The gravel ddveway and parking areas have been modified to include the installation of asphalt pavement over the existing gravel surfaces. The drainage calculations have been modified accordingly and the proposed drainage design meets the minimum requirements of the Town Code. At the time of this inspection, we observed construction on the rear and left side of the building, it was apparent that the site inspection was premature. 1) Install the final surface of the parking lot and access. 2) Finish all construction as approved on the site plan. The applicant / owner met us on site and indicated that the gravel surface approved on the site plan will be paved, please submit to the Planning Department the revised drainage calculations for approval prior to this work. Please notify us when all items are complete for a final inspection. Proje t ~"' ": ~ ~--'~' RE: Proposed Site Plan for Highwind Farm, e~t :~ SCTM #: 1000-122-7-8.6 Dear Mr. Terry: The Suffolk County Department of Health Services (SCDHS) has received your letter dated October 5, 2004, concerning the above-referenced application, and has no objection to the Town's designation as lead agency. This correspondence is intended primarily to expedite the procedural requirements of SEQRA pertaining to the establishment of lead agency. The comments provided below are, therefore, general nature, representing several of our most common concerns regarding Suffolk County projects. The department wishes, however, to reserve its right to provide more detailed information within the comment period(s) established for this action. I. Suffolk County Sanitary Code (SCSC) 1. The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems, pursuant to the authority and requirements of Articles 4, 5, and 6 of the SCSC. Applications must comply with all relevant density and construction standards for water supply and sewage disposal. Applicants should not undertake the construction of, or connection to, either system without Health Department approval. 2. The Suffolk County Department of Health Services has not received an application for the proposed subdivision as required by Article VI of the Suffolk County Sanitary Code (SCSC). The project sponsor should submit an application to our agency's Bureau of Water and Wastewater at · DIVISION OF ENVIRONMENTAL QUALITY · OFFICE OF ECOLOGY · RIVERHEAD COUNTY CENTER · RIVERHEAD NY 1901-3397 · Phone (631) 852-2077 Fax (631) 852-2743 the earliest possible date so that a complete technical assessment of this proposal can be undertaken. 3. Design and flow specifications, information regarding subsurface soil conditions, water supply information, and complete design details are essential to the review of this project, and are evaluated fully at the time of application review. Should the town require additional environmental information (such as a DEIS), discussion of the compliance requirements of the SCDHS should be required. In general, the department encourages the following land use measures be considered (where appropriate) to actions being reviewed pursuant to SEQRA. 1. Maximum practicable confinement of development to areas with slopes of less than 10%. 2. Maximum use of native species for landscaping purposes. 3. Minimal use of fertilizer-dependant turf and landscaping. 4. Employment of stormwater runoff control measures necessary to maintain nmoff on-site. 5. Clustering of subdivision lots to provide for maximum preservation of large contiguous areas of dedicated open space The department appreciates the oppommity to participate in the SEQRA review of this proposal. Additional information may be provided prior to the close of the established comment period. Should you have any questions or require additional information, please feel free to contact the Office of Ecology at 852-2077. Box 1179 Southold, NY 11971-0959 Tel. (631) 765-1809 Fax (631) 765-9064 PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 51.7518 acres in the R-80 Zone District, with street frontages along Main Road, Old Main Road, and Peconic Bay Boulevard. The property is improved with a single-family, two-story frame house, accessory sheds, barn, and horse stable, as shown on the April 9, 2004 site plan, amended June 24i; 2004 by Thomas C. Wolpert, P.E. / APPLICANT'S F~EQUEST/BASlS OF APPLICATION: A Special Exception is requested under 100-313~(12) for a proposed riding academy/stable-for-hire in this R-80 Residential Zone District. Parking and screening shall be as determined under the Zoning Code site plan provisions, considered under separate jurisdiction determined by the Southold Town Planning Board. STANDARDS/REASONS FOR BOARD ACTION: After review of the requirements set forth pursuant to Chapter 100 governing a horse riding academy uses by Special Exception review, and on the basis of testimony presented and personal inspection, the Boal d finds: The owners plan to board and stable horses for-hire, to breed, to offer riding lessons, to provide a viewing room and indoor riding rink inside the barn for riding shows, clinics and educational programs. Most of these activities will be conducted inside the stable (barn) and the indoor space will provide a safe and comfortable area for the exercising of the horses and learning to ride. 1. In this review the Board determines that this proposed use is in harmony with the zoning ordinance and will not adversely affect the neighborhood when meeting the code requirements. A horse riding academy is permitted in this Agricultural-Conservation (AC) Zone District under Section 100-31B(12) of the Town Zoning Code, subject to special exception authorization of the Zoning Board of Appeals. The property contains 51.75 acres and consists of open land with the owners' house and existing barns. The nearest street is 160 feet north of the new riding rink/horse barn with 4,143 sq. ft. addition. The building will be at least 92 feet from any other property or adjacent residence. Page 2 - August 2, 2004 ZBA SE No. 5552 - S. Lomangino 122-7-8.6 at Mattituck 2. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds that: (A) The proposed use will be primarily conducted inside the barn and will not interfere with the orderly and reasonable use of the other uses in the district. The parcel is over 50-acres, improved with a house that will continue to be occupied as a residence. Even if the house were separated in the future from the riding academy, there will be a minimum land area of 10 acres applied to this use, and both parcels will be in the control of the same owner. The barn for this use is located more than 160 feet from Old Main Road. The riding stable/barn was originally constructed for the owner's personal ~se, however, local horse owners and riders have requested access to the barns to exercise their t/orses, to stable their horses in a beautiful spacious building, and to enjoy the 51 acres of open lands for riding. The Boarding of homes and the customary uses associated with boarding are agrie, ultural uses protected in the Ag & Markets Law. The uses proposed in this Special Permit ar6 standard practices in most of the larger horse farms in the Town of Southold and else ware, the building department had threatened pmsecutiun of the zoning code if the owner rented the barn to other equestrian owners despite boarding of horses is a customary and accessory commercial use to a horse farm. As a "rid'~g academy and stable" in addition to the ordinary and customary practices of a horse farm, the o ,~wner will conduct riding clinics and educational programs. For example, the owner has investigated riding programs for handicap individuals. Similar to Hedgewood Farm (Mattituck), and Bittner's Farm (Southold) the owner will encourage private riding lessons, and educational clinicS. Horse Boarding will be conducted on the premises and is a specifically authorized agdcui~ural use. Along with horse boarding, the homes will be exercised and trained in the indoor riding rink. Due to th¢'.liability of an equestrian center, the owner wishes to reserve the fight to set - off the stable and.~iding academy from the residence ( subject to Planning Board review and approval) at some later date. The decision on the Special Permit should not preclude this option. B. THAT THE USE WILL NOT PREVENT THE ORDERLY AND REASONABLE USE OF PERMITTED OR LEGALLY ESTABLISHED USES IN THE DISTRICT WHEREIN THE PROPOSED USE IS TO BE LOCATED OR ADJACENT USE DISTRICTS: The indoOr Riding Rink inside the barn provides a safe and comfortable space for exercising the hoi',se and learning to ride. A viewing room is proposed for the family of the riders to sit, protected fr6m the horses, while viewing the riders. The proposed use will be primarily conducted inside the barn and will not interfere with the orderly and reasonable use of other uses in the district. The parcel is over 50 acres and, even if split off from the house parcel, will be in the control of the same owner. All the uses intended for this barn are customary and accessory uses of a horse farm, of which there are many in the Town of Southold, and all the planned activities are consistent with the agricultural use. Therefore, the proposed "riding academy" will not prevent the o/derly and reasonable use of other uses in the district. C. THAT THE ~FETY, THE HEALTH, THE WELFARE, THE COMFORT, THE CONVENIENCE OR THE ORDER OF THE TOWN WILL NOT BE ADVERSELY AFFECTED BYTHE PROPOSED USE AND ITS LOCATION This con'unity wishes to preserve agriculture of which a Horse Farm is specifically recognized under'~e Agriculture & Markets Law: The proposed "commercial use" of the barn is not significantly &fferent than the other home farms in existence throughout the town. Moreover, the o~er horse farms offer boarding for pay, horse riding lessons, and do all other manner of equestrian activities which are similarly proposed by the applicant. D. THAT T~IE USE WILL BE IN HARMONY WITH AND PROMOTE THE GENERAL PURPOSES AND INTENT OF THIS CHAPTER As was previously stated, the home farm and equestrian stable & riding rink proposed encourages and p~omotes agriculture. The Equestrian community is a significant segment of the agricultural community and deserving of promotion and support. The proposed riding academy is a private facili~ which promotes an agricultural use. E. THAT THE USE WILL BE COMPATIBLE WITH ITS SURROUNDINGS AND WITH THE CHARACTER OF THE NEIGHBORHOOD AND OF THE coMMUNITY IN GENERAL, pARTICULARLY WITH REGARD TO VISIBILITY, SCALE AND OVERALL APPEArAnCE The appearance of the structure and the use will not change as a result of the Special Permit approval. :An agricultural use is intended to make money- all the local horse farms board homes, give lessops, breed homes and conduct periodic educational clinics. The building inspector has dirdbted the owner to obtain a Special Permit. The Riding Academy is private, not open to the gener~ public and limited to exluestdan activities: private horse shows and educational clinic~. All these uses are no different then Vineyards selling from Wineries, and farmers selling at.~,stands throughout the season. F. THAT ALL PROPOSED STRUCTURES, EQUIPMENT AND MATERIAL SHALL BE READILY ACCESSIBLE FOR FIRE & POLICE PROTECTION The barn i$ designed with consideration for easy emergency access. The site plan will be reviewed and approved by the Planning Board. Adequate Parking is proposed and easy access is provided. QUESTIONNAIRE FOR FILING WITH YOUR Z.B.A. APPLICATION A. [22,441 sq.ft, structure and 300 sq.ft. Viewing area = 22,741 sq.ft. the total fee paid to the Town of Southold is $1,437 ($300 + $1,137.00) Thank you for scheduling this application before the Planning Board for a work session. The parking areas are calculated based on the Town Code, however, the horses are in the stables. Riders come onto the property in staggered numbers. My client does not anticipate more then 5 riders at any one time. On occasion trailers are needed for the horses, however any activity in and out of the barn is better suited on grass. We would respectfully request that the parking be "land banked" with grass area rather than crushed stone. If there are other issues you wish to discuss we would be pleased to address these matters at the work session. x.. Identifying that an impact will be potential]y large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifyin§ an impact in column 2 simplt asks that it be looked at further. · The Examples provided are to assist the reviewer by showin~ types of impacts and wherever possible the threshold o: magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State anc for a Potential Large Impact response, thus requiring evaluation in Part 3. · The impacts of each proiect, on each site, in each locality, will vary. Therefore. the examples are illustrative anc · In identifying impacts, consider long term, short term and cumlative effects. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. c. [f answering Yes to a question then check the appropriate box (coloron 1 or 2) to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If imoact will occur but threshold is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3, e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the proiect to a small to moderate impact, also check the Yes box in column 3.
