En-Consultants, Inc. on behalf of BRENDA HELIES & PATRIClA COLAGIURI requests a
Wetland Permit to construct approx. 77' Iow-profile vinyl groin in place of +/-95' timber groin by
replacing (in-place) +/-77' functional portion of existing groin and removing most seaward 18' of
existing groin located seaward of ALW. Located: 2500 Park Ave., Matttiuck. SCTM#123-8-13
The ~)roposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the following Policy Standards and therefore is
CONSISTENT with the LWRP.
This recommendation was based on the following.
Policy Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures tc minimize losses of human life and structures from
flooding and erosion hazards are suggested:
Use hard structural erosion protection measures for control of erosion only
where:
Construction of a hard structure is the only practical desiqn consideration
and is essential to protectinq the principal us~,
The principal use is residential. The fetch and exposure of the
location warrant the use of a hardened control structure to slow and
trap the west-east migrating sand and re-nourish the beaches.
The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
It is recommended to improve access along the foreshore, that
design elements (lower top elevation, stairs) be considered to
accomplish such.
b. based on sound enqineerin.q practices
Practical veqetative methods have been included in the proiect desiqn
and implementation.
Due to the elevation of the grade (beach) and tidal exposure, the use
of vegetation within this area is not a practical erosion control
method.

It is strongly recommended that the groin field be reviewed in its entirety and not as
individual groins for a long-term solution to protecting the residential structures along
this dynamic shoreline.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Attached please find an LWRP Consistency Assessment Form, which is being submitted
together with an application to modify the captioned Wetlands Permit.
I have indicated that ail policies are "Not Applicable" because pursuant to Town Code §268-5
("Review of Actions") and the corresponding definitions of "action" and "minor action" by
§286-3 ("Definitions"), the proposed in-place groin replacement meet the following definitions
of minor actions and are thus not subject to waterfront consistency review pursuant to Chapter
268:
"A. Maintenance or repair involving no substantial changes in an existing structure or
facility;" and
"B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site, including upgrading buildings to meet building or fire code, except for
structures in areas designated by the Coastal Erosion Hazard Area (CEHA) where
structures may not be replaced, rehabilitated, or reconstructed without a permit."

Before answering the questions in Section C, the preparer of this form should review the exempt

Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ listing both supporting and non-
