CHAIRMAN'S ANNOUNCEMENTS APPROVAL OF MINUTES Moved by Doug Hardy, seconded by Audrey Horton to Approve the Minutes of December 9, 2010. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Derek Bossen, seconded by Audrey Horton, it was RESOLVED to SUPPORT the Wetland Permit application of PAUL PAWLOWSKI to construct a detached garage and a 16'X 32' inground swimming pool. Located: 2404 Camp Mineola Rd., Mattituck. SCTM#122-9-7.20 Inspected by: Audrey Horton, Derek Bossen The CAC Supports the application with the Condition the drainage for the garage and swimming pool complies with the drainage code. The CAC recommends more information regarding the elevations. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MARY HUETTERMOSER to raise the existing first floor elevation from 18.6' to 20.6' by adding three courses of concrete block to the existing concrete block foundation walls; remove soil against the rear basement foundation wall to expose the wall to provide a walk out on grade basement area at elevation 11' and install windows and doors in exposed rear foundation wall; regrade rear and side yards to install decorative concrete block retaining walls to terrace existing sloping grade; rebuilding deteriorated concrete block wails; and in rear, side and front yards install wood decks and exit wood stairs in side yards. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of JOSEPH PAGANO to remove the existing bulkhead, install in same location 159 If. of vinyl bulkhead, remove existing 6'X 13' wood float, install new 6'X 20' wood float, 3'X 14' ramp, install two anchor pilings and replace approx. 20 cy. lost fill. SCTM#37-4-8 Inspected by: Jack McGreevy The CAC Supports the application with the Condition drywells are installed to contain roof run-off and the installation of a 10' non-turf buffer along both sides of the driveway/ramp on the seaward side of the dwelling. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of BARBARA PAGANO to remove existing bulkhead, install in same location 56 If. of vinyl bulkhead, reconstruct existing 6'X 20' wood float, 6'X 10' wood float, 3'X 14' ramp, 3'X 6' platform, install two float anchor piles, and replace approx. 10 cy. lost fill. SCTM#37-4-9 Inspected by: Jack McGreevy The CAC does Not Support the application because the proposed dock does not adhere to the existing pier line and two floating docks are not permitted in accordance with Chapter 275. Vote of Council: Ayes: All Motion Ca rfS¢.~ Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of JAMES & KATHLEEN BLACKLEY to construct an addition to the existing dwelling, in-ground swimming pool, drywell and pool mechanicals, remove portion of existing rear decking, construct a patio with wall, install steps to the remaining existing decking and construct a deck addition. Located: 415 Harbor Lights Dr., Southold. SCTM#71-2-4 Inspected by: Peter Young Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL BEHRINGER, NISHA KUMAR & ELIZABETH GARNDER to reconstruct the existing stairs, repair/replace existing timber dock, add new 32"X 20 ramp and 6'X 20' floating dock and construct stairs from dock to beach running parallel to the bulkhead. Located: 1665 & 1755 Shore Dr., Greenport. SCTM#47-2-30&31 Inspected by: Doug Hardy, Peter Young 4 The CAC Supports the application with the Condition the docking facility is constructed with lateral access complying with the original approved dated 2/27/08 and consistent with the public trust doctrine. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL BEHRINGER to reconstruct 100 If. of existing bulkhead to be rebuilt in-line with neighboring bulkhead using C-Loc vinyl sheathing, install two (2) new 12' returns, and split-rail fencing with child-proof mesh at top of bulkhead. Located: 1755 Shore Dr., Greenport. SCTM#47-2-31 Inspected by: Doug Hardy, Peter Young The CAC Supports the application, however the bulkhead is inconsistent with the public trust doctrine. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of GEORGE BALDWIN to add 8' long extensions to the bulkhead's existing returns; add gabions up to 24 If. to the northeast; add four tie backs to existing lower wale; and install a 10' non-turf buffer landward of AMHW. Located: 1045 Island View Lane, Greenport. SCTM#57-2-21 Inspected by: Doug Hardy, Peter Young Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit & Coastal Erosion Permit applications of CAROL KANE to install a 2' X 62' long retaining wall on the edge of the bluff to prevent erosion and strengthen bluff edge. Located: 3100 Sound Dr., Greenport. SCTM#33-1-18 Inspected by: Doug Hardy, Peter Young The CAC Supports the application with the Condition of an engineered plan for erosion control on the bluff. Vote of Council: Ayes: All Motion Carried Moved by Audrey Horton, seconded by Derek Bossen, it was RESOLVED to NOT SUPPORT the Wetland Permit application of JUNE & GORDON SEAMAN, JR. to replace existing 3.5'X 9' wood walk/step and 3.5'X 10' fixed dock with a new "L"-shaped fixed dock, consisting of a 3.5'X 24' fixed timber walkway and 4'X 12' fixed platform, connected to one another by a 2'X 5' fixed "bridge" section. Located: 1570 Cie Jule Lane, Mattituck. SCTM#122-4-3 Inspected by: Audrey Horton, Derek Bossen The CAC does Not Support the application because the position of the proposed dock exceeds 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of WINDWARD ROAD ASSOC. to construct beach access stairs consisting of a top landing 3'X 7', upper stairs 3'X 16', bottom landing 3'X 3', and lower stairs 3'X 5.6' on a right-of-way owned by Peter & Grace Gorman. Located: 440 Windward Lane, Orient. SCTM#14-2-30.6 Inspected by: Jack McGreevy The CAC does Not Support the application because a set of functional stairs currently exists on the property and new construction would be redundant. Stairs constructed on a steep bluff should be engineered to mitigate erosion. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Audrey Horton, it was RESOLVED to SUPPORT the Wetland Permit application of ERIC KOENIG to construct a two-story, single-family residence with 1890 sf. first floor and 1605 sr. second floor, 406 sf. two car garage, 1755 sf. cellar, 233 sf. front porch, 198 sr. second floor roof deck and 295 sr. rear decks. Located: 610 Jackson Landing, Mattituck. SCTM#113-4-8 Inspected by: Audrey Horton, Derek Bossen The CAC Supports the application with the Condition trees over 6" in caliper are depicted on the survey, the area seaward of the house and up to the 6' contour should be non-turf and non-disturbance seaward of the 6' contour, and no filling seaward of the house. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of DOUG & ELLEN ClAMPA to demolish the existing dwelling and abandon the existing sanitary system; construct new dwelling with attached garage; new sanitary system; swimming pool and stone terrace on grade; and subsurface drainage. Located: 4380 Paradise Point Rd., Southold. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of DONNA SALMINEN to install a vinyl-sheathed retaining wall along the bottom of bank within the eastern section of subject proper~y, measuring 65' long (inclusive of a 6' long vinyl sheathed return), which is to measure 4' in height; backfill behind the proposed retaining wall with 100 cy. of clean fill obtained from an approved upland source. Located: 320 Lake View Terrace, East Marion. Vote of Council: Ayes: All Motion Carried 7 Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of WALTER GAIPA to install a vinyl-sheathed retaining wall along the bottom of bank within the eastern portion of subject property, measuring 73' long overall (inclusive of a 6' long vinyl-sheathed return), which is to measure 4' in height; backfill behind the proposed retaining wall with 100 cy. of clean fill obtained from an approved upland source. Located: 360 Lake View Terrace, East Marion. SCTM#31-9-12 Inspected by: Jack McGreevy The CAC Supports the application with the Condition drywells are installed to contain roof run-off from the dwelling. INC. to construct approx. 146 If. of vinyl bulkhead in place of (and 6" higher than) existing timber bulkhead; construct 3'X 3' wood platform, 3'X 10' stairs, and 3.5'X 5' beach steps in place of existing platforms and steps; backfill with up to 10 cy. clean sand as necessary to restore embankment, which is also to be replanted with native vegetation. Located: 550 South Lane, East Marion. SCTM#38-6-10 A recommendation was made, however, the Motion was lost. Moved by Jack McGreevy, seconded by Audrey Horton, it was RESOLVED to SUPPORT the Wetland Permit & and Coastal Erosion Permit applications of MICHAEL & KATHLEEN MIGGINS to construct approx. 71 If. of vinyl bulkhead in place of (and 6" higher than) existing timber bulkhead; construct 3.5'X 6' steps to beach in place of existing beach steps; and revegetate with native plantings along disturbed portions of embankment. Located: 640 South Lane, East Marion. SCTM#38-6-8 Inspected by: Jack McGreevy The CAC Supports the application with the Condition the applicant demonstrates the need for raising the bulkhead 6" higher and consider alternatives such as a revetment. Vote of Council: Ayes: Jack McGreevy, Audrey Horton, Peter Young Nay: Doug Hardy Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMITS 8 Moved by Audrey Horton, seconded by Derek Bossen, it was RESOLVED to NOT SUPPORT the application of JANET I. DORAN to Amend Wetland Permit #4173 for the existing stairway and 8'X 30' deck. Located: 9575 Nassau Point Rd., Cutchogue. SCTM#119-1-3 Inspected by: Audrey Horton, Derek Bossen The CAC does Not Support the application because the stairs should conform to the original permit and erosion control devices should be installed at the base of the supports. The CAC also observed a small boat-lift off the deck and that there is limited public access. Vote of Council: Ayes: All Motion Carried CARDINAL EAST COAST DEVELOPMENT, LLC to Amend Wetland Permit #7182 to include modifications to the landscaping, swimming pool and retaining walls. Located: 4550 Wunneweta Rd., Cutchogue. SCTM#111-14-33.1 The CAC did not make an inspection, therefore no recommendation was made. Member Derek Bossen will attend the next regular meeting of the Board of Trustees scheduled for Wed., January 19,2011. The next meeting of the Conservation Advisory Council has been set for Wed., February 9, 2011 at 4:30 PM at Down's Farm Preserve.
