PROPERTY FACTS/DESCRIPTION: The applicant's property is unimproved land containing 63,302 square feet, shown on the January 6, 2005 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: Requested in this application is a variance under Zoning Code Section 280-18 (formerly numbered 100-30A.3, Bulk Schedule), based on the Building Inspector's May 31, 2006 Notice of Disapproval concerning an application for a building permit and applicant's proposal to build a single-family dwelling at less than the code-required 50 feet from the rear lot line at its closest point. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 30, 2006 and March 29, 2007, at which time written and oral evidence were presented. The written portion of the recorded was extended until April 19, 2007. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant has applied for a reduced setback for a proposed new dwelling with three-car garage, at 25.2 feet from the northerly rear lot line, at its closest point, instead of 50 feet. Based on the Building Inspector's determination issued, the Board's jurisdiction is limited to the code restriction defining the setback area to be at least 50 feet of the rear yard property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is vacant land and uniquely situated. The land contains variables with the shape, topographical contours, views, neighborhood concerns, closeness to the waterway (Goose Creek), closeness of other homes and their view areas. The existing elevation where the three-car garage section of the proposed home is to be sited, at the northeast corner, is currently shown to be 8.6 feet above mean sea level. The opposite side of the proposed dwelling contains wetlands and non-disturbance buffer areas with lower elevations. The parcel consists of a great deal of frontage along the wetlands adjacent to Goose Creek, the depth of the lot is reduced, making it more difficult to place a dwelling with attached garage. The benefit sought by the applicant can be achieved by alternative relief as noted below, and feasible for the applicant to pursue. Although the applicant has obtained other agency approvals prior to applying for a variance from the Zoning Code, the alleged difficulty is self-created because the applicant could take advantage of the fact that the house is not currently built and could redesign the footprint (size) to conform to the unique shape of this property. The Board does recognize the necessity of connecting the proposed house to a proposed garage as an accommodation and convenience to an owner who has a medical history, planning to reside in the home and the need for some variance relief. 3. The relief requested is substantial for the requested 25.2 ft. rear yard set back, amounting to a 50% reduction from the code required 50 feet. When it is combined with the 27% wetlands variance granted by the trustees, it begs for a solution other than a 50% code reduction in the setback requirement. 4. The difficulty is self-created because the applicant could take advantage of the fact that the house is not currently built and could redesign the footprint (size) to conform to the unique shape of this property. 5. No evidence has been submitted to suggest that alternative relief at a greater setback from the rear property line in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief for a 25.2 ft. setback is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with an attached garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The applicant's request is not the minimum necessary since a new design of the size of the dwelling with garage could increase the rear yard setback greater than the requested 25 feet. Also, conditions are necessary to mitigate many of the concerns addressed in the record. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Oliva, and duly carried, to DENY the relief as applied for, and to GRANT alternative relief for a minimum 37 ft. rear yard set back, subject to the following conditions: That hay/straw bales be placed seaward of the proposed foundation and wrapped around said foundation to a distance of approximately 50' to the northwest, and the northeast. That the construction of the proposed two-story attached garage BE REDUCED to a one and one- half (l~)-story garage, not to exceed 18 feet in height to the top of the ridge, or a ceiling height above the first story at not greater than seven feet in height. That the proposed attached garage (attached to the dwelling) be screened from the contiguous property to the north. The minimum distance of screening shall be 48 feet in length, commencing at the beginning of the northeasterly point of the garage and moving west, on a straight line about 5 feet inside the applicants property line. The screening should be of evergreen type, a minimum height of 5 to 6', and continuously maintained. Proper roof drainage of the garage should be maintained by the use of roof gutters and downspouts, as per code. This runoff should be placed in a drywell large enough to accommodate the same, as per code. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
