ALLISON TUPPER #6377. Request for Variance from Code Section 280-116B, based on an
application for building permit for additions and alterations, and the Building Inspector's
November 19, 2009, updated Mamh 1,2010 Notice of Disapproval concerning additions and
alterations to existing dwelling, at less than the code required setback from bulkhead of 75
feet; at 3050 Minnehaha Blvd., (adjacent to Corey Creek) Southold, NY. SCTM#1000-87-3-41.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
determination that the proposed action is EXEMPT from LWRP review pursuant to:
'§ 268-3. Definitions. MINOR ACTIONS item "Il" which states:
I1.
Additions to an existing building or rebuilt residential structure which results in no net
increase in ground area coverage, except where the parcel is located in a coastal
erosion hazard area;
The parcel is not located within the Coastal Erosion Hazard Area.

Due to the uniqueness of this application, I will be addressing these questions to each of the four
variance requests being made.
An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because;
As this is only an addition of dormers, wkich do not project outside the existing walls of the
residence, it will not change the character of the neighborhood.
The benefit sought by the applicant CANNOT be achieved by some method feusible for the
applicant to pursue, other than an area variance, because;
Due to the setback from the existing bulkhead being less than 75 feet, we cannot achieve our
project goals without a variance.
The amount of relief requested is not substantial because;
Due to this proposal being only minor dormers on the existing second floor, which do not project
outside of the existing walls, this project is minor in nature.
The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or the district because;
There will be no adverse effect or impact on physical conditions or environment due to this
project since it is a proposal for minor dormers on the existing second floor.
