testamentary having been issued by the New York County Surrogale's Court on July 31, 2008

BEING AND INTENDED TO BE THE same premises that was devised by the last will and testament of
Sarah Moore, a/k/a Sarah Ann Moore, who died on November 21, 1995, a resident of New York County
(File No. 765/1996), all of Sarah Moore's right, title and interest as tenants in common to MARY
KELLEHER, now deceased, that was devised by paragraph 3 of the Last Will and Testament of Douglas S.
Moore, who died on J'uly 25, 1969, a resident of New York County (File No. 4662tl 969) to his wife, Emily
Bailey Moore, who died on June 19, 1978, a resident o£New York County (File No. 3382/1978) leaving a
last will that devised all of her property, real and personal, to her daughters Mary Moore Kelleher and Sarah
Ann Moore.
This deed is intended to confirm the intent of the party of the first part to convey all right, title and
interest to the premises described herein at Schedule A to the party of the second part so as to
include all lands to the mean high water mark of the Great Peconic Bay. Said premises was
previously deeded by Darby Moore as Executrix of the Estate of Mary Kelleher to Jeff Miller by
deed recorded 6/23/09 in Liber 12591 Page 633, and which was subsequently conveyed by Jeff Miller
to Jeff Miller and Susan F_.. Miller, his wife by deed recorded 6/7/10 in Liber 12626 page 832. This
deed confirms the legal description of the premises herein which more accurately describes
premises as being bounded to the south by the Great Peconie Bay."
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any st~'eets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
11'O HAVE AND TO HOLD thc premises herein granted unto the part~ of tb.e second p~, ~e heirs or
successors and assigns of the party of thc second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the par~y
of the fwst part will receive the consideration for this convey~mce and will hold the right to receive such
consideration as a trust fund to be applied first for thc purpose of paying thc cost of the improvement, and
will apply the same first to the payment of thc cost of the improvement before using any part of the totzl of
the same for any other purpose. The word "party" shall be consmled as if it read "parties" whenever the
