Box 2492 Sag Harbor, NY 11963 Re: Approval: Site Plan for the Cutchogue/New Suffolk Historical Council Located at 27320 Main Road, on the S/W corner of Main Road and Case's Lane, Cutchogue SCTM#1000-109-5-6.1 Zoning District: R-40 Dear Mr. Studenroth: The Southold Town Planning Board adopted the following resolutions at a meeting held on Monday, January 10, 2011: WHEREAS, this site plan is for the construction of a 660 sq. ft. storage building on a 1.38 acre parcel owned and operated by the Cutchogue/New Suffolk Historical Council located in the R-40 Zoning District on the s/w/c/o Main Road and Case's Lane, Cutchogue; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3) has determined that the proposed action is a Type II Action as it falls within the following description for (6 NYCRR, Part 617.5 (c) (7): "construction or expansion of a primary or accessory/appurtenant, non- residential structure or facility involving less than 4,000 s.f....... and not subject to review under SEQRA; and WHEREAS, pursuant to Southold Town Code §280-133 C, the Planning Board has found that requiring the entire set of site plan application requirements for this site is not necessary for the following reasons: the application is for a storage building on a previously developed site, will not be open to the public, and is small in size relative to the existing structures on site and size of the parcel. Therefore, the Planning Board will require only the following site plan application items: §280-133 A. (1-5), B. (1)(a - e), B. 3(a) and B. 4(a) (b) and (i); and Cutchogue/New Suffolk Historical Page Two January 10, 2011 Council WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B (5), has the discretion to vary or waive the parking requirements for site plan applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan Requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because there is no need to provide for parking - the storage building is not open to the public, and there is parking existing on site in connection to the over-all use of the site; and WHEREAS, an application for a site plan was submitted on October 8, 2010, including a site plan prepared by John C. Ehlers, L.S., dated June 4, 2010; and WHEREAS, on November 1, 2010, during a Planning Board Work Session, the application was formally accepted for review; and WHEREAS, on November 3, 2010, the Southold Town Planning Board distributed the application to agencies having jurisdiction for their comments, and the following agencies responded: Town Engineer, Architectural Review Committee, and Cutchogue Fire District; and WHEREAS, the comments from those agencies referenced above were received and accepted by the Planning Board, discussed with the applicant, and incorporated into the site plan to the satisfaction of the Planning Board; and WHEREAS, on January 7, 2011, the Town of Southold LWRP Coordinator reviewed the above-referenced project and had recommended the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on January 7, 2011, the Southold Town Building Inspector reviewed the plan and certified that the proposed use is a permitted use in this Business Zoning District; and WHEREAS, on January 10, 2011, a public hearing was held and closed; therefore, be it RESOLVED, that the Southold Town Planning Board has determined that the action is consistent under the policies of the Town of Southold Local Waterfront Revitalization Program in a memo prepared by the LWRP Coordinator; and be it further RESOLVED, that the Southold Town Planning Board hereby waives the full site plan requirements pursuant to Southold Town Code §280-133 C and only will require those as described above; and be it further RESOLVED, that the Planning Board hereby waives the full parking requirements pursuant to §280-131 B (5), as described above; and be it further f Cutchogue/New Suffolk Historical Page Three January 10, 2011 Council RESOLVED, that the Southold Town Planning Board grants Approval with a Condition to have an archeologist on site during any excavation and authorizes the Chairman to endorse the site plan entitled "Survey Of Property Cutchogue" prepared by John C. Ehlers, L.S., dated June 4, 2010. Please also note the following requirements in the Southold Town Code relating to site plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Approved site plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the approved site plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board, or its representative, must inspect the site to ensure it is in conformity with the approved site plan and issue a final site inspection approval letter. Should the site be found not in conformance with the approved site plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the approved site plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. Conduct a cultural resource investigation when an action is proposed on an archaeological site, fossil bed, or in an area identified for potential archaeological sensitivity on the archaeological resources inventory maps prepared by the New York State Department of Education. 1. Conduct a site survey to determine the presence or absence of cultural resources in the project's potential impact area. 2. If cultural resources are discovered as a result of the initial survey, conduct a detailed evaluation of the cultural resource to provide adequate data to allow a determination of the resource's archaeological significance. It is used for historical tours and storage of items related to the town's history. BASIS OF APPLICATION: Request for Variance from Special Exception per Code Section 280-13B(15) and Variance from Code Section 280-18 based on an application for building permit and the Building Inspector's July 19, 2010, Notice of Disapproval concerning construction of a new building; #6416 - owners request a Special Exception for Historical Society, #6420 an area variance for a location at less than the code required front yard setback of 50 feet. RELIEF REOUESTED: The applicant proposes to construct a museum exhibit/storage building at a 16.5 foot setback from the front yard when the code requires a 50 foot setback from a front yard as shown on the survey prepared by John C. Ehlers, L.S. dated June 6, 2010. The applicant also requests a special exception for the structure to be used by a historical society. ADDITIONAL INFORMATION: The Town of Southold Planning Board reviewed the application and in a memorandum dated August 5, 2010, the Planning Board stated no objection to the requested Special Exception, and recommended that the ZBA rely on comments from the Landmarks Commission regarding the proposed area variance for the front yard setback. In a correspondence from James Grathwohl, Chairman of the Landmarks Preservation Commission, dated Sept 9, 2010, they advised the Board that the subject parcel is not on the register Page 2 -October 7, 2010 ZBA Filc#6420-Cutchogue-Nm Suffolk Hist. Col. CTM: 1000-109-5.6.1 of historic places and therefore the proposed construction does not require the review by the Southold Town Landmarks Preservation Commission. The proposed accessory structure is to be used to exhibit an antique truck and for storage of other items of historic interest. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 23, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town law 5267-b(3)(b)(1). Granting of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed accessory structure is only 660 sq. ft. and will have the same characteristic design as the other historic structures on this parcel. The subject property has two front yards and the proposed location appears to be set back from Case's Lane at a greater distance than the proposed non-conforming 15 feet because the property line is not near the road bed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed structure could be constructed at a conforming setback, however the proposed location is close to an existing paved parking area and another historic structure, which will facilitate the orderly touring of these historic buildings and museums. It is also to the advantage of the applicant to cluster the buildings so as to maintain its open spaces for summer concerts and other outdoor events enjoyed by the residents of the Town of Southold. Finally, the proposed accessory structure needs to be close to the road because it will house an antique truck that will be regularly driven in and out of the building. 3. Town Law 5267-b(3)(b)(3). The variance granted herein is mathematically substantial requiring a 33.5 foot or 67% variance from the code required 50 feet. However, the variance requested herein may be considered less substantial when considering the parcel has to two front yards, one along the Main Road where the proposed structure is setback greater than 100 feet and the other (subject setback) along Case's Lane where the proposed structure is approximately 40 feet from the edge of pavement. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The accessory structure is proposed to be located on a relatively flat portion of the site and will be fitted with gutters and leaders for control of roof runoff as per code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant could have proposed the structure in a conforming location without the need of a variance; but due to the location on the property of various historic buildings and the need to preserve open space for outdoor events, the proposed non-conforming best meets the needs of the Society (see 2 above) 6. Town Law 6267-b. Grant of requested relief and Grant of the Special Exception for use by a Historical Society is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a museum exhibit/storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Therefore, it is unknown if the proposed action will impair important archaeological resources at this time. o To further the intent of the above policy it is recommended that an archeologist be on-site during the excavation of the building foundation. • ARC o Approved as submitted • Building Inspector Certification o A permitted use. A Request for certification was sent to the Building Department. V: Staff Recommendations - The Planning Department recommends the Planning Board considers the following: 1. The Planning Board requested the following information to be submitted for review and the following responses were received for consideration: a. Drainage details - no drainage was to be proposed and there is no access proposed from the street, nor is there new impervious surfaces being proposed. In speaking with the Town Engineer, he mentioned a drainage pool 8 XV diameter would be sufficient to contain potential runoff on site. Staff recommends that the applicant hand draw drainage on the survey. b. Proposed lighting details - no lighting is proposed because the building is not open to the public and the facility is not open at night. No lighting is recommended. It should be noted that there are streetlights along Cases lane that light the parking area and lighting for the structure itself is not necessary for the reasons stated above. c. Parking- The new building will not be open to the public, will not increase the number of people on site and is proposed as a storage- building barn. For these reasons the recommendation is to not require parking for this structure or increase parking on site. It should be noted that there is a parking area adjacent to the proposed building that need some improvements. It is recommended for the applicant to re-strip the parking stalls and provided an ADA compliant parking stall. It would be recommend for the applicant to provide the following notations on the plan stating: i. That stripping for off street parking stalls will be provided in the paved area and, ii. An ADA compliant parking space will be provided prior to a certificate of occupancy being issued for the new building.
