Costello Marine Contracting Corp. on behalf of IOANNA & DAVID MOORE requests a
Wetland Permit to repair and/or replace sections of th'e existing stairway to beach as required,
in-kind and in-place. Located: 21075 Soundview Ave., Southold. SCTM#51-4-17
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "EE" which states:
A. Maintenance or repair involving no substantial changes in an existing structure or
facility;

Repair and/or replace existing staircase leading to the beach, in-kind, in-place.
DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal
location, and minimizes adverse effects of development.
The existing staircase is in poor condition due to the bulkhead failing. The owner is trying to maintain
the integrity of the staircase to ensure that is safe for his family to use to access the water. Our
proposal will not have any effect on the community character or preservation of open space.
Policy 2
Preserve historic resources of the Town of Southoid.
This property has no significant historic resources.
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The present condition of this staircase is unstable. Repairing the staircase is just an attempt of the
upland property owner to maintain his property. So the visual quality and scenic resources will be
restomcl to when the area was stable.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
Thc staircase will not have an effect on the loss of life, structures and natural resources from flooding
and erosion.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact on the water quality and supply of the Town of Southold.
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosystem.
This proposal will not have any impact on the Town of Southold's ecosystem. The location of the
existing staircase is landward of the high water mark with the majority of the structures on top the
bulkhead.
Policy 7
Protect and improve air quality in the Town of Southold.
This proposal will not have any impact on the air quality of the Town of Southold.
Policy 8
Minimize environmental degradation in the Town of Southold from solid waste and hazardous
substances and wastes.
This proposal will not degrade the environment with solid waste or hazardous substances.
PUBLIC COAST POLICIES
Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold.
Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. The existing staircase is landward of the high water mark.

WORKING COAST POLICIES

dependent uses in suitable locations.
Our proposal is to repair an existing staircase that was damaged during the recent winter storms. The
present condition of the staircase is poor and is unsafe. This staircase provides access to the water
allowing the property owner to engage in water dependent activities.
Policy 11
Promote sustainable use of living marine resources in the Town of Southold.
The location of the existing staircase is landward of the high water mark. There should be no
significant effects on the living marine resources.
Policy 12
Protect agricultural lands in the Town of Southold.
This proposal has no impact on the agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
This proposal has no influence on the development of energy and mineral resources.
