THIS INDENTURE, made thc 9m day of December, Two Thousand Ten
BETWEEN
EWALD M. KARB1NER, residing at 39 Edgewood Drive, New Hyde Park, New York 11040,
and JOSEPH TOMITZ, residing at 2966 Huntington Court, Wantagh, New York 11793,
party of the first part, and
EWALD M. KARBINER and MARY ANN KARBINER, husband and wife, residing at 39
Edgewood Drive, New Hyde Park, New York 11040, as to an undivided 50% interest, and
JOSEPH A. TOMITZ and JOAN H. TOMITZ, husband and wife, residing at 2966 Huntington
Court, Wantagh, New York l 1793, as to an undivided 50% interest,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situato, lying and being at Southold, in the County of Suffolk and State of New York,
being more particularly bounded and described as follows:
BEGINNING at a poim on the wesgrly side of a certain twenty foot wide right of way, which
point or place of beginning is distant the following three courses and distances fi.om the comer
formed by the imersecfion of the northwesterly side of Sound View Avenue with the
northeasterly side of Hortons Lane:
(I) Westerly along the northeasterly side of Hortons Lane, 564.49 feet to the intersection of
the southwesterly side of said twenty foot wide fight of way with the northeasterly side of
Honons Lane; ,
(2) Westerly along the southwesterly and southerly side of said 20 foot wide right of way,
t 12.73 feet to the westerly side of said 20 foot wide right of way;
(3) Northerly along the westerly side of said 20 foot wide right of way, 39.08 feet to the tree
poim or place of BEGINNING.
THENCE North 64 degrees 50 minutes 00 seconds West along land now or formerly of
Offenheimer, 371.00 feet to the average high water line of Long island Sound;
THENCE northerly along the average high water line of Long Island Sound along a tie line
bearing of North 32 degrees 15 minutes 00 seconds East, 171.31 feet to land now or formerly of
Burns',
THENCE South 64 degrees $0 minutes 00 seconds East along last mention~ land, 310.00 feet to
the westerly side of the aforesaid 20 foot wide right of way;
THENCE South 22 degrees 30 minutes 00 seconds East along the westerly side of said 20 foot
wide right of way, 15.16 feet;
THENCE South 14 degrees 59 minutes 20 seconds West, still along the westerly side of said 20
foot wide right &way, 162.34 feet to the point or place of BE(3INNING.
TOGETHER with a right of way over a strip of land twenty (20) feet in width from the
northeasterly comer of the premises herein described, southerly and then southeasterly and then
again southerly to said Hortons Lane.
BEING AND INTENDED TO BE the same premises conveyed to the party of the fLrst part by
deed dated October 6, 1981, and recorded November 6, 198t, in the Office of the Suffolk County
Clerk in Liber 9096, Page 462.
TOGETHER with all fight, title and interest, if any, of the party o£ the first part in and to any
stxeets and roads abutting the above described premises to the center lines thereof; TOOETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first p~t has not done or sufr~d
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Den Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
