Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: April 16, 2010 Re: Proposed Wetland Permit for FOR THE LOVE OF FAMILY, LLC SCTM#1000-104-3-16.1 En-Consultants, Inc. on behalf of FOR THE LOVE OF FAMILY, LLC requests a Wetland Permit to demolish and remove existing two-story dwelling and appurtenances and construct a two-story, one-family dwelling with attached garage, pomhes, decks, and patio, with a new pervious gravel driveway, and a drainage system of leaders, gutters, and drywells; remove existing sanitary system and install new, upgraded sanitary system at least 135' from wetlands; and establish a variable width (min. 50'), approx. 31,000 sf. non-disturbance buffer. Located: 9205 Skunk Lane, Cutchogue. SCTM#104-3-16.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Establishment ora permanent nondisturbance buffer between the developed portion of the land and all surrounding surface waters will further ensure consistency with Policy 5 by serving to limit the area over which landscape chemicals would be applied and to maintain an expansive area over which surface water runoff can be absorbed & filtered. The new dwelling, although considerably larger than the existing, will be located farther from Hog Neck Bay than the existing house and only partially (approximately 840 square feet of structure) within Chapter 275 jurisdiction relative to the dredged channel to the north. The project incorporates various mitigation measures to ensure protection of the function and value &the surrounding ecosystem and thus consistency with Policy 6, including 1) removal of an existing sanitary system located less than 100 feet from wetlands and installation of an upgraded sanitary system located at least 135 feet from wetlands and thus beyond Chapter 275 jurisdiction; 2) installation of a drainage system of leaders, gutters, and drywells to capture and recharge roof runoff from the new dwelling; and 3) establishment of an approximately 31,000 square-foot non-disturbance buffer (roughly one-quarter of the 2.8-acre parcel), which serves to a) provide and maintain wildlife habitat; b) to limit and set back from wetlands the area of the property developed with structures and chemical-dependent landscape vegetation; and c) provide an expansive area that serves both as a sink and filter for stormwater runoff and contaminants contained therein.
