Name of Owner: Charles Curtis & Jane ltarvey ZBA File # REASONS FOR APPEAL (additional sheets mar be used with preparer's signature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: This is the owner's vacation home. The existing deck is to be reconstructed and the owner wishes to roof over the deck due to the summer heat which makes the deck unusable in the summer. The deck is to be extended by two feet to accommodate standard sized outdoor deck furniture and make deck more functional. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue~ other than an area variance, because: The deck addition to the existing house can not be located in any other location than the back of the existing house, which because the house is at an angle, requires a front yard variance. The house is angled and the deck and roof are in line with the existing house. The addition and roof are all more than 100 feet from the wetlands. (3) The amount of relief requested is not substantial because: The existing houses remains, as is, on Reservoir road and the existing deck will be replaced with a covered porch. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The deck replacement with a covered deck is a minimal improvement, the house will have roof drainage and is more than 100 feet from wetlands. (5) Has the alleged difficulty been self-created? )Yes, or (X)No The house is preexisting nonconforming Are there Covenants and Restrictions concerning this land: XNo. ~yes Iolease furnish coov).
