THIS INDENTURE, made the 22"4 day of October two thousand and 10,
between Suzanne Diviney, residing at 3 Pinoak Court, Huntington Station, New York l 1746,
party of the first part, and
Daniel Diviney and Suzenne Diviney, his wife, residing at 3 Pinoak COurt, Huntington Station,

WITNESSETH, that the party of the first part, in consideration often dollars and other
valuable consideration paid by the party of the second pan, does hereby grant and release unto
the pm'ty of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, near Greenport, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a locust post on the Easterly line of Bay Road, distant 763.22 fi. Southerly
measured along said Easterly line of Bay Road and along the Easterly line of Inlet Lane from the
Southerly line of Manhanset Avenue, said point of beginning being the Southwesterly comer of
land, now or formerly of Eugene and Ruth Spalinger; and from said angles to said Easterly line
of Bay Road, North 86 deg. 38' 40" East 172 ft. more or less, to ordinary high watermark of
Gull Pond Inlet or Cutter; then Southerly along said high water mark to a point 125.0 ft.
Southerly from the Northerly boundary line hereinabove described when measured at fight
angles thereto and to the Northerly boundary of land conveyed by Michael J. Capuano and Lois
il. Capuano to George and Mary Witanko be deed dated June 4, 1956 and recorded in Liber
3706 pg 500; Thence along said land of Witanko and again at fight angles to said Easterly line of
Bay Road South 85 deg. 38' 40 ~' West 144 ft. more or less to an iron pipe on said Easterly line
of Bay Road; and Thence along said Easterly line of Bay Road North 4 deg. 21' 20" West 125 ft.
to the point of Beginning.
SUBJECT TO A LIFE ESTATE IN VIRGINIA F. MARTIN, CREATED PURSUANT TO
DEED DATED, NOVEMBER 6, 2009, RECORDED JANUARY 15, 2010.
TOGETIlER with all right, title and interest, ifany, of the party of the first part in and to any
streets and roads abusing the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of thc first part in and to said
premises; TO HAVE AND TO HOLD the premises bercin granted unto the party of the second

AND thc party of the first part, in compliance with Section 13 of the Lien Law, covenants that

right to rcccive such consideration as a trust fund to be applied first for the purpose of paying the
cost of thc improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
