THIS INDENTURE, made the 9a~ day of December, Two Thousand Ten
BETWEEN
EWALD KARBINER, residing at 39 Edgewood Drive, New Hyde Park, New York I 1040, and
JOSEPH TOMITZ, residing at 2966 Huntington Court= Wantagh, New York 11793, as equal
tenants in common,
party of the first part, and
EWALD M. KARBINER and MARY ANN KARBINER, husband and wife, residing at 39
Edgewood Drive, New Hyde Park, New York 11040, as to an undivided 50% interest, and
JOSEPH A. TOMITZ and JOAN H, TOMITZ, husband and wife, residing at 2966 Huntington
Court, Wantagh, New York 11793, as to an undivided 50°,4 interest,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk, and State of New
York, bounded and described as follows:
BEGINNING at an iron pipe on the westerly line ora 20 foot right of way, North 14 degrees 59
minutes 20 seconds East, a distance of 11.79 feet along said westerly line and along land now or
formerly of Burns from the curved northerly line of Horton's Lane, said point of beginning being
the northeasterly comer of land now or formerly of Olivefi; from said poim of beginning running
along said land now or formerly of Olivefi, North 64 degrees 50 minutes West, a distance of 400
feet, more or less, to ordinary high water mark of Long Island Sound;
THENCE northeasterly along said high water mark 33 feet, more or less, to land now or formerly
of Witherspoon;
THENCE along said land now or formerly of Witherspoon, South 64 degrees 50 minutes East, a
distance of 390 feet, more or less, to a monumen'~ on said westerly line of said 20 foot right of
way;
THENCE along said westerly line, South 14 degrees 59 minutes 20 seconds West, 32.58 feet to
the point or place of BEGINNING.
'TOGETHER with a right of way over said 20 foot right of way from the northeasterly comer of
the premises southerly and then easterly and then again southerly about 150 feet to Horlon's
Lane.
BEING AND INTENDED TO BE ffa~ same premises conveyed to the party of the tim part by
deed dated April 22, 199I, and recorded May 6, 1991, in the Office of the Suffolk County Clerk
in Libe~r 11257, Page 461.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of thc party of thc first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of thc first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid,
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the fight
to receive such consideration as a Irust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
