Spoil to be trucked off-site to an approved location. Located: 6540 Main Bayview Rd., Southold. SCTM#78-5-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with the following LWRP policy standards and therefore is CONSISTENT with the policies of the program and therefore is consistent with LWRP, In the event that the action is approved; to further Policies 5. Protect and improve water quality in the Town of Southold, 6.3 Protect and restore tidal and freshwater wetlands and Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary and Town waters. If practical, it is recommended that the Board require that the silt boom be deployed during the construction of the structure pursuant to: § 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessar~ during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation ora silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The removed spoil to be tracked off site to an approved disposal location. DEVELOPED COAST POU[CTES Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient uso of infrastructure, makes benef'~ial uso of a eoastal location, and minimizes adverse effects of development. Our proposal is consistent with this policy in that this canal is used by the homeowner to engage in water dependent activities. The shoaled area is preventing the owner from using this section in front of his bulkhead at Iow tide, Removing this material will allow the owner access to his entire bulkhead with a small boat. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have any negative impacts on the visual quality or scenic resources. There are no structural components to our proposal. This proposal is consistent with the area. Areas in this canal have been dredge normally during bulkhead reconstructions and there was no impairment to the existing vegetation. NATURAL COAST POL/CZES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. This project has will have no flooding or erosion concerns. Policy 5 Protect and improve water quality and supply in the Town of Southold. Our proposal will not have any impact of the water quality or supply in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. Our proposed dredge will maintain a minimum water depth of -2.5' at Iow water. The dredge spoil will be placed at an approved upland location. Policy 7 Protect and improve air quality in the Town of Southold. Our proposal will not have any impact on the air quality in the Town of Southold. Policy 8 Minimize environmental degradaUon in the Town of Southold from solid waste and hazardous substances and wastes. Our proposal will not influence the environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. . PUB'L.~C COAST POL[C.I[ES Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will give the property owners the ability to safely access his bulkhead with a small boat or water craft. There will be no change in the ability of the public to access public resources of the Town of Southold. WORKING COAST POi/CIES Policy 10 Protoct the Town of Southold's water-dependent uses and promote siting of new water- dependent uses in suitable IocaUons. The project site is located at the end of an existing man made canal where there is an area of shoal limiting the ability of the homeowner to utilize the full length of his bulkhead. Removing 75 cubic yards will provide sufficient water depth for only a small boat. The homeowner uses this property to access iarger bodies of water to engage in water-dependent activities such as boating, fishing and water sport, etc... Policy 11 Promoto sustainable use of living marine resources in the Town of Southold. The canal is an active waterway and not the mos~ desirable habitat for living marine resources. The area to be dredged is a small in area in front of the owner's bulkhead. Afrer the proposed dredging is complete, the surrounding area will not have any long term negative effects. This canal is shallow and is disturbed from the minor boat traffic within the summer months. Policy 12 Protect agricultural lands in the Town of Southold. Our proposal will not have any impact on agricultural lands in the Town of Southold. Policy 13 Promote appropriato use and development of energy and mineral resources.
