Meeting Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 4:30
PM with the Pledge of Allegiance to the Flag.

SUPERVISOR RUSSELL: Please rise and join with me in the Pledge of Allegiance. Thank
you. I just want to clarify for everyone, the screen you see there is actually part of our new video
conferencing setup, so that we can actually host Town Board meetings live on Fishers Island.
They won't be participating tonight, they did participate, Louisa Evans participated today at
work session via this means. And we are looking forward to rolling it out formally in two weeks.
Now, the agenda is out, does anybody have any comments on the agenda? Hearing none.

resolution of the Fishers Island Ferry District Board of Commissioners dated January 29, 2011
that reads as follows:
RESOLVED that the firm of Lamb & Bamosky, LLP (L&B) be retained to conduct the
necessary legal research and completion of a written legal opinion concerning the rights of

resolution at their January 19, 2011 monthly meeting to hire as a part time deckhand Angela
Moore effective January 20, 2011 and
WHEREAS the Town Board of the Town of Southold is required to approve appointments and
salary adjustments of employees of the Fishers Island Ferry District now therefore be it
RESOLVED that the Town Board of the Town of Southold hereby appoints Angela Moore~ of
New London~ CT~ to the position of a part time deckhand for the Fishers Island Ferry
District, effective January 20, 2011 at a rate of $9.50 per hour.

RESOLVED that the Town Board of the Town of Southold hereby grants permission to The
National Multiple Sclerosis Society to use the following route for its 2011 Bike MS Twin
Forks Ride on September 10~ 2011: east from town line on Route 48, to Mill Road, Soundview
Avenue, Lighthouse Road, Old North Road, Youngs Avenue, Route 48, Route 25 to Orient
Point, west on Route 25 to Front Street to Third Street and onto the ferry, provided they file with
the Town Clerk a One Million Dollar Certificate of Insurance naming the Town of Southold as
an additional insured and contact Capt. Flatley upon receipt of the approval of this resolution to
coordinate traffic control. Support is for this year only, as the Southold Town Board continues to
evaluate the use of town roads.

York Organ Donor Network (NYODN) to hold a 35 mile North Shore Bike Tour fundraiser
to begin at Osprey Dominion Winery in Peconic, ride to Orient Point and back to the winery on
Sunday~ May 22~ 2011 beginning at 9:00AM, provided they file with the Town Clerk a One
Million Dollar Certificate of Insurance naming the Town of Southold as an additional insured
and contact Capt. Flatley upon receipt of the approval of this resolution to coordinate traffic
control. All fees shall be waived. Support is for this year only, as the Southold Town Board

WHEREAS, the Town of Southold has amended the Town's Local Waterfront Revitalization
Program by amending the Town's Waterfront Consistency Review Law in cooperation with the
New York State Department of State in accordance with the provisions of Executive Law,
Article 42; and
WHEREAS, the Town of Southold has amended the Town's Local Waterfront Revitalization
Program to reflect changes made to the maps and narratives for the State's Significant Coastal
Fish and Wildlife Habitats within the Town's Local Waterfront Revitalization Area; and
WHEREAS, the Town Board, as lead agency, has prepared and evaluated an Environmental
Assessment Form concerning the action of adopting the Local Waterfront Revitalization
Program Amendment in accordance with the requirements of the State Environmental Quality
Review Act and Part 617 of the implementing regulations of Article 8 of the New York State
Environmental Conservation Law, and determined that there will be no anticipated adverse
impacts upon natural, institutional, economic, developmental, and social resources of the Town,
and, therefore, authorizes Supervisor Scott A. Russell to execute the Environmental Assessment
Form and the Negative Declaration;
NOW, THEREFORE, BE IT RESOLVED that the Local Waterfront Revitalization Program
Amendment for the Town of Southold is accepted by the Town Board as complete and ready for
public review and shall be submitted to the New York State Department of State for its review
by State, Federal and Regional agencies pursuant to the provisions of Article 42 of the New York
State Executive Law; and be it further
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the

COUNCILMAN RULAND: Mr. Supervisor, I will need to recuse myself on that vote as Mr.
Wolbert is my nephew.
SUPERVISOR RUSSELL: I will just clarify for everyone, those three positions were part of the
budget that was adopted for 2011. There has been a lot of depletion of forces in the highway
department because of retirement incentives that had first been offered locally and then
participation a year later in the New York State retirement incentive. These are just three
positions of the many that have been lost here.

SUPERVISOR RUSSELL:
Board first? Mr. Wacker?
Now, with that being said, who would like to address the Town
Tim Wacker, Cutchogue
TIM WACKER: I am sure you can hear me, I have spoken with Scott very quickly about this
and I mentioned to Albert and I am appearing to you all completely unprepared. I was talking to
a few folks about the prospect of having oyster reefs created in some of our creeks. I have got a
few in mine in particular. The, I managed to recruit the assistance of a fellow from the
University of New Hampshire who is right now installing these oyster reefs in the Hudson river,
he was installing them in New Jersey and Jamaica bay as well in Queens. And when I showed
him google earth images of the creeks that I had in mind, he said they were ideally suited for
oyster reefs. You might wonder why you want to put oyster reefs in these creeks. Road runoff is
a chronic problem here that I am sure every Board member has dealt with. Oyster reefs and the
oysters that live in these reefs have an enormous capacity for filtering water and they are
particularly, and they do particularly well in high nutrient waters such as the creeks in this area.
The creeks are infiltrated both by farm and regular residential impacts and the reefs are very
effective, I should say the oysters are very effective at filtering. The oysters have what is called
a limiting factor and that is substratum, they have nothing to attach to and while you will
certainly see random collections of oysters in various creeks throughout the area, an oyster reef is
actually establishing the substratum onto which bay view oysters can attach. These things are all
the rage right now. They are going in everywhere, along the Gulf coast, down in the Gulf of

Mexico, they are in the Gulf of Maine. Virginia, Florida, certainly in New Jersey, Maryland,
everywhere. There is a lot going on now in Chesapeake Bay. I didn't see much happening in
this regard in this area. I didn't want to jump the gun and you know, just say why don't we do
this until I had spoken to this fellow at UNH, a fellow by the name of Ray (inaudible) who is
accomplished and he has reestablished oyster reefs in a water body in New Hampshire called the
Great Bay and he has had tremendous success with it. He has got kind of a (inaudible). When
he encouraged me, I figured I would come to you all. The reason I am here is to feel out the
Board on the prospect of Southold becoming, I don't know if it is a partner or sponsoring
agency, an official body that would back either any grants application that may be sought.
Heaven forbid, the Town itself may find a few grand kicking around that it may want to
contribute to this ....
COUNCILMAN ORLANDO: Now these are man-made reefs?
MR. WACKER: They involve the dropping of shell and then the shells have to be treated for six
months but they are man-made in that it is shell that is placed...
COUNCILMAN ORLANDO: And the reef consists of shells?
MR. WACKER: But then when you drop what is called spat, baby oysters, on top of that, they
fix to the shell and they are particularly attuned to fixing to other calcium substratum such as
shells and so that is why shells are used, it doesn't take a great deal of time for these reefs to
establish themselves. There are drawbacks, these reefs are, you don't exactly want to be water
skiing and hit one of these things. However, the places that I am considering are extremely low
traffic, specifically Wickham creek, there is an area in front of Wickham creek that is ideally
suited for it, Little Creek on the far side of Nassau Point causeway is also, there is minimal, if
any recreational or for that matter boat traffic whatsoever and I am thinking of other locations in
and around the East Creek branching, although those would have to be considered more
carefully. Ray (inaudible) told me that these things come in around $50,000 an acre but he said
two pilot reefs at about, whatever the ¼ acre each, I was thinking Wickham Creek and Little
Creek would be two pilots, they would be easy to establish. And even that figure, you know, we
can start eating away at that through finding shell that is available for free. I am guessing I could
probably turn to Kenny Homan at Brauns to see if he has got anything kicking around. There are
a lot of oyster companies out here that are selling through retail. It is something that this area
lends itself perfectly for this particular installation and the other consideration the Board might
want to bear in mind is I am sure there are various retention basin projects going on. Road
runoff mitigation projects that aren't cheap, that certainly compared to the oyster reefs are much
more expensive and the oyster reefs are astonishingly successful at filtering the water and they
also bring the added benefit of once they establish themselves, they provide, the substratum
provides a more diverse area for little animals to live, if you can imagine that. It doesn't take a
lot of imagination to think how that could improve not just oyster reefs in filtering the water but
the bio-diversity of the creeks themselves. So here I am thinking, if the Board wants to kick it
around at its next work session, I don't know, the financing is something, it is not a great deal of
money, I don't know whether you would have it or not, if the town could consider in kind
services, maybe that is something else. I will have my ducks more in a row when I make a few

more phone calls on it, I originally had just planned on sitting down with Scott and floating this
by him and maybe you all could give me some instruction as to what my next move would be.
COUNCILMAN ORLANDO: Could you clarify the cost? Was it $50,000 per acre or ¼ acre?
MR. WACKER: Per acre. Ray was talking about two pilots that are ¼ acre each and he said
that these things also have a propensity to spread. They are like, literally the oyster reef....
COUNCILMAN ORLANDO: So it is a $25,000 project you are looking at. Two quarter acres.
MR. WACKER: If that. Ray told me he might be able to get the spat for free, we might be able
to get volunteers, I am sorry. What did you say? $25,000 for a half acre ....
COUNCILMAN ORLANDO: Two quarters.
SUPERVISOR RUSSELL: Yes, we actually have a fairly robust spat program now. I think the
thing is to get some key players in the room and talk about it. I happen to think it is a great idea,
so I am not as maybe as well versed in terms of biology as Albert is but certainly it is an idea we
would like to sit down and talk about. Absolutely.
COUNCILMAN KRUPSKI: It is intriguing.
MR. WACKER: My purpose is tonight, if I could say to the agencies whatever granting
agencies there are involved, that Southold Town has indicated a preliminary support as a
sponsoring entity, I would leave here with what I came here for.
SUPERVISOR RUSSELL: Well, I would appreciate and I think this Board, you will find this
Board very accommodating to yourself and if you can get a hold of the professor and anybody
else that you would like to bring along to talk about it further.
MR. WACKER: That will be in (inaudible). I have got the, Professor (inaudible) he is one of
the foremost experts in this and I was thrilled when he got on board and if he wasn't on board I
wouldn't be here tonight.
SUPERVISOR RUSSELL: No.
MR. WACKER: And he additionally said (inaudible) these reefs were once historically
everywhere out here. To my understanding, these things were wiped out so early on in settling
this area that nobody really knows what kind of proliferation they had. If you all have a moment
and I am sure most of you, if not all of you, are well-versed in internet searches, take a moment
and look up oyster filtering capacity. There is some statistic that is frequently kicked around
about how the oysters in the Chesapeake Bay once filtered the entirety of the Bay within a course
of a couple of days. They are a very potent, natural curb of water pollution.
COUNCILMAN KRUPSKI: And one person you want to include is Jim King, because he is

very familiar with the oysters in Mattituck inlet. They did have a disease that came up the coast
that destroyed the population, so you might want to talk to him about how that could possibly
affect, if we did a project like that, what risk we would have?
MR. WACKER: That is an excellent point. There are other flies in the ointment. The DEC has
closed, certainly Wickham Creek is closed to shellfishing and they have a concern that if you
establish programs like this and you establish a thriving oyster population, what is to keep people
from going down and eating these oysters. And in New Jersey, as a matter of fact, one of these
programs was, the state environmental agency in Jersey put the kibosh on it because they were
concerned of that very thing. So we have to smooth a few things out. I am not sum that one of
them won't be a fatal flaw. But however, the support of the Board ....
SUPERVISOR RUSSELL: Can I just say, last night we actually had the public meeting on the
economic chapter of the comprehensive plan that is underway and each table in this work session
was assigned a different task. Actually I was assigned to the group that was discussing the
marine industries and the fisheries and the natural resources. And one of the suggestions of that
economic chapter was to partner with various governmental and educational organizations to
help bring that back. This is exactly what that point tried to underscore last night. So I think it is
completely consistent with everything we have been trying to do. No doubt we will probably run
into some roadblocks as we go but we have to start with at the very least a discussion with some
of these entities like the DEC and see where we can take it.
MR. WACKER: Well, in response to your remarks, Albert, I will call Jim immediately. And
additionally, Ray has been for the past 10 years, these disease resistant oysters. And so his spat
are as near as he can tell, disease resistant. I don't know i£he has the spat to provide, he had
mentioned something about somebody having half a million free spat. So there are so many
variables involved here in terms of the cost and like I say, something could come out and put the
kibosh on it right away but having town support and you know, at least a verbal commitment
(inaudible). Thanks a lot. Perfect.

BENJA SCHWARTZ: Good evening. How are you doing? I missed you this morning. What
was the West Creek study agenda item?
SUPERVISOR RUSSELL: That was to discuss reasons for the DEC closing. Jay Bredemeyer
from the Trustees did a very thorough briefing to the Town Board on some of the causes, pet
waste, etc. And then some of, the Trustees had recommended some actions that we need to take
to try to turn that creek around.
MR. SCHWARTZ: Is that West Creek by Wickham?
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: Thank you. I forgot to mention, my name is Benja Schwartz from
Cutchogue. What about the Walz decision that was on the agenda?
SUPERVISOR RUSSELL: That was to discuss the decision of some years back that the Town
Board would like to take up some of the limiting factors that, that decision actually, the town,
what I think was evaluating the benefits of the decision and then some of the drawbacks and then
maybe legislating some easier language in the code so that every change that wants to be made to
a house that is in a pre-existing, non-conforming location doesn't have to go through a very long
and arduous review process.
COUNCILMAN TALBOT: Going to go back to code committee for discussion.
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: Then I think the next item said draft local law. That is all it says on the
agenda.
COUNCILMAN KRUPSKI: Then on the next page it continues.
MR. SCHWARTZ: Oh, that ....
SUPERVISOR RUSSELL: That was the licensing for the carters. We are actually having a
community meeting to discuss the issue of solid waste plan that the town is required to follow by
DEC permit. We set the meeting for February 24 at 7:00 PM. It is going to be in this room.
MR. SCHWARTZ: Inaudible.
SUPERVISOR RUSSELL: February 24. We are going to, you know, I think there is a lot of
misunderstanding out there and we are going to clarify for everyone exactly what the town's
position is and why. And also where we can go as a community from here.

SUPERVISOR RUSSELL: Possibility. That has been put on the table.
MR. SCHWARTZ: I have got to say, item 7 on the agenda, you probably had a good reason to
go into executive session but you didn't put a good reason on the agenda. The agenda says that
you are going to discuss the value of a property that the town might purchase for the preservation
department. What the law says is that you can go into executive session to discuss potential
purchase if and only is there is a reason to believe that that property, discussion of buying that
property might significantly affect its value. Cost the public more money. I just, can we at least
be, if you have, you seem to have made a decision that every property purchase, every potential
property purchase is something that could affect its value and you are going to hold them in
executive session. I am not sure whether that is right or wrong but if that is what you want to do,
fine. But to do it legally, you need to make it clear what, why, what you are thinking every time
you go into executive session. That is what the meeting is for. It talks about contract
negotiations in item number 8, what contract were you, I think you have an obligation to say
what contract. You can't just...
COUNCILMAN RULAND: I believe when we went into executive session, that was stated.
MR. SCHWARTZ: Could you remind, because you know...
COUNCILMAN RULAND: Town of Southold and the police benevolent association. Town of
Southold and the North Fork Animal Welfare League.
MR. SCHWARTZ: The animal welfare league, I am not sure that qualifies as a contract that is
eligible for discussion in executive session. You might want to check on that, I don't believe it
is.
COUNCILMAN RULAND: My opinion would be, if you are discussing terms and conditions
of a contract that are going to affect its value, definitely. Since we adopted a resolution tonight
to go out for RFP's, I don't think that the discussion of the values that were involved, even
though they are public information, from our point of view, I don't think that we should discuss
them in public. My opinion.
MR. SCHWARTZ: Okay. What is an economic development committee? 1 know you gave a
explanation at the meeting last night, Scott, but my brain was slower than your explanation.
SUPERVISOR RUSSELL: The way it was presented as part of the draft economic chapter was
to identify the goals of the town in terms of economic stimulating the downtowns, creating a
more robust maritime heritage. The whole thing. The idea that the economic development
committee would be a committee that would be a steering committee that would see to those
tasks and those goals. That would be a, presumably, volunteer committee of professionals, a lot
of wonderful, talented retired help out here in Southold Town. To help us achieve those goals as
outlined in that plan.

MR. SCHWARTZ: I know, I thought that was what we were supposed to be doing in the
comprehensive plan process and I also thought that that was an ongoing thing the Town Board
does but I think there were some things that weren't said at that meeting last night and I would
like to take the opportunity here. What kind of businesses, there has been a lot of talk with this
economic chapter about what kind of businesses we want in town. There is a sign at A1
Kmpski's farmstand. It says local farmer, local food. I think, is that ....
COUNCILMAN KRUPSKI: Yes.
MR. SCHWARTZ: Good sign.
COUNCILMAN KRUPSKI: Thank you.
MR. SCHWARTZ: Principle by local. We want businesses that are going supply the needs of
the local people. I have no quibble with that. But I think that is just one principle. I think we
can go a lot further than that.
COUNCILMAN KRUPSKI: Well, I think the purpose of the economic chapter in the
comprehensive plan is to give the town its general direction. And if we form this economic
committee, they can work on specific initiatives and specific ideas. Some that will come from
the community and some that will come from the Town Board. And they can put more effort
into the details. All these things come down to the details.
MR. SCHWARTZ: There are details and then there are general principles and I think we are a
little short on principles now, so I would like to discuss with you some other principles. Other
than buy local, what kind of businesses, I have heard a lot of talk that we don't want to have
corporate franchises in town. But that is a negative, let's think positive and I think the issue, too,
became very clear at the business table last night was that while the businesses in town want
help, they don't want the town telling them what to do. They don't want the town to be
controlling them, they just want assistance, so how can a government assist without controlling?
But the first step I think is to identify the types of business that we would like to see more of or
attract or help. Buy local is good. You know, there was in terms of principles, it was almost set
up at the meeting last night that there was, there was a business, it was an economic chapter,
develop business and then there was a table that was to balance the environment and when you
talk about balance between the environment and the economy, it almost gets back to one or the
other in an adversarial situation between them. I don't see it that way. Having grown up in the
environmental movement, I think what we, there are environmental businesses that, that if we
take care of our environment, I think that will support business in town. So I think that
businesses that will help us to save what is left, very important, businesses that we can attract or
develop to enlarge that are not going to have negative environmental impacts. (Inaudible) that
we can put up with buy local, businesses that will save what is left won't hurt anything, then
maybe certain types of businesses could restore what we had in the old days. Maybe we could
find a way to encourage the types of farmstands that we used to have. Little, small farmstands
that had nice fresh vegetables that were very easy to get to and we didn't all have to go to the

one. Businesses that respond to what is new. I think we have to look into what didn't exist in
the past but exists now and I think we have to respond to that. And then finally businesses that
will imagine what is unknown. And I think we had a good example of that with this oyster reef.
You know, I don't know what it will cost but it will be sort of a business. Anyway, I thought
that was very exciting tonight that we had someone come in and propose that. In terms of the
business, I heard some very upsetting comments last night from some of the businessmen, that
we know that you are talking about planning to control traffic and for less traffic but we are
businessmen, we want more traffic the better. More traffic more business. I think there is a little
problem with that kind of thinking and one of the things I would like to see the comprehensive
plan do is to make it clear, why that kind of thinking is not productive or supportive for our
community.
COUNCILMAN ORLANDO: I don't recall someone last night promoting traffic. I do recall
that one group did, they were like in a quandary, they were trying to increase tourism but not to
affect traffic, so they were kind of, that bittersweet thing.
MR. SCHWARTZ: Not everything that was discussed was discussed with, there was, it was
broken up into five sections so, if you didn't hear that, you were not in that section at that time.
But what was discussed across the board in all the sections was to essentially to grow the
economy. It was very clear that everybody wanted to grow the economy. Well, there are two
ways you can grow the economy. There are two ways you can do economic development. One
way is to make more money, make a bigger business, the other way is to, instead of making the
pie bigger, dividing the pie more equally and I think that is the, one of the things that government
could do, if we could figure out a way to facilitate and to encourage dividing the pie more
equally, that would protect our local identity and local economy. Growing the pie is an
invitation to multi-national corporations and franchises to come in and take our money and take
it elsewhere. I don't see anything in the economic proposed draft of the economic chapter that
addresses the basic principles of what kind of economic development there will be. Now you
can appoint a committee but to expect a committee to you know, when you appoint a committee
you are supposed to charge that committee with its purpose and what it is supposed to do. And
those kinds of principles I think need to be established prior to adding and growing the town
government. In addition to that, I don't know if we need an economic development committee,
we might, we might not but I thought of an alternative way to study economic development and
promote it in town. People who have contacted the group for Cutchogue have brought to our
attention that the recreation department is essentially been doing the same thing that they have
been doing for the last 20 years or whatever, they are not really developing. Well, one thing you
could do, I think that would help would be just to rename the departments. Instead of the
recreation department, recreation education department. Because the department is already
giving classes. Renaming it, that would be a (inaudible) but then you could direct the, whoever
is in charge down there to try and develop that portion of the department. In, you know, one
thing you could do is you could try to attract a professor, teacher to come in, someone to give a
class in economic development. People who, you know, last night I heard they said oh, we need
an economic development committee and we need another proposal in the plan I think is to have
a business incubator and there were suggestions at that meeting. I don't know if you were in that
group, that Southold Town can't do that effectively alone, it needs to be a regional solution.

Well, regional solutions already exist and maybe we should work with them but I think we can
do it ourselves and I think we could do it in-house. I think we could have a, but we don't need to
create another committee or another part of Southold Town government. We already have the
department that is supposed to be handling that kind of thing and I would suggest to you that to
go one step further, take the recreation education department and, they are also kind of now
involved to some extent with entertainment, I believe.
COUNCILMAN ORLANDO: They have educational programs. It is not a lot. But they have
some, they have computers, they have guitar and they have a musical, you know, instrument
classes. So that is educational.
MR. SCHWARTZ: But they call it just the recreation department. So great documentary last
night on (inaudible). Are you familiar with Chautauqua?
COUNCILMAN ORLANDO: No.
MR. SCHWARTZ: Are you familiar with Chautauqua? No, no, Chautauqua is a national
treasure. In the western most part of New York State, up in the west, north west most comer of
New York State. Away from everything. But people have been going there for vacations and
for summers for decades, maybe centuries. Even when people didn't feel like it was right to go
on vacation, just take recreation, they would go there because they would get education as well
as recreation. And I forget which president went to visit there and brought it out as a national
thing but then it spread but we could have Cutchogue Chautauqua, I mean Southold Town
Chautauqua here. Not, it is not at all, you know, what do you all think about the winterfest? I
never thought we would get those kinds of entertainers in Southold. Is the town playing any role
in that program? Is the town involved in it?
SUPERVISOR RUSSELL: We sponsor the North Fork Promotion Council, so any role they
have in promoting that event, we would be directly involved in that because we sponsor that
organization.
MR. SCHWARTZ: I think the recreation department maybe could get involved in that, too, if it
was a little more ambitious. I think there is a lot it could do and it could help with economic
development. There is a lot of potential to even just develop the current programs, adding new
programs. The summer programs. Well, again I just really want to stress that I am a little
concerned about those little more, more, grow, grow, bigger idea. I know that's the way things
have always been but you know, this year, rather than grow the salaries of the municipal
officials, you decided to keep them where they are but I suggested an alternative. Probably none
of you remember that because you don't really listen much when I talk. At least you don't, you
know, do you remember what I suggested, Scott? Because you said you would take it up next
year.
SUPERVISOR RUSSELL: I think you recommended to give everyone the same cash
equivalent.

MR. SCHWARTZ: Very good. Very good. Thank you. Not exactly but right now, the way it is
right now, the increases proposed were based on salary, so the individuals who are making ....
SUPERVISOR RUSSELL: More get more.
MR. SCHWARTZ: Five times as much are getting five times as much increase. The town
councilmen, most of them would only have seen a couple of hundred dollar increase where the
Supervisor and the Clerk would have seen a couple thousand dollar increase. Further increasing
the disparities that already exist. And I think our government might work better if we found a
way to reverse that trend. And try to divide the pie more equally.
COUNCILMAN ORLANDO: The egg timer is almost up, Benja. Hurry up.
COUNCILMAN KRUPSKI: He is talking about pie, it is dinnertime.
MR. SCHWARTZ: Well, not only that but the weather is bad tonight, so I will (inaudible). You
know, I was a little, the last thing I wanted to mention, last week, two weeks ago I wasn't here
and you finished the meeting in a half hour. And you all congratulated yourselves, how quick
you, so you know when you keep bugging me about how long I am talking, I know I have been
talking too long. I talk too long because I don't think that you are listening, I don't get, if you
would say to me, I know what you are talking about, this is what you said, I agree or I don't
agree or whatever, then I wouldn't be going on and on. I am going to try to be brief in the future
but I don't think the problem is people going on and on, not when we are having half hour
meetings. You know, I think we should be taking longer time and would like to see you-all take
some time at every meeting to discuss what happened in the work session. To discuss other
issues of importance to this town that the people should know about, you know, and we vote for
you but if we don't know what you are doing on a day to day basis, then we can't really make
intelligent choices in who to elect next year or at all.
COUNCILMAN ORLANDO: That is actually not a bad idea, Benja. To go down the agenda
that is on, the agenda here, that we did in the work session. Real brief. You know, not an hour
on each subject, just touch on each one.
COUNCILMAN KRUPSKI: Because we spend hours at the work session discussing in great
detail, sometimes unbelievably great detail, all these items and then, it is true, when we come to
the meeting, all in favor aye and then we move on because it has already been discussed and it
has been hashed out.
MR. SCHWARTZ: The nature of this meeting, they call it business meeting or whatever.
SUPERVISOR RUSSELL: Perfunctory component. But let me just explain, I think we try and
go to great lengths to get community input and get those types of discussions going. We have
hamlet meetings, we are setting up a few more in the near future, we go out to the community.
We have those informal settings for people. Much of the community isn't as comfortable as you
might be in a televised event, so we try to get those issues out to the public but you know, there

might be something set forth, what Albert said was unbelievable detail. What came to my mind
was excruciating detail but neither here nor there, point well taken on that. I certainly think that
you have a good point there.

SUPERVISOR RUSSELL: Would anybody else like to address the Town Board at this time.'?
Supt of Highways Peter Harris
PETER HARRIS, HIGHWAY SUPERiNTENDENT: Good afternoon, members of the Board.
Peter Harris, Superintendent of Highways, Town of Southold. The reason why I came this
afternoon, early today, in fact each one of you members had received I believe a request about
me attending and going to the CON EXPO equipment exposition. This exposition is done once
every three or four years, it is not a yearly thing and the fact that it has to due with heavy
equipment and the fact because we have budgeted $280,000 for the highway department to
purchase a new payloader and skid steer loader this year and the fact that every single
manufacturer is represented there with every piece of machinery that they make at this expo, you
don't talk to salesmen, you talk to factory representatives and the fact that where you have it all
in one place and you can do all you comparisons, if you want to call it a one stop shopping type
deal, I feel the expense of me attending, I think it is a plus for the town, it actually, it saves time,
it saves money because again, you are not dealing with a salesperson, you are dealing with the
people that build the equipment, okay? The fact that I had spoke to the supervisor this afternoon
and he had said the Board members wanted me to come back in two weeks and sit down, it is
important only because of the fact that or transportation and accommodations because this show
is so big, the longer it takes to get approval or disapproval to go, that cuts down the options of
being able to make my reservations so that I can get there and get back. I don't know. I mean,
we are doing the very best we can in highway and this is, this is by no means, it isn't vacation.
In fact, this morning when I brought the paperwork down to Linda Cooper, I even cut the thing
short by a day. I cut the stay down, take the day you get out there, the Friday, I would be getting
up in the morning and tum around, go fight to the airport to get on a plane to come home. So I
have got, the day I get there and the next two days and the third day, you come home. That is
how big this show is. When I was there the last time, I spent eight hours, three days
consecutively, eight hours each day and I never saw the entire show because that is how much,
that is how much equipment is there. Again, we are looking to spend $280,000 this year to buy
equipment that is going to be best suited, the best possible price to get the best possible product.
It is all going to be there and that is why I want to go. Not to go on a vacation, I am going to go
there to look out for the best interest of you people, the best interest of my department and not
have to deal just with sales person rhetoric. You are dealing with the people that manufacture.
You have got a question, you get a straight answer. Like I said, you are not dealing with
salespeople.
COUNCILMAN ORLANDO: Well, Peter, I explained to the Board, in my past life, I went to
many of those trade shows on equipment and they were so valuable to go there and see the
people and see the equipment, the new technology, what you can learn from them. Our only
reservation was, in these economic times to spend $2,000 to send you there. That was the
question. The trade shows are very valuable when you are doing like you said, one stop

shopping, look at ail the equipment, speak to the people, you can make deals there. It is just, the
price just caught us and we said, bring Pete in so we can talk about it. That was the concern. It
wasn't the value of those trade shows.
MR. HARRIS: Vinnie, outside of going to the last CON EXPO, the only other, other than the
Association of Towns, the only places I have ever been is to Albany for advocacy day, to try to
fight for money for the taxpayers, okay? You don't see me putting in to go hem, to go there.
The money is in my budget, the money is budgeted, there is money in there budgeted so it is not
like I am asking you people to come up with extra funds for me to go. The money is in the
budget and every year, in fact, there is normally money, there is always money left over in those
line items because I haven't gone anywhere before. So it is just the case of, I mean, all of you
people up there have your expertise in certain areas. I didn't think any of you ever bought a
payloader or anything like that. Farm equipment is farm equipment. This is industrial
equipment, this is something that I deal with. Okay? And that is why, that is why I feel it is
necessary to go. And when you are spending $280,000 compared to spending $2,000, I think the
$2,000 is, in my opinion, that is money well spent. When you are going to look to make an
investment of $280,000.
COUNCILMAN ORLANDO: It can be. I have been to those trade shows. I have bought
payloaders, super suckers, dump trucks, roll offtrucks, I have been there. I have spent ¼ million
dollars on those things, on vehicles.
MR. HARRIS: So, you know, the facts, like I said, the fact of me to come back in two weeks to
sit down and discuss this, I don't know, I just, I mean we have been working our fannies off, I
don't have to tell you
COUNCILMAN ORLANDO: Yes, you have.
MR. HARRIS: Okay? And this town has performed admirably.
COUNCILMAN ORLANDO: Yes, you have. Thank you to you and your crew.
MR. HARRIS: And if, by going to this thing is going to save this town some money, to get the
best possible product for the least amount of money, that is going to service this town, the best
bang for the buck. I, you know, the thing of it is, I hear people's names go here, go there, go
there and I am not, you know, and I am not saying when these other people go that it is not a
legitimate thing but this is legitimate. This is no fanfare you know, I am not going on a
gambling junket that is for dam sure, I am going there for a reason, if I am allowed to go. And
like I said, $280,000 compared to $1,900 and change, to me, that is a win-win. And that is not
just because I am the person that is going, if I am allowed to go.
COUNCILMAN TALBOT: Pete, that was the question that I had. The money was in the
budget?
MR. HARRIS: Yes.

COUNCILMAN TALBOT: When there was discussion to not allow it to happen, I said well, if
the money is in the budget, then why did we put the money in the budget if we are not going to
let him go to it?
MR. HARRIS: I can't answer that.
SUPERVISOR RUSSELL: I think the issue was that the money in for training and the Town
Board wanted you to come in and explain how this would be pertinent to training. In other
words, the allocation would have been made under the heading of training and the Town Board
wanted you to come back in two weeks. I don't think the Town Board was unfair in saying let
him come back in two weeks. It still gives him plenty of time to book, this still gives him plenty
of time to book. Nobody said no, we said we wanted to hear from you, that is all. Nobody said
no, they wanted to hear from you. And I think we went through this the last time you went and it
worked out fine for you but I think the Town Board, you know, $2,000 in this climate, it is a lot
of money to a lot people and the Town Board had some reservations about that without at least
having the man that is the most affected by the decision be before us to talk about it.
MR. HARRIS: Well, I can appreciate what you said, Mr. Supervisor, but there are a lot things
that over the past year or so that has transpired in this town and personnel, people doing things,
not doing things and nothing, things that were found out and nothing was ever done about it.
And my only thing to that is, there were personnel that had done things that were not according
Hoyle and their only punishment was that they got a raise. Okay? Like I said, I came here to lay
my cards on the table and if the Town Board feels that it is not worth the $2,000 to send me, so
be it, we will just go the old route. By pictures and videos and talk to sales people and let them
do their sales pitch but like I said, it, I am trying to do the best possible job I can that I was
elected to do and ifl didn't feel that this was a worthwhile endeavor, I wouldn't be standing here
right now. I would have just took that you didn't want to act on it and just forget about it but like
I said, I have got $280,000 that this board still has to approve to go out to bond because it is in
the capital budget but if we are going to make a $280,000 investment in Southold Town, I would
like to be able to see it and talk to the people that build it compared to just talking to a sales
person that is going to sell it. That is all.
COUNCILMAN RULAND: Well, cutting fight to the chase, Pete, do you think if we spent the
approximately $2,000, will we recoup the $2,000 when we purchase the equipment from what
we learn?
MR. HARRIS: I would have to say yes, only for the simple fact that the technology that is out
there, Bill and the fact that there are certain manufacturers out there that would lead you to
believe that because it says a three letter word, CAT or other ones that have big time names,
there are other manufacturers out there that probably have the same technology, I mean, I have
just seen at our landfill, I shouldn't call it landfill, our solid waste management area where when
Caterpillar compared to this one was $50,000-$60,000 more for the exact same item, same size,
same engine displacement, same everything but because it had a three letter word that everybody
knows, CAT, oh, well, if it is a CAT it has got to be the best. Well, that is not always the case.

It is not always the case. So this is why you go out, this is why you go and you have the time to
go and stand there and talk with these people, get literature and visit every single one and listen,
if you have, if you find out from this one over here, then you go back and say well, listen I was
over talking to these people over here and they told me and they showed me and you can go back
and say did I miss something, do you have the same capability, does your machine have the same
capability. It is a matter, like I said, it is all in one big area so that you have the opportunity, if
you have a question, you can go talk to a face and not just rely on what is printed with glossy
color print.
COUNCILMAN RULAND: I would be much more wanting to know which ones had the letters
DOG so that we didn't end up with one of them, alright, and I assume that is how you would
learn it, by going to, the other question I have for you is, how many people such as yourself
would be at something like this? In other words, you have got to be able to interact with other, I
assume. How many people? A lot of people?
MR. HARRIS: That go to this?
COUNCILMAN RULAND: Such as yourself?.
MR. HARRIS: When I went the last time, there were three other highway superintendent's from
Long Island there. And they were there looking at specific items, okay? Once you get, once, if
they got done looking at the specific items that they were there researching on, okay, then you
can go around, like I said Bill, I was there for three consecutive days and I spent eight hours and
I still didn't see the entire show. Okay?
COUNCILMAN RULAND: I think that, I am only going to say two things, one, I know you
understand our side of the thing as well but I am more enlightened by what you have said and the
fact that we interacted and asking questions and listening to you respond than I was from the
paper that you submitted and as Councilman Talbot said, you know, he raised some points this
morning, alright, which raised questions and the only way to raise questions would be to have
you come in and talk about them. I thought about this now and yes, I do believe that we could
recoup the $2,000 when we go to purchase the machine by what you will learn when you go
there, alright? Because you and I both know that your hands are going to be somewhat tied
when you go to purchase because you only have avenues of competitively good contracts from
state and county or you are going out there on your own, well, I agree with you that knowing
what you want is a big thing and in a machine that price, it is even bigger, alright? Because a lot
of money involved there and the money is not ours and I think that is another point that we all
are painfully aware of, that this money isn't ours but I would say from a practical standpoint
while this might have not been the greatest venue to have this discussion alright, the fact that you
showed up and we are having this discussion, leads me to believe, I for one am willing to revisit
resolution 130 based on what I have learned, alright. And I guess more than anything it shows us
that no matter how hard we try on communication, we will always need to strive to do it better
because we are living in an age, technological age, whatever, it is the information age no matter
what, it still is. And what you know determines what we decide because we are only as good in
a lot of ways as the information that we get because we can't possibly know everything, I know I

don't and I would be the first to admit it and I would defer to the people that know more than I
do on the subject such as the one that you are telling me. But I think the fact that we have had
this discussion now, leads me to believe in my opinion, alright, it would be worth you attending
on behalf of the Town of Southold. That is my opinion. I don't know what my colleagues feel
but I agree that putting it offtwo weeks isn't going to tell us anything more than what we have
talked about now because we talked about it 10 minutes more than we did this morning based on
the information that we had. That is it in a nutshell, for me.
COUNCILMAN KRUPSKI: Well, a couple of years ago when there was a downturn in the
economy and actually when I first got elected, a lot of these people, department heads and town
employees put in for meetings, seminars, a lot of these things were state requirements, the
building department, the planning board, the ZBA has state requirements, they offer different
meetings and seminars, you get so many credits and so we approved a lot these things as time
went on. Association of Towns, which some members of the Town Board and some town
employees attend on a regular basis, fulfilled a lot of these state requirements however, because,
Mr. Orlando and I noticed that a lot of town employees at the Association of Towns and as a
result, we asked the different department heads, different departments to try to eliminate a lot of
people going because you didn't have to send everybody there unless it was necessary to get
training. And we eliminated a lot of that expense for the town. Because there are free seminars
for a lot of these people, in fact, the building department is going to a free one, there are a lot of
people that we just authorize to leave town hall on their work time and go to a free seminar on
Long Island to get some of their credits that they need, we encourage that. It is still town time
but they are getting the necessary training to fulfill their requirements. So it is the obligation of
the Town Board to question everyone who works for the town on what they are doing because it
is not our money, if it was our money it would be a different story but it is not. And when I go
up and down the street, if I go to King Kullen or if I go to a store somewhere and people say,
what is the town thinking of, what did you spend that money for? I am responsible for those
people, it is not just the six of us up here. So if we don't consider everything, we are not really
doing our jobs.
MR. HARRIS: Oh, I understand that, Albert and when it comes to being physically responsible,
I think I have proven as an elected official myself, that I have been physically responsible
because I believe, if I am not mistaken, that I have had a surplus every single year in my budget
since I have been elected, so I am not what you call a spendthrift that I drain every single penny
or go beyond and then come to you with the rags on the elbows and the basket saying you know,
the basket it empty and I still got things to do. I have not done that. I try to run my department,
stay within the persona of the budget and I, like I said, again and I totally understand exactly
what you are saying but ifI didn't feel so strongly I wouldn't be here lobbying.
COUNCILMAN KRUPSKI: Well, my question is and this is why we wanted to talk about this,
is there any other way besides sending you to Las Vegas to find out what kind of equipment
would best suit the needs of Southold Town?
MR. HARRIS: Yeah, I can deal with a sales person. I can deal with every company that is out
within 100 miles of Peconic and then you're having, instead of getting just, you are getting a

sales pitch, okay?. I am not going for a sales pitch. I am going there because the person that you
are going to be talking to is not a sales person. They are the manufacturers, and every single
manufacturer is not going to, when you get done asking him questions is going to say, so can I
sign you up? That is not what they are there for. They are there to answer any and all questions
that you may have. Give you any and all literature that you may want to carry back with you,
okay?
COUNCILMAN KRUPSKI: Do any of these companies have websites or catalogs that you can
get that information from?
MR. HARRIS: Well, let me ask you this. Did you ever buy a farm tractor from a catalog?
COUNCILMAN KRUPSKI: Nope.
MR. HARRIS: Didn't think so. That is what I am trying to say. I don't want to buy from a
video, I don't want to buy from a picture. I want to be able to go and I can put my hand on it. I
want to be able to climb up in, I want to be able to bounce questions off a person that can answer
my questions. Not a sales person but the person from the manufacturer. That's the, and like I,
and again, every one that builds, it will be there. So the fact that you can go, when you get done
talking to this guy, you go down a ways and there is going to be another guy and you start all
over again. And you know, again, like I said, I don't buy off the interuet, I don't buy out of
magazines, I don't buy off of video, I want to be able to see it, I want to put my hand on it.
COUNCILMAN TALBOT: Do you guys want to revisit this? The resolution that was tabled?
COUNCILMAN RULAND: I do.
COUNCILMAN TALBOT: I would be willing to, mostly in light of the fact that I agree with
you Pete, that you pinch pennies down them, you know obviously there are some things that
could be even better down there or be better down there but I agree that the budget is tight and
you always keep it, you are not down there wasting money and you do a lot of work for the town
and I think you are going to get more than just information on the equipment down there, I think
you will speak with other superintendents out there and you will end up talking to the other trade
people that are dealing with the same products that you will be using all the time and I would
support sending you. So I think we should redo the resolution and...
COUNCILMAN ORLANDO: Before you do that, Benja had a question.

MR. SCHWARTZ: I was just curious, in the agenda it doesn't have the breakdown of what the
$1,900 is ....
COUNCILMAN TALBOT: We have a copy of that breakdown. I don't have it with me now ....
MR. SCHWARTZ: One thing, that is the issue here, is the money not just the content of what
you are going, it is a long way to go to Las Vegas and the Superintendent was asking (inaudible)

COUNCILMAN TALBOT: I tell you it was about (inaudible)
MR. SCHWARTZ: That is fine if he is going to an affordable place...
COUNCILMAN TALBOT: Well, it was around $700 in airfare, somewhere around $800 in
hotel and $300 in expenses of food and any other entry fees and stuff like that.
COUNCILMAN KRUPSKI: The entry fee was $50.
COUNCILMAN TALBOT: $50 entry fee as well.
MR. SCHWARTZ: Okay, because, you know, I know Pete has to buy food if he stays home,
too, so he could probably afford to feed himself but it is a little bit more expensive eating out so
maybe you want to give him an allowance for that and I think that is the issue.
COUNCILMAN TALBOT: Well, that was included in there. In that $1,900. Should I read
resolution 130 or at least put it out for a vote?

MR. HARRIS: Can I just, I cut it back, I am going to come home on the 25th, I cut the one day,
SO...
COUNCILMAN TALBOT: About $1,700.
MR. HARRIS: So the figures you have are correct for the 22nd through the 25th, (inaudible) were
higher and I cut it back and I am coming, we are going to come home a day earlier.
COUNCILMAN TALBOT: Is it still that $1,900 and change?
MR. HARRIS: Yes. The numbers you have is for the four days. Three night stay and airfare

I know your best effort will go forward and I am confident you will come home with a deal of
the century or a demo and make up that money, yes.
COUNCILMAN KRUPSKI: Pete, I think you are doing a great job running the department, I
have every confidence in your ability to buy new equipment. I have seen some of the used
equipment you have bought and I think you have done a great service to the town buying used
equipment and repairing it and using it but I think this is just not the fight time, with the town's
finances. It has nothing to do reflecting on you, your ability or your job because I think you are
doing a great job but I vote no.

to have Superintendent Harris come back to the Town Board in two weeks. I am pretty familiar
with the inventory of Las Vegas, I don't think that will jeopardize reservations, I realize it might
put a little more of a burden to book the flight but I am going to stick to this morning's decision
of the Town Board which was to have him come back in two weeks. So I am going to pass, well,
I will vote no because that wasn't the will of the Board just a few hours ago.

public meeting on long and short term solutions to erosion prevention along Hashomamaque
cove on Long Island Sound. That is what I know about the meeting. It says 1:00 here.
SUPERVISOR RUSSELL: Tomorrow's meeting?
MR. SCHWARTZ: Yes.
SUPERVISOR RUSSELL: That was moved to February 16. We just did a media alert today I
believe. It was firmed up for February 16 at 10:00 AM at the Peconic Educational Recreational
Center. The Albany contingent and others from other locations, the Army Corps etc. did not
want to travel given the forecast for tomorrow and from the road closures up west, I think they
probably made a wise decision.
MR. SCHWARTZ: Well, I am glad I caught you on that. The other thing is I just wanted to
