WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon as described in "Schedule A" annexed hereto and made a part hereof.
Said premises are being known as 2800 Dignans Road, Cutchogue, New York.
Being the same premises conveyed to the party of the first part deed dated September 10,
1994 and recorded September 28, 1994 in Liber 11696, Page 149.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of thc party of thc first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that thc party of thc first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid. AND the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part will receive the
consideration for this conveyance and wilt hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of thc cost of the improvement before using any
part of the total of the same for any other purpose. The word "party" shall be construed as
if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at
Cutchogue, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point marked by a monument on the division line between
land of`john Zuhoski on the West and land now or formeHy of David Dignan on
the East; said point being North 46 degrees 39 minutes 50 seconds West,
3067.33 feet along said line from a point on the northerly line of Oregon Road,
where same is intersected by the center line of a certain right of way set forth
in Liber 5187 page 289;
RUNNING THENCE from said point of beginning, South 43 degrees 20
minutes 10 seconds West, along the southerly line of premises as set forth in
Liber J 1488 page 54, 25.00 feet to a point;
THENCE North 46 degrees 39 minutes 50 seconds West still along land now
or formerly of,John Zuhoski, 222.40 feet to a point;
THENCE North 88 degrees 17 minutes 50 seconds West still aiong land now
or formerly of John Zuhoski, 40.62 feet to land now or formerly of Murray
Klapper;
THENCE North 27 degrees 00 minutes 00 seconds East along said land now
or formerly of Murray Klapper, 279.61 feet to the mean high water mark of the
Long island Sound;
THENCE generally easterly along the mean high water mark of the Long
Island Sound the tie line of which is South 70 degrees 29 minutes 20 seconds
East, a distance of 129.75 feet to land now or formerly of David Dignan; and
THENCE South 05 degrees 02 minutes 10 seconds West along land now or
formerly of David Dignan, 344~.3 feet to the point or place of BEGINNING.
TOGETHER WITH the Benefits of that certain non-exclusive 20 foot wlde
Right.of-Way as more fully described in Liber 5187 page 289 over land now or
formerly of John Zuhoski to Oregon Road.
SUBJECT TO the Burdens of a non-exclusive 16 foot and 20 foot Right-of.
