SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County
Department of Planning issued its reply dated Dec. 29, 2010 stating that this application is
considered a matter for local determination as there appears to be no significant county-wide or
inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property consists of an agricultural/farm parcel
containing 77.66 acres, minus 4.11 acres of wetlands, with 73.51+/- remaining acres, or
3,202,008+/-square feet. The property is located in the AC Zone, and is in use as a horse farm and
stable. The property is improved with a two-story frame house, several principal agricultural
structures, and numerous accessory agricultural structures, all of which are identified as buildings
# 1-19, as shown on the site survey drawn by BBV Civil Engineers, latest revision dated Nov. 17,
2010. The agricultural structure with the proposed staff [groom's] apartment subject to this Special
Exception Application is noted as building # 18 [stable] on the reference survey; and is also titled
Barn "A" on the site plan as shown on Sheets A- 101, A-101.1, and A- 110 drawn by Fairfa,x &
Simmons Architects PC., latest revision dated Feb. 2, 2011.
BASIS OF APPLICATION: Request for Special Exception approval per Code Section 280-
13B(9) whereas the Applicant proposes farm labor housing that is a permitted use requiring a
Town Zoning Board Special Exception.
RELIEF REQUESTED: The applicant proposes to construct a two-bedroom apartment in an
agricultural structure (second floor of an existing horse barn) for the purpose of providing living
space for an employee (groom) of 4170 Indian Neck Lane Holdings, and related family members.

ADDITIONAL INFORMATION:. This Special Exception requires Town Planning Board site
plan approval. The Applicant's file contains a copy of a Memorandum from the Town Planning
Board Office, dated Dec. 13, 2010, a copy of a Building Permit issued by the Town Building
Dept., dated June 26, 2008, and other pertinent documentation provided by the Applicant. The
Town code recognizes a horse farm as a bona fide agricultural operation. At the Feb 3,2011 public
hearing the agent for the applicant submitted an amended set of architectural plans for the proposed
second floor apartment to address the Zoning Board's concerns for the number of proposed
occupants, fire safety, and emergency egress.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on January 6, 2011, and
February 3,2011 at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant and makes the following findings:
The Board has reviewed the General Standards governing Special Exception uses set forth in
Section 280-142 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts. The applicant owns a 77.7 acre parcel with a residence
and agricultural structures/barns which are not easily seen from the street. Only one
apartment unit of farm labor housing is being proposed in conjunction with the agricultural
operation.
B. That the use will not prevent the orderly and reasonable use of permitted or legally
established uses in the district wherein the requested use is located or of permitted or
legally established uses in adjacent use districts
C. That the safety, the health, the welfare, the comfort, the convenience or the order of the
town will not be adversely affected by the proposed use and its location.
D. That the use will be in harmony with and promote the general purposes and intent of
this chapter. The occupant of the proposed farm labor housing shall be limited to a full
time employee of the agricultural operation.
E. That the use will be compatible with its surroundings and with the character of the
neighborhood and of the community in general, particularly with regard to visibility, scale
and overall appearance. The proposed farm employee apartment is residential in character,
as are other properties in the neighborhood, and shall be located within an existing
agricultural structure suitable to the AC zoning.
F. That all proposed structures, equipment and material shall be readily accessible for fire
and police protection. The proposed second floor apartment includes 90 minute fire rated
doors, two hour fire rated perimeter walls, and two exterior balconies each with a pull
down ladder for emergency egress.
BOARD RESOLUTION: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member
Goehringer, and duly carried to

Barn A on the site plan sheets prepared by Fairfax & Sammons Architects PC, latest revision dated
Feb. 2, 2011, and the architectural drawings by Fairfax & Sammons Architects PC sealed and date
stamped 1/26/11 and dated Feb 2, 2011 issued for hearing Zoning Board, labeled Barn "A" plans
Sheet A-101, Barn A Upper Level Plan w/Apartment A-101.1 and Barn A Elevations Sheet A110.
Subject to the following conditions;
Conditions:
1. The apartment shall be occupied by a full-time employee of the Applicant/owner, and
related family members, not to exceed three persons.
2. The apartment occupants shall not be a partner or co-owner of the Applicant.
3. This Special Exception permit is granted subject to site plan approval by the
Planning Board.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in
delays and/or a possible denial by the Building Department of a building permit, and may require a new
application and public hearing before the Zoning Board of Appeals
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject propemy that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

Dear Ms. Weisman:
At the Public Hearing of January 6, 201 I, the Board members had several question regarding this
application. This letter is in response to those questions. The architectural plans have been revised
to reflect the responses. The questions and comments are listed below with the respective
response.
1. The proposed number of occupants of the apartment. It is anticipated that there will be no
more than three occupants of the apartment, as shown on the revised plans. It is respectfully
suggested that in your decision the occupancy of the premises be limited to no more than one
family as defined in Section 280-4 of the Southold Town Code.
2. Plans for apartments in any of the other barns. There are no plans for dwelling units in any
of the other hams on the property.
3. More detailed floor plan, e.g no kitchen is shown. The plans have been detailed to show the
kitchen layout and the TV room (waiting room), as well as other details shown in "clouds" on the
revised plans.
4. Can the farm be subdivided and an independent dwelling be built on a new lot rather
than put one in a barn? Theoretically, yes, however there is no desire to subdivide the farm at
this time. The previous owner's proposed subdivision has been abandoned in favor of the present
agricultural use which fully occupies the property.
5. Show a second method of egress to the apartment. The plans have been revised to show two
additional emergency exits in the form of metal balconies and pull up ladders. Fire doors with a
90 minute minimum have been added to each end of the apathnent.
6. Compatibility of hay storage and a dwelling on same floor. The dwelling will be protected
with two-hour rated fire wall separations in the flooring and from the hay storage areas. All other
requirements of applicable New York State, County and Town fire regulations will be reviewed
and met in the Building Permit process.
7. Was an apartment on ground floor considered instead? It is not practical to establish an
apartment on the ground floor as it has already been built for the required number of stalls and
appurtenant tack and storage rooms.
Please enter the attached architectural plans for Indian Neck Farm, Sheets A- 101, A- 101.1 and A-
l 10, prepared by Richard Franklin Sammons of Fairfax and Sammons, sealed and date stamped
1/24/11, into the record of this hearing.
Also attached is a Notice of Disapproval from the Town Building Department indicating that the
proposed use is permitted pursuant to Article III, Section 280-13A of the Southold Town Code,
also requiring a site plan approval from the Town Planning Board.
If you need any further information on this request prior to the February 3~d hearing on this
project, please contact me. I will attend that hearing to answer any further questions. Thank you

Re: 4170 Indian Neck Holdings, LLC
We have received your request for comments on this proposed farm labor camp. The Planning
Board currently has no application before it with regard to this proposal, nor have they ever
reviewed a site plan for the three recently completed barns. It is our understanding from the
Building Department that the barns were constructed as accessory structures to the home located
on this property, and have received certificates of occupancy as accessory structures, not as
agricultural buildings. Buildings accessory to residences do not require site plan approval.
The fact that these buildings received permits as structures accessory to a residence, however,
raises the question of whether an apartment constructed inside can be classified as a "farm labor
camp." Typically, an apartment in an accessory structure would be identified as an "accessory
apartment." A "farm labor camp" implies there is a farm and agricultural activity rather than a use
that is accessory to the residence. Thus, it seems the applicant is signifying a change of use of the
new bams from residential to agricultural. Bams for agricultural use are subject to site plan
approval.
It should be determined whether the farm labor camp special exception is the only alternative to
achieve the goal of having an apartment in the barn. If"farm labor camp" is the route chosen, it
seems the proper course of action is to establish the barns as "agricultural buildings" rather than
accessory residential. To that end, the applicant would need to demonstrate that they meet the test
for "bona fide agriculture" as provided by New York State Agriculture and Markets law, and
apply in the Building Department for a change of use, which in turn will initiate the site plan
process. Both processes (special exception and site plan) could run concurrently.

Dear Ms. Weisman:
In accord with the provisions of Chapter 280-13 B.(9) the owner is seeking to establish a groom's
quarters in an existing barn for the purpose of supporting the residential/agricultural use of the
property. In accordance with past discussions with the Building Department, this section of the
Town Code apparently provides the closest fit within which an applicant may propose such a use.
The parcel contains some 77+ acres, the majority of which is devoted to horse paddocks and
exemise areas. Three barns currently in the final stages of completion contain stabling facilities
for 60 horses. In the middle barn, within the second floor central gable, there exists sufficient
room to establish an apartment of some 1195 SF to provide for 24 hour on-site supervision of the
horse farm.
The structures on this property are shown on the attached plan entitled "Survey" prepared by
Barrett Bonacci & Van Weele, PC last revised 11/17/10. The floor plans for the barn are shown
on the set of architectural plans entitled "Indian Neck - Barn A: PLANS; ELEVATIONS; and
UPPER LEVEL PLAN W/APARTMENT" prepared by Fairfax and Sammons dated August 14,
2008. Photographs accompanying the application depict the middle barn from three perspectives;
a view of the closest abutting residence, some 500+ feet distant; two views of the second level
showing the central bay south gable and west hay lott; a view to the easterly showing the farm
area entrance drive.
No change in the building footprint or any other changes to this site are proposed for this
accessory use. Sufficient parking area exists on the north side of this barn as shown on the survey.

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before December 20th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to al_l owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable1 you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
hearing, prov d n.q the returned letter to us as soon as possible;
AND not later than December 27th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
green/white receipts postmarked by the Post Office. When the green signature cards are
returned to you later by the Post Office, please mail or deliver them to us before the scheduled
hearing. If any envelope is returned "undeliverable", please advise this office as soon as
possible. If any signature card is not returned, please advise the Board during the hearing and
provide the card (when available). These will be kept in the permanent record as proof of all
Notices.
2) Not Later December 29th: Please make arrangements to place the enclosed Poster on a
signboard such as cardboard, plywood or other material, posting it at the subject property seven
(7) days (or more) prior to hearing. (It is the applicant/agents responsibility to maintain sign
until Public Hearing) Securely place the sign on your property facing the street, not more than
10 feet from the front property line bordering the street. If you border more than one street or
roadway, an extra sign is supplied for posting on both front yards. Please deliver or mail your
Affidavit of Posting for receipt by our office before January 4, 2011.
If you are not able to meet the deadlines stated in this letter, please contact us promptly. Thank
