The meeting began at 7:15 p.m. with four LPC members present. This meeting was a re-scheduled regular meeting since the February 8, 2011 meeting was cancelled. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM JANUARY 25, 2011. Not prepared in time for meeting. Land Preservation Applications and Inquiries: ?? SCTM #1000-106-9-2.3 (Don Cooper) New AgPDD application Eric Keil was not present for discussion on this project due to family relationship to applicant. In following Town Code adopted procedures regarding AgPDD, Melissa Spiro is to direct the Cooper application to the Town Board for review. CUB SCOUT INQUIRY Melissa received a phone call from Tammy Jester, local Cub Scout leader, requesting information on any current Town projects going on that the Cub Scouts could assist with, such as erosion projects. LPC suggested beach grass planting, phrag cutting, or trash clean-up. General Land Preservation Items: ?? EASEMENT LANGUAGE AND DEFINITIONS Ray Huntington took the floor and continued previous discussions concerning “easement language and definitions”. He distributed his “Composite for Discussion on 2/15/11” (white sheet) for review and comments. No action was taken and discussion will continue at future LPC meetings. ?? UPDATE ON RUTTURA PROPERTY (f/k/a Batuello f/k/a Kaloski – Alvah’s Lane, Cutchogue) SCTM #1000-102-4-6.1 The woods have been cleared and nothing remains but stumps and branches. It appears that some grading has been started. Current landowners informed Damon Rallis, Code Enforcer, that land was being cleared for grape planting, an agricultural use within the development rights easement area, so no Code violations at this time. Deer fencing has been installed that was approved by LPC at a previous Committee meeting. ?? AgPPD Melissa reviewed background of adopted Town Code for AgPDD. LPC created hypothetical parcel to be appraised for AgPDD when legislation first adopted and two appraisals were prepared; however, LPC and Town Board never adopted annual purchase price. Appraisals are now outdated and in order to proceed, new appraisals are needed. MOTION made by John Sepenoski, seconded by Eric Keil, to direct Melissa Spiro to commission two separate generic appraisals for purpose of establishing annual AgPDD purchase price. Appraisers to appraise “hypothetical parcel” described by LPC. Motion carried: 4/1 (no – Ray Huntington) MOTION made by Ray Huntington, not seconded, that the creation of the AgPDD opportunity (Chapter 280 § 170) was a good faith effort to establish an additional tool for land preservation, but it is not a ready-made tool. It requires further investment, has significant operating costs and is potentially costly for the results that would likely be obtained. When viewed in the current economic climate, the mechanism is seen as complex and questionably affordable. Resources that can be made available would be more effectively applied within the mechanisms earlier established under Chapters 17, 70 and 185 as well as the subdivision parts of Chapter 280. Therefore, the land Preservation Committee recommends that the mechanism for establishment of an Agricultural Planned Development District as described by Chapter 280 be eliminated from the Town Code. Motion discussed but not seconded. No vote. Next Regular Meeting: ?? The next regular meeting will be held on February 22, 2011 at 7:00 p.m., in the Annex Executive Board Room. Adjournment: ??
