RICHMOND, Town Clerk CUTCHOGUE-NEW SUFFOLK PARK DISTRICT SUPERVISOR ALBERTSON: legal notice and affidavit attesting to its offic/al newspaper. "LEGAL NOTICE. NOT/EE OF PUBLIC HEARING. I will open the hearing by reading the publication in the NOTICE IS HEREBY GIVEN that the Town Board of the Town of Southold, New York, New York, Suffolk County, will meet at the Cutchogue schoolhouse, Depot Lane, Cutchogue, in said Town on the 29 day of November, 1961, at 7:30 o'clock P.M., Eastern Standard Time, for the purpose of conducting a public hearing on the question of authorizing, on behalf of the Cutchogue-New Suffolk Park District, the acquisition of the real property hereinafter described, at an estimated expense of $17,550.00, and the original improvement and embellishment thereof for use as a bathing beach, including a building and appurtenant equipment, at an estimated expense of $9,800.00. At the time and place aforesaid, said Town Board will hear all persons interested in the subject matter of said public hearing. "The aforesaid real property proposed to beacquired on behalf of said Park District, consists of two parcels, respectively described as follows: "PARCEL NO. I. ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, at Nassau Point, near Cutchogue, County of Suffolk and State of New York, bounded and described as follows: "BEGINNING at the intersection of the southerly line of Bay Avenue with the westerly line of Nassau Point Road; thence running along said southerly line of Bay Avenue, N.87°01'20"E. 223.53 feet 3 to ordinary high water mark of Little Peconic Bay; thence running southerly along said high water mark of Little Peconic Bay 1,363.35 feet more or less, the tie lines being as follows:- (1) S.4°53'20"W. 404.85 feet; (2) S.0°54'20"E. 220.11 feet; (3) S.3°02'50"E. 299.82 feet; (4) S.3°26'50"E. 438.57 feet to land of Nassau Point Causeway Association, Inc.; thence along said land of Nassau Point Causeway Association, Inc. RICHMOND, being duly sworn, deposes and says, that he is over 21 years of age; that he resides at Cutchogue, New York; and that on the 13 day of November, 1961, he posted copies of the notice which is hereto annexed conspicuously in the five (5) public places within the Cutchogue-New Suffolk Park District, in the County of Suffolk and State of New York, which are respectively described as follows: "1. SUPERVISOR ALBERTSON: Is there ahyone present who wishes to speak in favor of the Park District going ahead with this proposal? WILLIAM WICKHAM, ESQ., Mattituck, New York: I would like to day of Nov. 1961. /s/ Adele Payne, speak in behalf of the Commission in favor of this proposal. There are a lot of people who believe this is a most predominant occasion when the Commission presents their first petition for a park site. I will explain the work this group has done to bring this occasion about. It all goes back to 1954 in meetings of the Cutchogue Chamber of Commerce when there was an agitation for a park district in this section. The group realized all the shore fronts were being taken by private individuals and water front was becoming a premium and sooner or later people With inland property would have no access to water. In Mattituck to the west a commission had been started since the early 1940's and in 1954 they had obtained a large beach on Peconic Bay, two beaches on Long Island Sound, a parcel on the creek and also parking space in Mattituck. Since then it has acquired another large parcel on Peconic Bay. In that year we tried to get legislation enabling them to start a park district with park commissioners. There was opposition by the Comptrollers office and inspite of work by Ed Lupton, the Governor turned the bill down. The agitation continued because the shore fronts were becoming unavailable . In 1958 again this group started work and with the help of the Town Board and Lou Price and Senator Barrett we managed to get a bill through the Legislature. There was a sudden call from Albany that although the bill had passed there was opposition on the part of the Comptrollers office. Mr. Grathwohl and I went to Albany. We had a very interesting discussion with the counsel to the Comptroller and I called the counsel to the Governor and made an immediate appointment and we had a talk with him and after that Governor Harriman passed the bill. That fall the first election of Commissioners was held, and the Commissioners then. started to look for sites. We also retained counsel to help us in this, also a bonding attorney was retained; they have to approve the legality of the legislation and also the~spers. Unfortunately they found a flaw in the act. It was originally drawn by legislative draftsmen and we had to go into it again. This time the bonding attorneys passed the new enabling act and with their help and the help of the Town Board, local assemblymen and Senator we were able to secure the necessary legislation. This process slowed the operation of the Commissioners because they did not know where they stood. After the enabling legislation was passed and was approved by the Town Board the Commissioners began looking around for possible sites and there were months of conferences and finally a contract was entered into this last spring with the Nassau Point Causeway Association for part of their beach. (Mr. Wickham presented a map of the site.) On this causeway parcel we have a contract to acquire over 1300 feet from Bay Avenue to a point 300 feet from the north side of Nassau Point Road. The Nassau Point Causeway Association insisted on retaining a buffer zone. We had considerable discussion with the Association not only on acquiring this but also bringing into consideration at this time possible future developments of the causeway. In spots it is quite narrow and we have as a long range program, and perhaps with the ~lp of the Town Board and County of 8 Suffolk of expanding the beach. There is a possibility of getting a dredge in and the spill put in and the road shifted to the west and leaving more parking space along where the present road is now . That is based on the District getting the fill and if the two roads are abandoned. The contract provides that the Causeway Association will grant a new strip for a highway. Another matter in shifting this road to the~st~ at Bay Avenue the road is on the westerly part of the causeway and there is no room to shift over at that point. We were then able to acquire a contract from Mrs. Horton for the meadow land over to Pinetree Road. The Town does own a strip in there and there is hope there will be some cooperation to utilize the strip the=e. In addition to acquiring those two parcels there is the following expenses involved: $15,000 for the Nassau Point Causeway parcel and $800 for the Horton Parcel. We are asking, however, for a bond issue totaling $27,350. It is necessary if this parcel is acquired and is used for a bathing beach. It is required by the Board of Health that a suitable building be placed on the property and lifeguards be placed on the beach. The plans are that a small and attractive build/ng be placed in the northerly corner at an estimated cost of $8,500; lifeguard platform $100; boats and equipment $750; legal fees, survey and miscellaneous expsnses $2200, making a total of $27,350. If the acquisition is approved by the Town Board these moneys have to be raised by a bond issue. I have been very pleased to present this petition to the Town Board. We hope this is the first of many steps for waterfront property and inland property too. This District is to be governed by three commissioners and such sites are for the benefit of the district. The District comprises three school districts of New Suffolk, Cutchogue and East Cutchogue. The Town is growing and the District is growing. Parcels for the benefit of the people are very scarce and it is going to mean a constant search to get more parcels. It is our civic duty to provide parcels for the residents. We all know the popularity of this beach in years past and it is growing and is an excellent site and I think it will be even more popular and I think it will be even more important for the health and safeguard of the people if there is proper supervision of it. SUPERVISOR ALBERTSON: Is there someone else who would like to speak in favor of this project? MR. CURTIS HORTON, Commissioner: I am very much in favor of this project. I think it is a wonderful thing. I think it should have been done many years ago. Someone back 25 years ago could have gone to any beach, today we cannot do that. We are fortunate in having this beach, but in five years we may not be able to have it. MR. CAROL NEWELL: Is this beach going to be confined to the citizens of Southold Town or can anyone go there? SUPERVISOR ALBERTSON: This is a beach being bought and maintained by a park district and the people within the park district are paying for it and they are the ones who are able to use it. Other beaches are open until it gets to a point where they are overcrowded and they then have to make rules and the people are asked to get stickers. Does that answer your questio~ Mr. Newell? MR. NEWELL: I just wanted to know if it was for all the people in the Town. SUPERVISOR ALBERTSON: There is one beach in the Southold area that requires stickers. MR. HORTON: That is our idea to have it for this park district. However, we have nothing made up on that as yet for we haven't got the beach yet. SUPERVISOR ALBERTSON: Is there anyone else present who wishes to speak in favor of this project? (There was no response.) MR. JOHI~ FENSTER: How much of Broadwaters Creek will be filled in by ~e new improvement west of the present causeway? WILLIAM WICKHAM: I have no answer to that., that it would be just filled in a short distance. in the future.
