Dear Ms. Steelman:
The Southold Town Planning Board adopted the following resolution at a meeting held
on Monday, March 14, 2011'
WHEREAS, this site plan is to construct a 724 s.f. wine tasting room and a 782 s.f. wine
storage area by altering an existing 2,480 s.f. barn on an 87-acre parcel in the A-C
Zoning District; and
WHEREAS, on January 19, 2010, a site plan application was submitted for review by
the applicant's agent, Samuels & Steelman; and
WHEREAS, on March 23, 2010, the Southold Town Planning Board formally accepted
the application for review and distributed the application to agencies having jurisdiction
for their comments including the following: Town Engineer, Architectural Review
Committee, Cutchogue Fire Department, Suffolk County Planning Commission, Local
Waterfront Revitalization Coordinator, Southold Building Department and NYS DOT;
and
WHEREAS, the comments from those agencies were received and reviewed by the
Planning Board, discussed with the applicant, and incorporated into the site plan to the
satisfaction of the Planning Board; and
WHEREAS, on May 10, 2010, a public hearing was held and closed by the Southold
Town Planning Board regarding the site plan; and

WHEREAS, on May 17, 2010, the Southold Town Planning Board, pursuant to Southold
Town Code §280-131 C., received a reply from the Suffolk County Planning
Commission with the notation that the application was a matter for local determination,
with two comments:
1. No off-street parking should be allowed to overflow onto adjacent Suffolk County
(purchase of development rights) farmland property;
2. A fence (in accordance with the Zoning Code) or a landscaped buffer should be
located between Lot 40 and Suffolk County PDR farmland property to the south.
Both comments were considered by the Planning Board and the Development Rights
Easement Area was noted on the plan, however, a fence or landscaped buffer was not
required because both uses are agricultural and screening was not considered
necessary; and
WHEREAS, the Southold Town Planning Board, acting under the State Environmental
Quality Review Act (6 NYCRR), Part 617.5c(7), has made a determination that the
proposed action is a Type II Action and not subject to further environmental review; and
WHEREAS, on August 23, 2010, the applicant submitted the Suffolk County
Department of Health Services approval, Permit (#C10-10-0003) and a copy of the plan
approved by the SCDHS, on which one hand-written notation was made (and
subsequently noted on the site plan to be endorsed by the Planning Board); and
WHEREAS, on March 9, 2011, the applicant submitted plans approved by the NYS
DOT with their Curb Cut Permit #10-094P, and those plans were found to be in
agreement with the site plan except for one detail showing an existing curb cut to be
abandoned. This was subsequently noted on the site plan; and
WHEREAS, on March 10, 2011, the Cutchogue Fire Department reviewed the plan and
requested an emergency vehicle turn-around, pursuant to State Fire Code Appendix
D103.4, be installed as the driveway is a dead-end greater than 150' in length; and
WHEREAS, on March 11,2011, the Southold Town Building Inspector reviewed the
plan and certified that the proposed action is a permitted use in this A-C Zoning District;
and
WHEREAS, at a Work Session on March 14, 2011, the Planning Board determined that
all applicable requirements of the Site Plan Regulations Article XXIV, §280 - Site Plan
Approval of the Town of Southold have been met; therefore, be it
RESOLVED, that the Southold Town Planning Board has determined that the action is
consistent under the policies of the Town of Southold Local Waterfront Revitalization
Program; and be it further

RESOLVED, that the Southold Town Planning Board grants Approval and authorizes
the Chairman to endorse the site plan entitled "A New Winery at the McCall Farm",
prepared by Nancy Steelman, R.A., dated January 15, 2010 and last revised March 11,
2011, including the following pages:

Please also note the following requirements in the Southold Town Code relating to site
plans:
1. Any outdoor lighting shall be shielded so the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries, and to shield the light from the sky.
2. All storm water run-off from grading, driveways and gravel areas must be
contained on site.
3. Approved site plans are valid for three years from the date of approval, within
which time all proposed work must be completed, unless the Planning Board
grants an extension.
4. Any changes from the approved site plan shall require Planning Board approval.
5. Prior to the issuance of a Certificate of Occupancy, the Planning Board or its
representative, must inspect the site to ensure it is in conformity with the
approved site plan and issue a final site inspection approval letter. Should the
site be found not in conformance with the approved site plan, no Certificate of
Occupancy may be issued unless the Planning Board approves the changes to
the plan.
A copy of the approved site plan is enclosed for your records. One copy will also be
sent to the Building Department and the Town Engineer/Highway Department.

Wine Tasting Room, 22600 Main Road in Cutchogue. (Building Permit #36341.) Please come check the new handicap

FIRE APPARATUS ACCESS ROADS
This appendix is enforceable.
SECTION D101
GENERAL
D101.1 Scope. Fire apparatus access roads shall be in accor-
dance with this appendix and all other applicable require-
ments of the Fire Code of New York State.
SECTION D102
REQUIRED ACCESS
D102.1 Access and loading, Facilities, buildings or portions
of buildings hereafter constructed shall be accessible to fire
department apparatus by way of an approved fire apparatus
access road with an asphalt, concrete or other approved driv-
ing surface capable of supporting the imposed load of fire
apparatus weighing at least 75,000 pounds (34 050 kg).
SECTION D103
MINIMUM SPECIFICATIONS
D103.1 Access road width with a hydrant. Where a fire
hydrant is located on a fire apparatus access road, the mini-
mum road width shall be 26 feet (7925 mm). See Figure
D103.1.
D103.2 Grade. Fire apparatus access roads shall not exceed
10 percent in grade.

This is in regard to the site plans for the referenced project which were submitted to us for review.
Prior to an approval of the site work and issuance of a New York State Highway Work Permit, the
following items must be addressed:
Please clarify the intent of the dirt and gravel driveways shown on the plan. Our driveway
policy guidelines require that there should only be one (1) access per parcel. We
recommend that the additional driveway(s) be removed and the NY 25 right-of-way
restored with turf.
2. A note should be included in the plans stating all work will be coordinated with NYSDOT
Capital Project PIN 080858 "Drainage Improvements".
This development is along State Bike Route NY 25. Bicyclists should be accommodated in
the Work Zone Traffic Control plan. Also, we suggest that the developer consider installing
bike rack(s) on site.
Site plan approval for highway work permit issuance is contingent upon our receipt of all of the
following items within six (6) months of the date of this letter and no further revisions are made to
the plans once we approve them.
If the Highway Work Permit will be secured by anyone other than the property owner, i.e.
contractor, the applicant must provide a signed letter from the property owner stating the applicant

is authorized to act on behalf of the property owner in this matter. The letter must also include the
property owner's mailing address and telephone number.
Kindly submit three (3) sets of the revised plans, permit fee and surety bond (sample enclosed). It
is also mandatory that protective liability insurance be provided by the permittee. This must be
accomplished by submitting a completed Perm 17, Certificate of Insurance, in accordance with
Option A (form enclosed), or by submitting the fee specified below to be covered under the
NYSDOT Blanket Policy. Also enclosed is a Highway Work Permit Application to be completed
and returned to us. The application, completed Perm 17 and the Surety Bond must be secured by
the same party.
All checks issued to the State of New York must show a Federal Identification Number.

Bond Amount: $10,000.00
Insurance Fee: $175.00 or Perm 17 paid by check no. 15496, dated 4/26/10

renovation of an Agricultural Farm Building into a winery. These plans have been prepared by the
office of Samuels & Steelman Architects. Please consider the following:

The proposed overall disturbance resulting from construction activities and grading of
this site does not appear to be greater than one (1) acre in area. Therefore~.this project
will not require coverage from NYS Department of Environmental Pr, o~n (DEC) under
the Phase II State Pollutant Discharge Elimination System (SPDEST~rogram.
3. The drainage calculations provided on the site plan will require some minor adjustments
to meet Town Code Chapter 236 for Storm Water Management.

We recommend that you consult our driveway policy manual, which is available on our
website at www.n,/sdot.gov. On the NYSDOT A-Z bar click on "H," then click on
Highway Work Permits and then click on Policy and Standards for the Design of Entrances
to State Highways. The driveway design should follow the guidelines outlined in the
driveway policy manual for driveway radius, offset from adjacent property line, etc.
2. A driveway profile should be shown indicating the high point of the driveway, as we do not
permit any runoff to the State highway right-of-way.
A detail for the trench drain should be provided for our review along with the calculations
supporting the choice of drain and storage capacity for the drainage area generating the

The details for the proposed curb along NY 25 should be shown on the plans along with the
appropriate NYSDOT specification item numbers. Please consult our Standard Sheets 609,
which are available on our website, to provide an appropriate design for the curb transition
to end in zero reveal along the NY 25 frontage.
We recommend that a stop sign be installed for this site driveway. The sign should be
shown and called out in accordance with the current National Manual of Uniform Traffic
Control Devices (MUTCD) and NYS Supplement.
The plans do not indicate the treatment for the wooded area of white poplars along the NY
25 frontage. We recommend that the wooded area be called out on the plans to remain
undisturbed and the limits of clearing needed for construction be clearly shown on the
plans.
Please submit five (5) copies of revised plans. In your response letter, please state how the above
comments are addressed, item by item.

The minutes for the March 18, 2010 meeting were approved.
Introduction:
All applicants will give a presentation consisting of drawings, exterior materials
samples and other information required by the Planning Department to the Committee.
The Committee will ask questions and make suggestions as part of a general discussion
with each applicant. Final recommendations from the ARC will be presented to the
Planning Board in the ARC Meeting Minutes, and be made part of the Planning file for
that application. The Planning Board will consider these recommendations, together
with all comments from other agencies, and provide the applicant with a
comprehensive written list of its requested revisions.

work within the fight of way of NY 25, a NYSDOT Highway Work Permit will be required.
The plan you submitted is very helpful; however, it does not contain sufficient information to
progress a meaningful review by our staff. We recommend that the applicant's design
professional consult our driveway policy manual, which is available on our website at
www.nysdot.gov. On the NYSDOT A-Z bar, click on "H", then click on Highway Work Permits
and then click on Policy and Standards for the Design of Entrances to State Highways. In addition
to the driveway design, the publication contains a complete list of items to include on submitted
site plans. All work and material details shall be shown referenced to NYSDOT specification item
numbers.
Please have the applicant submit five (5) copies of site plans, revised as indicated above, directly
to us so that we can commence our review of proposed work. Please also ensure that the attached
NYSDOT Region 10 Project Information Checklist is fully completed and returned with the
applicant's submission.
This permit application should be sensitive to the unique visual and historic setting of the Long
Island North Shore Heritage Area, which runs from the Queens/Nassau County line to Orient
Point, and from Route 25 or 1-495, (whichever is farther south), to Long Island Sound in the north.

A. Submission of a complete site plan application shall consist of:
(1) A completed site plan application form.
(2) The site plan review fee, as specified in Subsection B below. Editor's t9

(3) A completed environmental assessment form.
(4) Nine copies of the site plan.
(5) Four copies of a property survey, certified by a licensed land surveyor.
B. Standards. Site plan design shall include the following items:
(1) Technical data:
(a) The lot, block and section number of the property, taken from the
latest tax records.
(b) The name and address of the landowner on record:
[1] The names and addresses of adjoining landownem.
[2] The name and address of the applicant, if not the
same as the landowner.
(c) The name and address of the person, finn or organization preparing
the map, sealed with the applicable New York State license seal and
signature.
(d) Date, graphic scale and North point, whether true or magnetic; if
magnetic, show the date of reading.
(e) A survey prepared by a licensed surveyor or civil engineer. The site
plan may reference a land surveyor's map or base reference map.
All distances shall be in feet and hundredths ora foot. All angles
shall be given to the nearest 10 seconds or closer. The error of
closure shall not exceed one in 10,000.
(f) The locations, names and widths of all rights-of-way within 500
feet of property lines. If none exist within 500 feet of the subject
property, indicate the distance to the nearest intersection with a
public street.
(g) A separate key map showing location and owners of all adjoining
lands within 500 feet, as shown on the latest tax records, at a scale
of one inch equals 100 feet.
(h) The location, width and purpose of all existing and proposed
easements, setbacks, reservations and areas dedicated to public use
within or adjoining the property.
(i) A complete outline of other existing easements, deed restrictions or
covenants applying to the property.
(j) Existing zoning, including zone lines and dimensions.
(k) Site plans drawn at the scale of one inch equals 20 feet. If all
required information cannot be shown clearly on one plan, the
information should be separated as follows:
[ 1] Alignment and schedule plan.
[2] Grading and drainage.
[3] Landscaping.
[4] Other, e.g., site utilities.
(2) Natural features:
(a) Existing contours with intervals of two feet or less, referred to mean
sea level as per United States Geological Survey datum.
(b) Boundaries of any areas subject to flooding or stormwater
overflows, tidal bays, saltwater marshes, beaches and all freshwater
bodies, including wetlands and intermittent streams, perimeter
boundaries of shoreline bluffs, dunes and beaches.
(c) The location of existing natural features, including but not limited
to natural drainage swales, watercourses, wooded areas and
wetlands, as defined by the New York State Department of
Enviromnental Conservation and the Board of Trustees of Southold ~
Town, marshes, ponds, dunes, bluffs, beaches, kettleholes,
escarpments, wildlife habitats, flood hazard areas, erosion-prone
areas and trees of six inches in diameter at a point three feet above
the trunk base.
(d) The location of any existing cultural and historical features within
, 500 feet of the property boundaries.

(3) Existing building structures and utilities:
(a) The locations, dimensions and outlines of all buildings, as defined
in § 280-4 of this chapter, and all uses of the site.
(b) Paved areas, including parking areas, sidewalks and vehicular
access between the site and public streets.
(c) The locations, dimensions, grades and flow directions of any
existing culverts, waterlines or sewage disposal systems, as well as
other underground and aboveground utility poles and utility lines
within and adjacent to the property.
(d) The location and use of ail buildings and structures, including
curbcuts, within 200 feet of the boundary of the subject property. 'V~
(4) Proposed construction:
(a) The location of proposed buildings or structural improvements,
indicating setbacks from all property lines and horizontal distances
from existing structures.
(b) The location and design of all uses not requiring structures, such as
off-street parking and loading areas and pedestrian circulation.
(c) The location, direction, power level and time of use for any
proposed outdoor lighting or public address systems.
(d) The location and plans for any outdoor signs must be in accordance
with applicable sign regulations.
(e) The location and details of aprons, curbs, sidewalks, fencing (type ,4.~ ~-r~
and location), and grading, including existing and proposed
topography with two-foot contours (on site and 200 feet beyond the
property line) and spot elevations for buildings and all structures,
drainage calculations, details of drainage structures and watershed
areas, where applicable.
(f) Grading and drainage plans shall be based upon site stormwater
retention, in conformance with Chapter 161, Highway
Specifications.
(g) The location and listing of landscaping, buffering and street tree
plans, including type, material, size, quantity and location.
(h) The location of water and sewer mains, electrical service,
cablevision and telephone installations, ground transformers, fire
wells and fire hydrants and/or any alternate means of water supply
and sewage disposal and treatment.
(i) Building elevations for all facades and floor plans showing the
proposed use of floor area.

C. Notwithstanding the foregoing, the Planning Board shall have the discretion to waive any or all of the
requirements of this § 280-133 by resolution at a duly noticed public meeting, for those applications
involving modifications to existing structures with no substantial change to the existing footprint, where the
Planning Board determines that such modifications or any change in use will not require significant changes
to existing major site design features, as well as applications involving uses strictly related to agriculture
(but excepting retail winery operations), if it determines such requirements are not necessary to protect and
maintain the public health, safety, or welfare and to further the objectives set forth in § 280-129.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge
