Rose PROPERTY LOCATION: 145 King St., Orient, NY SCTM# 1000-26-1-23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 8, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 6,731.55 sq. fi. parcel in a R-40 District, with 61.50 fi. of frontage on King St., 108.90 feet on the west property line, 61.50 feet along the north property line and 110.00 feet on the east property line. It is improved with a one story dwelling and a two story accessory building as shown on the survey by Nathan Taft Corwin, III Land Surveyor, dated last revised October 17, 2009. BASIS OF APPLICATION: Requests for variances from Code Section 280-124, based on an application for building permit and the Building Inspector's September 10, 2010 Notice of Disapproval concerning reconstruction of a single family dwelling: (1) less than the code required combined side yard setback of 25 feet (2) less than the code required rear yard setback of 35 feet. The Building Inspector also indicates that the Town Code requires a Certificate of Appropriateness from the Town Landmarks Committee under Local Law 22 on this application. RELIEF REQUESTED: Applicant is requesting a rear yard setback of 25.9 feet where the code requires 35 feet and combined side yards of 24.9 feet where the code requires 25 feet. They are proposing to construct a second story addition and renovations to the dwelling. The applicants' want to place a new foundation under the present dwelling and convert a small screened porch on the northwesterly rear comer of the cottage to interior space. The total side yards are almost conforming and the front yard is conforming. ADDITIONAL INFORMATION: The agent/architect for the applicant was asked to provide more detailed information to the Board of Appeals regarding the proposed reconstruction and additions, specifically about the structural soundness of the existing dwelling to support a partial second story, and the process of lifting it and Page 2 - January 19, 2011 ZBA Fileg6430 - Rose CTM: 1000-26-1-23 constructing a new foundation, per FEMA regulations, under it without demolishing the dwelling. Also the Board asked if the applicant would consider alternative relief by moving the house forward toward the street to create more distance between the dwelling and accessory building in the rear and partial side yards. In a letter dated December 30, 2010 from the agent Samuels & Steelman Architects, the Board received assurances that the proposal would not result in a demolition and that, moving the existing footprint toward the street would be extremely costly because it would involve new reviews and permits for the existing septic/sanitary system located in the front yard. The applicant previously received a variance for the existing non-conforming lot coverage of 28.2% under ZBA Decision #6130. FIND1NGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2, 2010 and January 6, 2011 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.. The subject property is located in the historic Village of Orient where the homes are close together on small lots, many of which have been converted from seasonal to year round dwellings, as proposed by the applicant.. None of the lots in the immediate area conform to zoning as the homes were built prior to zoning. The proposed height of the second story addition is 23.2 feet from existing grade, which is well below the code maximum of 35 feet and in keeping with the neighborhood. The entire second story addition is within the code required setbacks. No changes in existing non-conforming setbacks are being proposed and the applicant's architectural design must be approved by the Town's Landmarks Preservation Commission to be sure it is compatible with the historic character of the neighborhood. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the rear yard setback could be made more conforming to the code by moving the dwelling toward the street, at the Public Hearing it was explained by the owner and their agent that moving the house would create an unnecessary hardship on the applicant due to the location of the existing septic system. Also, the house has existed in its current location pre-zoning and is situated within an historic district at its current setbacks. Town Law §267-b{3}{b){3). The variance requested for a combined side yard setback of 24.9 feet represents a 1% variance from the code required 25 ft. and is not substantial, The variance request for maintaining the non- conforming rear yard setback of 25.9 ft is a 26% variance from the code required 35 ft. setback. However, most of the lots in the immediate area are significantly non-conforming in size and width. Town Law §267-b{3){b){4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The house will remain within its existing footprint and all storm water runoff will be retained on site. Town Law §267-b(3}(b){5). The difficulty has not been self-created, since this is a pre-existing non-conforming dwelling any type of renovations will require variances. Town Law §267-b. Grant of this variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed home with second story, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Schneider, and duly carried, to ' Page 3- January 19,2011 ZBA File#6430 - Rose CTM: 1000-26-1-23 GRANT~ the variance as applied for, and shown on the drawings labeled SP, 1, 2, 3 and the proposed south elevation date stamped received Oct. 27, 2010 prepared August 10, 2010 by Samuels & Steelman, Architects. Condition: Variances are granted subject to the applicant receiving a Certificate of Appropriateness from the Town's Landmark Preservation Commission, as required per Town Code Local Law 22. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Enclosing the existing covered porch where the new kitchen is proposed is located in the rear yard and will not be seen from the street. B. The site is located in the AE Flood Zone which requires that the lowest floor elevation to be at 9'. The existing first floor is currently at elevation 8.79'. To comply with FEMA, the grade below the first floor will need to be level with the adjacent grade and have flow thru vent around the perimeter foundation. To maintain a minimum 18" from the bottom of the floor structure to grade, the house will be raised approximately 1' to Elevation 9.8' and a new foundation will be constructed. This will not be an undesirable change because new the first floor elevation will be similar to adjacent properties. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance because: A. The only area where it would be feasible to add on to the house, where a setback variance would not be required, is the from of the house. An addition in this area would still require a variance because it would increase the lot coverage which is currently at 28.25%. Enclosing the existing porch with a new kitchen will not increase the lot coverage because it is has been included in the existing lot coverage calculation. A variance was granted May 8, 2008 for the increase in lot coverage above the allowable of 20%. B. Portions of the existing house are within the rear and side yard setbacks and as a result the increase in the first floor elevation will require a variance. There is no other feasible method to pursue to meet the FEMA requirements. (3) The amount of relief requested is not substantial because: A. The existing covered porch is integral to the original design of the house. It is covered by the main roof which is pyramidal in design and has an existing floor structure. The addition of two walls with windows is not substantial because the design utilizes existing space and does not increase the footprint of the existing house. B. Raising the first floor one foot is not substantial and is the minimum amount required to meet the FEMA requirements and also have enough clearance under the building for access. ~ECEIVE~ I~OARD OF APPEALS (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: A. The proposed renovations are minimal and are within the existing footprint of the building. B. The FEMA requirements will not have an adverse effect because it is a minimal change in floor elevation and will allow water to flow naturally over the site and under the building. Also, the applicant/owner testified at the March 27, 2008 public hearing that he has terminated his website custom furniture business operated from his woodworking shop in New Jersey and will be using the proposed accessory woodworking shop/garage for the creation of small scale metal and wood fabrications as a personal hobby In his pending retirement and not for any business/retail use. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the setback variances and lot coverage will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are several other large accessory structures, including two story structures, in the area and the proposed 3' setbacks for the new accessory garage and home hobby woodworking shop will decrease the degree of non-conformity of the 2.1' and 2.4' setbacks for the existing one story structure. Although the proposed new 2 story construction will be approximately twice the size of the existing structure, the proposed dormers and massing of the roof forms are designed to reduce thc overall bulk and to cast shadows primarily on the garage to the east. The increase in proposed lot coverage is minimal at 55 square feet. With respect to the use of the building, the owner will continue thc accessory use as per code for a one-car garage and homeowner's private hobby woodworking shop, without business or commercial activities, and will not be used for habitable space. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some ~nethod, feasible for the applicant to pursue, other than an area variance because thc proposed two-story replacement garage and homeowner's personal (non-commercial) hobby woodworking shop cannot meet the code required 5 feet setbacks because that would locate the garage door partly behind the existing house, thereby denying functional access by car to the garage space using the existing driveway that runs along the easterly property. An increase in lot coverage also requires a variance since the existing house and garage constitute 27.4% lot coverage, which is already beyond the code permitted 20%. 3 Town Law §267-b(3)(b)(3). The proposed setback variances of 3 feet are substantial at 40%. The requested lei; coverage of 28.25% represents a 41% variance. However, denial of the increase in lot coverage of an additional 55 square feet of footprint would necessitate a change in the pitch of thc proposed roof configuration that would create an increase in the mass and height of the structure, thereby creating a greater impact on the character of the neighborhood than the proposed increase in lot coverage would generate. The request to include insulation and an HVAC system to allow the proposed accessory structure to be used as a year round habitable space for home hobby small scale woodworking is substantial and represents a 100% variance in an accessory structure. 4. Town Law §267-b(3)(b)(5). The difficulty has been self-created in that the applicant has chosen to increase the footprint of the ex/sting accessory structure beyond that permitted by code and to construct a 20 feet high structure with 3 ft. setbacks in order to use the second floor as habitable space when on 18' accessory structure with 3 ft. setbacks would not have required a variance. The existing structure is a one story, light framed house with a locust post foundation. The existing condition of the structure is currently structurally sound but is starting to experience some settling where the locust posts are deteriorating. There is the possibility of some dry rot at the floor structure where the house sits at grade level and is lacking adequate ventilation at the crawl space. The exterior perimeter walls are 2x3 at approximately 20" on center with no insulation or interior finish. The ceiling are framed with 2x4 ceiling joists and 2x6 roof rafters. There currently is only a single space heater that is inefficient for heating the house and is only use in the late fall and early spring. As part of the general renovations proposed, the existing locust post foundation will be removed and new perimeter concrete block walls and piers will be constructed. Since this work is required to stabilize the structure, meeting the FEMA requirement is possible. A house mover will be employed to brace the house internally and lift it to the required elevation so that the foundation will be able to be constructed and any dry rot found in the floor structure will be remove and new joists installed either adjacent to the existing or replaced in kind. To keep with the existing interior character of the house, lx6 horizontal boards will installed instead of sheetrock to recreate the look of the horizontal sheathing that is currently exposed. A new second floor will be constructed within the existing roof area. Structural beams and columns will be introduced at the main bearing walls in the existing house and new pier at the foundation will be installed to pick up all point loads. The existing roof rafters will be cut and will be supported at the new second floor walls. Every aspect of this project requires thought in the design and construction phases so that the existing structure can be maintained. The owner is committed to saving this house and understands that the work being proposed is complex and costly but recognizes the value of this historic structure. Working closely with the Town of Southold Landmarks Commission will also insure that the project is respectful of not only this historic house by also the Historic District of Orient. Mr. Gerriger also asked if the Owner would be willing to move the existing house towards the street by five feet. We believe the Board has now received a letter from the Owner responding to that question. At a more technical level, we spoke with Mike Verity of the Town of Southold Building Department and he has stated that if the house is moved, even as little as five feet, he would required approval from the Suffolk County Health Department for a new sanitary system. The current design does not require sanitary approval because the house is maintaining its current location and not adding additional bedrooms and in fact is decreasing bedrooms. The current systems has been recently upgraded. Normally the design of a new sanitary system to meet current standards would not be difficult except without public water and small lot sizes in the Village this would force the applicant into the Board of Review at the Health Department. This is due to not meeting the required distances from neighboring we!!s to the proposed sanitary system or even meeting required distance from the owner existing well to the proposed sanitary system. The added issue of high ground water would require that the existing sanitary system be a shallow pool system which would require that the bottom of any leaching pools be three feet about ground water. This would require that either the sanitary system be raised above grade with either a natural slope or contained within a retaining wall system. By raising the sanitary system, the existing house would need to be raised higher than proposed or a pumping system would be required to be installed. In 1909, when John Sharpe built the house, he placed the structure in harmony with pre-existing homes. Moving it will destroy the original historic balance on King Street. We intend to renovate our home of thirty years within the historic footprint and location.
