficult to verify the extent of all new construction. All new stone blend parking areas should
be included into the drainage calculations using a run-off coefficient of 0.6. Alt new roof and
asphalt areas will have a run-off coefficient of one. The run-off generated by any proposed
new construction should be included in the design. Any and all existing drainage structures
that are to be used to contain additional run-off generated by the proposed construction will
need to be detailed and shown on the plan.
A test hole should also be provided to ensure soil permeability and drainage
]}~, capabilities of the systems proposed. Please have the applicant revise the drainage
calculations accordingly.

The Planning Board has received your revised site plan dated February 15, 2001.
The following changes/additions must be made before the Board can proceed with its
review:
1. Drainage calculations and dry wells for proposed building.
2. Side yard setback for proposed boat display and sales building must be
twenty-five feet (25').
3. Show all trees over six inches in caliper.
4. Show type of landscaping in front yard areas. Boats presently stored in this
area must be removed.
Show twenty-five foot transition buffer between the business zone and the
residential zone. This buffer must be planted with a double row of six foot
evergreens staggered ten foot on center.
6. Elevation drawings and floor plans.
7. Name of adjoining landowners.
8. Show any outdoor signs.
Handicapped parking must be shown. This space must be paved, marked with
the handicapped logo, and a sign placed at the top of the space. A paved walk
leading to the handicapped entrance to the buildings must be provided.
10. Place bumper stops at parking spaces.
13. Entrance and parking area must be paved, show drainage.
14. Boats must be removed from the residential portion of the property.
In addition to the above, the Zoning Board attached the following conditions to your
Special Exception:
A fence (for security purposes) shall be maintained in good condition
surronding the entire parcel, except for the portion lying south of the frame
building that is to be used as a showroom and office space. A locked gate shall
be placed for emergency purposes. Please show this fence on the proposed site
plan.
A fence or other low barrier shall be constricted along the westerly side of the
property, running southward from the existing 6-foot fence, to prevent
vehicles from exiting from the neighboring property. (See ZBA Special
Exception for other conditions). Please show both the existing fence and the
requested barrier/fence on the proposed site plan.
A review by the Suffolk County Department of Health Services and the New York State
Department of Transportation will be required.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicant is the owner of property located at the
north side of Main Road in Mattituck, which has been used and occupied by the Bergen Oil
Company. The property is located approximately 800 feet deep from the Main Road to
the Long Island Railroad, and the southerly half is zoned B Business while the northerly
half is zoned R-40 Residential.
Applicant has submitted a survey map prepared by Young & Young, Surveyors May 31,
1988 for Dale Bergen, a prior owner. The 1988 survey shows the layout of the property
with dimensions and setbacks of the buildings. The principal building consists of
approximately 1104 sq. ft., and is situated 59.5 feet from the front line, 6.9 feet from the
east side line, 42.1 feet from the west side line. The 1988 survey shows three oil storage
tanks and a second building, all of which have been removed, according to applicant's
testimony. Applicant submitted a sketch of a map with driveway and parking areas,
entrances and exits, fencing and similar details related to this Special Exception use.
For record purposes, it is noted that the following Town determinations were issued
regarding this property: (a) Certificate of Occupancy No. Z-1157 issued September 20,
1961 to Robert L· Bergen for a business building, referring to Building Permit No. Z1447
dated June 15, 1961; (b) Certificate of Occupancy No. Z-5900 issued May 9, 1974 to
Robert L. Bergen for a business building (repair shop) with addition, referring to Building
Permit No. 6973Z dated November 7, 1974; (c) ZBA approval rendered ,luly 13, 1961
which extended the 'B' Business District boundary line 50 feet west, and specified a
permanent westerly side yard of 14 feet and permanent rear yard of 14 feet.
APPLICANT'S REQUEST: Applicant requests a Special Exception to establish a business use
consisting of the display, storage, sale and service of boats on the portion of property
zoned B-Business. Code Section 100-101B(12) authorizes boat sales, with accessory repair
facilities, in the B Zone provided a special Exception is issued by the Board of Appeals.
Article XXVI of the Zoning Code sets forth the requirements for issuance of a Special
Exception.

REASONS FOR BOARD ACTION AND OTHER CONSIDERATIONS:
(1) After headng testimony and making personal inspection of the property, the
Board has considered the General Standards set forth in Code Section 100-263,
and finds and determines the following:
(A) The proposed use will not prevent the orderly and reasonable use of
adjacent properties or of properties in the adjacent use district(s) (residential).
(B) provided that the conditions set forth below are satisfied, the proposed
use will
not prevent the orderly and reasonable use of permitted or legally established uses
in the Business Distdct wherein it is proposed to be located, or of permitted or
legally established uses in the adjacent residential use district.
(C) The safety, health, welfare, comfort, convenience and order of the Town
will not
be adversely affected by the proposed use and its location;
(D) The proposed use will be in harmony with, and promote the general
purposes and intent of the Zoning Code.
(E)
The proposed use will be compatible with its surroundings and with the
character of the neighborhood and of the community in general,
particularly with regard to visibility, scale and overall appearance.
(F) The structures, equipment and material will be readily accessible for fire
and police protection.
(2) The Board has considered the other matters relating to Special Exceptions set
forth in Code Section 100-264, and finds that no adverse consequences will
result from the proposed use.
RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it
was
RESOLVED, to GRANT the application as applied for, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. A fence (for security and safety purposes) shall be maintained in good condition
surrounding the entire parcel, except for the portion lying south of the frame
building that is to be used as a showroom and office space. A locked gate shall
be placed for emergency purposes
2. A fence or other Iow barrier shall be constructed along the westerly side of the

easterly portion of the property (to keep noise levels down).
5. As required by Section 100-101B(12) of the Zoning Code:
A. Entrance and exit driveways shall be arranged so as to avoid necessity of
any vehicle backing out onto the Main Road.
B. Dismantled boats, and parts and supplies, shall be located within a
building.
Any storage of gasoline or flammable oils in bulk shall be fully
underground and at least 35 feet from any property line other than the
street line.

Company. The property is located approximately 800 feet deep from the Main Road to
the Long Island Railroad, and the southerly half is zoned B Business while the northerly
half is zoned R-40 Residential.
Applicant has submitted a survey map prepared by Young & Young, Surveyors May 31,
1988 for Dale Bergen, a prior owner. The 1988 survey shows the layout of the property
with dimensions and setbacks of the buildings. The principal building consists of
approximately 1104 sq. ft., and is situated 59.5 feet from the front line, 6.9 feet from the
east side line, 42.1 feet from the west side line. The 1988 survey shows three oil storage
tanks and a second building, all of which have been removed, according to applicant's
testimony. Applicant submitted a sketch of a map with driveway and parking areas,
entrances and exits, fencing and similar details related to this Special Exception use.
For record purposes, it is noted that the following Town determinations were issued
regarding this property: (a) Certificate of Occupancy No. Z-1157 issued September 20,
1961 to Robert L. Bergen for a business building, referring to Building Permit No. Z1447
dated June 15, 1961; (b) Certificate of Occupancy No. Z-5900 issued May 9, 1974 to
Robert L Bergen for a business building (repair shop) with addition, referring to Building
Permit No. 6973Z dated November 7, 1974; (c) ZBA approval rendered July 13, 1961
which extended the 'B' Business District boundary line 50 feet west, and specified a
permanent westerly side yard of 14 feet and permanent rear yard of 14 feet.
APPLICANT'S REQUEST: Applicant requests a Special Exception to establish a business use
consisting of the display, storage, sale and service of boats on the portion of property
zoned B-Business. Code Section 100-:I.01B(12) authorizes boat sales, with accessory repair
facilities, in the B Zone provided a special Exception is issued by the Board of Appeals.
Article XXVI of the Zoning Code sets forth the requirements for issuance of a Special
Exception.

REASONS FOR BOARD ACTION AND OTHER CONSIDERATIONS:
After hearing testimony and making personal inspection of the property, the
Board has considered the General Standards set forth in Code Section 100-263,
and finds and determines the following:
(A) The proposed use will not prevent the orderly and reasonable use of
adjacent properties or of properties in the adjacent use district(s) (residential).
(B) provided that the conditions set forth below are satisfied, the proposed
use will
not prevent the orderly and reasonable use of permitted or legally established uses
in the Business District wherein it is proposed to be located, or of permitted or
legally established uses in the adjacent residential use district.
(C) The safety, health, welfare, comfort, convenience and order of the Town
will not
be adversely affected by the proposed use and its location;
(D) The proposed use will be in harmony with, and promote the generai
purposes and intent of the Zoning Code.
(E) The proposed use will be compatible with its surroundings and with the
character of the neighborhood and of the community in general,
particularly with regard to visibility, scale and overall appearance.
(F) The structures, equipment and material will be readily accessible for fire
and police protection.
(2) The Board has considered the other matters relating to Special Exceptions set
forth in Code Section J, 00-264, and finds that no adverse consequences will
result from the proposed use.
RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it
was
RESOLVED, to GRANT the application as applied for, SUBJECT TO THE FOLLOWING
CONDIq'IONS:
Security fencing around the entire parcel, commencing at the rear of the
principal building and not extending further than 50 feet past the B-Business
Zoning; all fencing shall be maintained in good condition at all times for security
and safety reasons. A locked gate shall be placed for emergency purposes
2. A fence or other Iow barrier shall be constructed along the westerly side of the

property, running southward from the existing 6-foot fence, to prevent vehicles
from exiting over the neighboring property.
3. To the greatest extent possible, larger boats shall be stored and displayed on the
easterly portion of the property.
4. To the greatest extent possible, service work on boats shall be conducted on the
easterly portion of the property (to keep noise levels down).
5. As required by Section 100-101B(12) of the Zoning Code:
A. Entrance and exit driveways shall be arranged so as to avoid necessity of
any vehicle backing out onto the Main Road.
B. Dismantled boats, and parts and supplies, shall be located within a
building.
C. Any storage of gasoline or flammable oils in bulk shall be fully
underground and at least 35 feet from any property line other than the
street line.

Purpose: The full £^F is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal know[edge of the environment or may net be technically expert in environmental
analysis. In addition, many who have know[edge in one particular area may not be aware of the broader concerns affectin§
